    It was also mentioned that JM is trying to get the tape that was played on Dr. Drew with respect to Travis and Stabby (she was sitting in his lap), to prove that she as not a dirty little secret. I hope he succeeds. Of course, he was talking about getting killed, so they said she may just allow photos and not the actual recording. Might be too prejudicial for defense.

    I agree. She had to assume that the roommate would find him that night. I cannot believe no one ever tried to see him for 5 days! I know he was supposed to on a trip, but the smell in that house had to be awful. I have smelled a body decomposing and it is one you don't forget.

The defense has been allowed so much leeway in this case already. No, their case is DONE! They've taken more than enough time. The judge has to think of the jury and what's best for them. Surely juror fatigue is a concern. I don't care if this is a DP case. She has to try and keep this jury intact or else the whole case gets thrown out. I'd be SHOCKED if the judge allows this. Besides, after we hear from all of the pre-meditation witnesses, shlepping in a psychologist to quibble on whether or not Jodi has mental problems will seem silly and moot.

    Yes!!! That's an old trick used in beauty competitions way back in the day. Not sure why they didn't have makeup on the ready in beauty competitions... but that's where it originated, I believe.

    I just heard on HLN that the DT is wanting to bring on a Dr. Caffner, not sure about the spelling. It seems to be to rebute Dr. Demate's diagnosis of BPD. If approved they could have more witnesses too. Ugh!!!! This could go on forever!

    I have to wonder if the defense was aware of Dr. DeMarte's diagnosis prior to the trial... one would assume that they WERE--and if so, there is no grounds for a sur-rebuttal (since this evidence was therefore not new).

    570. Voluntary Manslaughter: Heat of Passion - Lesser Included Offense

    A killing that would otherwise be murder is reduced to voluntary manslaughter if the defendant killed someone because of a sudden quarrel or in the heat of passion.

    The defendant killed someone because of a sudden quarrel or in the heat of passion if:

    1. The defendant was provoked;
    2. As a result of the provocation, the defendant acted rashly and under the influence of intense emotion that obscured (his/her) reasoning or judgment;

    AND

    3. The provocation would have caused a person of average disposition to act rashly and without due deliberation, that is, from passion rather than from judgment.

    Heat of passion does not require anger, rage, or any specific emotion. It can be any violent or intense emotion that causes a person to act without due deliberation and reflection.

    In order for heat of passion to reduce a murder to voluntary manslaughter, the defendant must have acted under the direct and immediate influence of provocation as I have defined it. While no specific type of provocation is required, slight or remote provocation is not sufficient. Sufficient provocation may occur over a short or long period of time.

    It is not enough that the defendant simply was provoked. The defendant is not allowed to set up (his/her) own standard of conduct. You must decide whether the defendant was provoked and whether the provocation was sufficient. In deciding whether the provocation was sufficient, consider whether a person of average disposition would have been provoked and how such a person would react in the same situation knowing the same facts.

    [If enough time passed between the provocation and the killing for a person of average disposition to "cool off" and regain his or her clear reasoning and judgment, then the killing is not reduced to voluntary manslaughter on this basis.]

    The State has the burden of proving beyond a reasonable doubt that the defendant did not kill as the result of a sudden quarrel or in the heat of passion. If the State has not met this burden, you must find the defendant not guilty of murder.

    Instructional Duty:
    The court has a sua sponte duty to instruct on voluntary manslaughter on either theory, heat of passion or imperfect self-defense, when evidence of either is "substantial enough to merit consideration" by the jury.
