    Dear Diary,

Sorry I am writing this to you so late tonight. I have been busy with a few of my ghost friends. My ghosts come to visit me when I am by myself and things are really quiet. Johnny Cochran has been giving me really good legal advice. I listen to him more than I do to Nurmi. That is why I completely ignored most of what Nurmi wanted me to say today. I mean, seriously! He wanted me to say that I was sorry for killing Travis! Well, I absolutely refuse to feel bad for Travis being dead. He practically killed himself. Travis had a chance to make the right decision. I gave him plenty of opportunities. It was his choices that wound him up butchered. Not mine!

I have been thinking a lot about love lately. I'll admit that I don't understand the concept very well. I have heard people saw that love means never having to say you are sorry, right? So why should I have to say "I am sorry" for what Travis made me do to him? If anyone deserves an apology, it is ME. Look at what Travis is putting ME through. It is MY life that is practically over. It is MY life that is on the line...not his. Travis gets to be in a much better place...where do I get to be? In jail. It is completely unfair! I have tried to love Travis enough to forgive him for what he has done to me, I really have. But, it is just too difficult. Maybe someday I will be able to...but I seriously doubt it.

It was so awful when I had to talk about how I almost died when I almost tried to commit suicide. That paper cut nick from the razor was the MOST pain I have ever felt in my WHOLE life. And for the next two days, anytime I bent my finger, I could feel the searing pain again. I hope I never have to feel that kind of pain again. It is just too much to bear. Talking about it today in court almost made me feel like I could cry. How can anyone even focus on Travis when they see the kind of pain I have been through?

Well, I better go. I am conducting a group seance tonight and I don't want to keep the spirits waiting.

    Till next time,
    Jodi

I don't think it will work, but .......... I still see the sting of the crazy juries in history that bought a lot of BS.

There's somehow that 'duty to retreat' is being argued too. It's one of the things this judge ordered she rule on later. So that has be wondering when and how that applies or if somehow Nurmi will get that tossed as one of the things the jury can hear.
Oh, I know you are definitely not on Jodi's side!

I'm just saying, in my own person, non-legal opinion, that I don't think her claims are going to fly.

The jury is a concern, definitely. It would not be the first time that jurors have made highly questionable decisions, and I agree the prospect is there, that someone will decide Jodi was abused, or that she was telling the truth, somewhat; that she just snapped and doesn't remember. Or whatever.

I know, if this were a case with a judge deciding, Jodi would be found guilty and probably sent to ride the lightning. But, it's possible that some of the jurors are not the brightest, or most logical, or are going to apply personal feelings or experiences in deciding whether to buy what Jodi is selling.

It's definitely a concern that I have, that they could end up with one or two people hanging this jury.

A question for everyone: What do you think she should be charged with? VS What do you think she'll actually be charged with?

there are no jury instructions yet - they are not given until they go to deliberate

She should be charged with First Degree Murder, all the way.

With the evidence, the brutality, and the obvious premeditation, I wouldn't accept a lesser charge.

Not to mention, the fact that the murder came during the commission of a felony -- as Jody is claiming the gun belonged to Travis and she stole it, that would qualify her for First Degree. Murder/burglary.

thanks, I just wanted to make sure I was being clear. I can't imagine her walking away from this but if she ends up with something like only 20 years I will cry.

Especially since she would probably get credit for "time served".

there are rules to being a juror and jury instructions which instruct how they will deliberate - we have no idea what the instructions will be - we don't know if the judge is going to offer a lessor plea - we don't know what they lawyers are going to ask to be included or discluded until the judge actually gives them - they have not been advised on arizona law yet or what laws apply to this case or how

One reason this case is so intriguing is because despite all the evidence, there still are a lot of unknowns. Even after Jodi's testimony no one can be sure how exactly things played out however strongly they pretend to have the inside scoop because of their training or insight or whatever, they weren't there, no one alive knows but Jodi. That's why there are so many different theories on this forum and even among so-called experts. For instance, I can't believe some people think Travis had no idea Jodi was taking pictures of him the day of his death even when there are snaps of him in bed looking at the camera and holding up a "peace sign", but truly I don't know for sure, because I wasn't there. The pictures we have are maddening because they give glimpses but hide just as much. I think if you look at the evidence objectively you have to admit there is a lot we don't know. From the text messages from Travis it does show that he was very angry at Jodi, insulting her, and threatening to destroy her reputation among their circle of friends. Yes no one knew Travis to be violent, but they also didn't know him to be sexually active, and clearly he was. I'm not saying Travis deserved it, that he really attacked Jodi, or that Jodi is telling the truth about self defense, but playing Devil's Advocate and looking at the evidence like the jury is supposed to, I have to admit there is a lot I don't know, and it isn't as clear cut as most people are are making it out to be.

Also whoever said defense lawyers are scum and prosecutors are awesome... wow. Defense lawyers have to defend people when masses are braying for their blood. They get paid much less than prosecutors. They often deal with obstruction from law enforcement, especially in Mesa where you have sheriff Joe Arpaio who has a history of ordering officers to destroy and tamper with evidence that would help the defense's case and - he gets away with it (wiki it). People convicted rightly or wrongly (and it's not hard to be convicted wrongly in this prosecution heavy system) can expect to be sent to a jail where inmates are housed outdoors in tents concentration camp style, as he calls it, in an area where temps are 145 in the summer. In many cases a prosecutor's job is merely to convince people of what they already have a tendency to believe, that the person on trial is an evil asshole guilty of the crime they are being charged for. Just like it's the defense's job to defend regardless- even if everything points to someone being innocent prosecutors seek a guilty verdict. The more guilty verdicts, the more they are promoted; in fact usually judges who preside over cases were former prosecutors. So anyway, before you bash defense lawyers think about the service they provide and how things would be if the few established rights citizens do have to defend themselves against accusations made against them were compromised further.

I think they've got the charge right.....murder in the first degree. She came prepared to do battle. I believe the jury is going to have a hard time overlooking the evidence in this case vs. the story Jodi tells. The wounds he suffered....the number, the severity, the extent....does not support a case of self-defense. Far from it. I think they will come back with a guilty verdict, but to what degree, I'm not sure. If she has swayed the jury to feel empathy for her, they may not want to chance her getting the death penalty. I'm hoping the jury didn't buy her sob stories. She deserves to die in prison, one way or the other!

oh no, do I dare say, here is where my non violence comes again. I don't need her to suffer in the sense of torture ways. I wouldn't want that for anyone.
Forever sleep aka DP isn't suffering or violent imo. They go to sleep. With how cruel this murder was, that would be a fair verdict. But I could settle for LWOP too, keep her away from society to never be able to hurt another again.

I think she needs to be thrown in a nut house for the rest of her life. Let her live out her days with her own kind.

Very good point. Just more proof that Jodi is a liar, liar, pants on fire!

I agree with everything you said, except about preferring the death penalty. My first choice would be for her to get life with NO possibility of parole.

My fear is that it will be much less than that though, for the exact same reasons you said.

That is what I remember from today - she said she went into the closet to escape thru the other door, remembered the gun was there, climbed the shelf to get it, said he followed her in there and that is when she pionted the gun at him, he tried to tackle and it went off. But there was no blood in the closet! or evidence of a struggle.

If she doesn't remember stabbing him, and didn't think the bullet hit him, why was she worried her life was over, wanting to rewind the clock? What was she not wanting her family or anyone to know what she did, if she didn't remember any of it anyway. What did she have to be ashamed of? could it have been the slit neck and 27 other stabs she was ashamed of? such fuckery/bs, she so deserves to be put down for first degree premeditated cold blooded murder.

BTW, someone mentioned Mesa as being rural; far from it, the Valley, meaning Phoenix and surrounding areas is one big metropolis of around 5 million people. There is a Mormon Temple in Mesa, so yes many Mormons live in that community; however, the jury pool is Maricopa County, so that would water the pool down quite a bit as far as one religion predominating.

Standard is standard, the judge can't toss 'required' instructions out. SOME parts will change but if there is no plea, nothing wrong with trying to understand them now if possible. Like listening to THs on law isn't much different. They aren't the jury either. But, some of us are interested in it.

i'm not convinced. plenty of people 'don't remember what they did last night.' different situation - i know, but you can be 'blacked out' and continue to function... it's called disassociation. *something is so horrible while it's happening, that a different piece of your mind takes over separate from your conscious you, but you function in a way that takes care of business.*

    *not a clinical explanation...

i don't believe she blacked out or disassociated. i believe she's a lying fuck.

the old sleight of hand trick. i like this theory! although i have never been convinced he knew what was up during the photos, this is a contender... gun in one hand, camera in the other, drop the camera to pull out the knife from behind you and stab, stab, stab!

even ron should appreciate this one...

some people have a higher tolerance for pain.

-I'll jump to the ending because at this point I was in my car. It seemed that Nurmi wanted her to say that she admitted the truth about what "she remembered" happening that day and about Travis beating her and being a sexual defiant. Martinez objected and Nurmi had to ask again. All I remember is Jodi saying she confessed and Nurmi saying he didn't have anymore questions. Usually when Jodi doesn't answer a question exactly the way Nurmi wants her to, he will ask her 5,000 different ways until she finally says what he wants. It was odd the way he closed. I kind of felt like he was just throwing his hands up and saying, "eff Jodi, if you can't get it right, I'm sick of forcing it out of you."
seriously, when he said he had no further questions, i actually heard: 'i'm done.'
    i want my diary damnit!

The angle of the shot means Jodi was aiming down at Travis when she pulled the trigger. There is the last photo of him, sitting in the shower. It would seem logical that she shot him shortly after that, while he was still in that position.

The other explanation is that she shot him after the stabbing and neck slicing, in order to insure that he was truly dead. I can understand that thinking as well. But, in that case, it means that somehow, after she had already done all that damage, that he was in a sitting position. You would think a guy who was attacked so viciously and hurt so badly, would have a hard time sitting up. I would have expected him to be prone on the floor. Although I suppose she could have been dragging him into the shower when she discovered he was still making noises? Death throes? And so then she leaned him against the door of the shower and pulled the trigger?

i just don't see why he would have to be sitting? he could be laying, with his head turned to the side and she pointed the gun down at his head and shot.

I'm pretty sure this is what she said happened. He threw her. She ran into the closet and got the gun. While she was getting the gun, he ran around the otherside through his bedroom and into the closet from the other side. She had no where to go but back into the bathroom since he was now in the closet. He came through the closet into the bathroom after her and thats when the gun struggle began.

Too many privs there. Better TV channels, more movie nights, bead class, play cards, games, wear you own clothes. Now in humor, if you could make that locked up listening to Nurmi 24/7 it would make me laugh.

This was so cruels, dp is my first choice even though I know it's unrealistic. The thing that worries me about LWOP is one day some ass comes along and pardons her or they change a law and killers are free birds.
