    I understood as this as well. If jury does not vote DP, judge sentences either LWOP or LWP.

I would not put it past Jodi to think of something like that. I think Jodi manipulates her mother extensively.

    I believe the only way she can get possible parole is if the decision is left in the hands of the judge, who has the option of that sentence. But it is very unlikely to end up with the judge having to decide, and for all her bending over backwards for Jodi, I still don't think the judge would choose life with the possibility of parole.

    Courts in my neck of the woods would not allow such dress, the chances of a judge speaking to her, possibly even in open court in front of everyone, about the need to dress professionally would be fairly high.

    Not sure if I am agreeing or disagreeing with you, but I think I am agreeing :P
    The day the Freeman's took the stand for the defense & opened their mouths... I felt a sour bitter taste in mine.
    It was totally apparent to me they were in total support of JA & showed little if any for Travis.
    I feel the ONLY, absolute only, reason that Dan is now siding with the state, is because of the backlash, I am totally assuming he & his sister received from the public, maybe even family & friends. I hold no respect from either of them.

    The law varies from state to state, I know. In the state I live in, we don't have DP......Murder 1 carries an automatic sentence of LWOP. I assumed that, because the jury was deciding DP vs LWOP, the option of life with chance of parole would be off the table (and a slap in the face to the jury, if they've decided it's serious enough to warrant DP consideration) I think the Judge would catch hell if she went with the lesser option.

    I think Dan Freeman was truly fond of Jodi, before the murder of Travis. When he testified, I got the impression that it took him time to accept what she'd done, but I found his testimony to be very truthful. His sister, on the other hand, was a dimwit who seemed to show NO emotion. Very flat affect. I'm glad he has taken the stand on the side of Travis. He seems like the sort of guy who tries to see the best in everyone.....and there was none to be found with Jodi.

    So sorry... I know, I am being a serial poster & never ever wanted to bear that title.

    I think if/when Patti takes the stand or wherever they make statement to the judge/jury to save the life of the monster JA, it will be a HUGE FAIL.
    Remember when they had her on one of the HLN shows, on a phone interview? She could barely speak or put words into sentences & I can only imagine what she looked like & what expressions she wore.
    So that in itself, will be comical to watch. And knowing that I will probably require a full box of kleenex while hearing Travis' family plead, the train wreck I am imagining w/ Patti, will lighten my day.

I think she thought that we were trying to position ourselves to jump the line, (impossible to do) for the afternoon session, which in itself, if it happened, would only be a reading of the Jury Verdict on the Cruelty since they were in the process of deliberating. I invited her to come talk to the press with us as they had previously invited me to and she retreated. She was so aggravating, that we decided to just get away from her and go downstairs and wait it out in front of the building. Both Denver and I were of the opinion that it wouldn't be long. As soon as we came out of the front doors JVM was standing there. She approached us; asked us where we were from; how we got interested in the trial, etc. We told her that we met through a blog and that our meeting was arranged by another person who participated. JVM asked the name of the site and Denver told her it was MDS. JVM then asked us if we would do an interview, but that she couldn't mention the name of the blog. She also told us that she had lots of interviews in the can but that people were saying mostly the same things and she appreciated our different perspective from the few things we had said to her by way of introduction. Then she asked us to not say anything more 'till she got the cameras rolling 'cause she found that people never said things as well the second time and she wanted our fresh viewpoints on tape. We weren't all that enthusiastic about participating but I, for one, and I think Denver as well, thought of all you guys and thought we owed you one. So, we did that first clip and you saw it. Looks like we didn't bomb totally. When that was done, JVM asked us to stick around for a further interview closer to verdict time. So, a little while later, just before the verdict, we did the second. Our star turn was over. That was our star turn. We hung around on the steps for a little while longer and saw the Alexander family leave, in procession with a sheriff's deputy, followed by some other trial watchers. Wait for it! Tiger Lady was amongst the followers. I have to confess that I am a little apprehensive about what waits in store for them with their new 'close' friends but I suspect that when this is all over and they are able to return to their normal lives, (to the extent that even that's possible), they'll cull the herd or the herd will move on to other grazing sites.

    Can I tell you the rest tomorrow? I mean from the beginning of the day up to the JVM interviews? I'm whacked and a good part of that is as a result of the release of the tension and excitement we experienced throughout the day. It was a good day. Truth won! Our truth won! Watching Justice at work, when it works, gives us that lump in our throats.

    Absolutely! I totally get that. It was just that she had gone on and on about Travis' abuse and threw in the pedo stuff to boot. That was the first thing I thought of when Troy was asked if he believed her. I'm positive he doesn't believe that part of her story- (if any) I just wish he would have been a bit clearer on what part he "believed". That, "yes" answer kinda stung.
    I also think Jodi has a crush on him (Who wouldn't?! The guy is a hottie biscotti!) and that had to have helped his access to her a bit. He lobbed soft questions to her, I'm sure, because he didn't want to ruin a good thing, and keep the love going between them. (Her perceived love). I'm ok with the whole interview. The only part that kinda stung me was that "yes" answer.

    Did Ian actually try to stare back as Donavan, the Lumberjack, eye-fucked him?!! Be careful Ian! She is known in the "joint" as someone fluent in both "pitching" and "catching" so stay safe! Also, thanks for the info!

    But, the problem I have is with the ME's report. The lack of blood in the head leading to the lack of hemorrhaging.     And while it's reasonable to ask "why use a knife when you have a gun?" I think it's reasonable to ask, "why even bring a knife if you have a gun?" And since she brought the knife as well, we have to believe she was prepared to and willing to use it; which of course she did.

    Why use a knife instead of a gun? Many reasons:

    - A knife doesn't make a loud "BANG" that could alert the neighbors who might then call 9-1-1.

    - A knife doesn't have to be properly loaded; it doesn't have a safety that you know how to use; you don't have to know how to chamber rounds; a knife doesn't have a recoil; a knife doesn't run out of "ammo".

    - A gun shot is potentially quickly fatal; whereas a knife let's her take out her rage in making him hurt while she stabs him 2+ dozen times. I will never believe that Jodi wanted Travis to die quick and relatively painlessly. She wanted to rant at him and blame him, and punish him. A knife works better for that.

    - It's believable that she thought a couple of stabs, while he was in a confined space, would disable him to the point where he could not fight back, but that he would linger and suffer while she verbally assaulted him. It seems reasonable that a person would believe that a knife wound to major artery connecting to the heart would quickly disable a person from being able to fight back or even just defend himself.

    So, an argument could be made for both methods. I go with the knife wound first for several reasons mentioned above; because she wanted it to be personal; because she thought it would be a disabling wound; because she was fearful someone would hear a shot; and because she wanted him to linger and suffer, both for the pain it caused him and so that she could rant how it was all his fault. Throw in the ME's report and the bullet casing and I believe the gun shot came last, and was the last straw for her , noise be damned, because he just wouldn't die.
    So well thought out and, sadly, probably true.

    Even if she got the knife from Travis' house, she still had it on her person prior to initiating the crime. And if you believe the gun shot came first, Jodi still had the knife with her in the bathroom even though she had the gun. Why? Because she was prepared to use it, even though she had a gun.

    Whether it's his knife or her knife, doesn't change my "argument". It would be a different story if there was time during the attack that she ran downstairs to grab the knife. But, then you run into another problem. If we believe the shot is first and Jodi didn't have the knife on-hand, then Jodi has to run downstairs and back upstairs to continue to attack a man who would have allegedly been shot in the face, yet unfazed by it. If Travis is mobile and coherent, and Jodi runs down to get a knife, then doesn't Travis run to his room and pick up his phone? Doesn't he get dressed? Wouldn't he have been able to run down the stairs after her?

    That knife was in the bathroom -- regardless of whose knife it was -- because she was prepared to use it.

    I also tend to believe that she did in fact bring the knife because of the fact that when she tried to run, she had 2 knives in the car.

    You could certainly argue that the knife was a backup plan, but, I think it takes a lot more for a person to stab a person (especially that many times, slit a throat etc), than it does to pull a trigger and walk away. Stabbing would be a more visceral experience I would think.

    I also think she got off on using that knife to brutally torture him. I think she enjoyed it in a way that a gun shot wouldn't do. Using her hands to snuff out his life. How much more personal of way is there to kill a person than stabbing and slicing?

    She wasn't traumatized by what she did, she didn't regret it. She reveled in it. She wanted to relive it. She wanted to see those pictures because she enjoyed her handiwork.

    Shooting someone is something that most people could probably do, if they had to, as in self-defense or defense of others. I think there are very few people out there though, who could stab a person to death. Much less anyways, in comparison.

    I have always thought the mitigation specialist looks and acts very unprofessional. When I first started watching the trial, I thought she was a friend who had somehow gotten permission to be near Jodi, for whatever reason. When I found out what her job is, I was stunned. Her look is inappropriate for the courtroom, and her behavior is disgusting. The worst moment was when she burst into laughter at one of JM's questions....the day that the judge admonished everyone in the courtroom for their outburst. Then again, the defense team behaved improperly throughout the trial, as well. What a bunch! Thank you for the awesome updates!!
    This reminder of that outburst reminds me of how arrogant Jodi, the mitigation specialist, and LaViolette all seemed during that part of the trial. Contrary to what they probably thought, their condescending attitudes toward Juan were only making Jodi look even more unlikeable, and themselves even more unprofessional.

    I know I am way behind on this today.....just getting caught up with testimony from today. I just got the the 2 minute pause. Whewww that was incredible. Sooooo emotional. I got goosebumps and teary eyed watching and staring, I think those 2 minutes are going to go down in trial history. Juan is amazing.

    @ ian, faq, brillig & denver......i haven't seen your comments on it yet. It must have been an incredible moment.
