Something I don't understand....how come things that are deemed "too prejudicial" to the defendant are not allowed in evidence...however it seems that things that are "too prejudicial" toward the victim are allowed in eveidence....I don't understand this...can on of you legal experts give me a little education on this...Thanks

I am too famous to live in the USA, and too smart to live in Canada. I like Australia. It's huge and I can get a Range Rover with plenty of gas cans in the back. Koalas are cute. Maybe if I ask Gus he will buy me a ticket to go there. We can put together a dream team and move the whole gang to Sydney. Me, Gus, Alyce, Samuels, Donovan, the twins, Doggyboy. Abe you wanna come with, hotti biscotti?
I will open a theme restaurant/cafe in Sydney. With all my artwork and photography on the walls. How amazing would that be? Jodi's Art Cafe! I will retire as a waitress because of my finger injuries. Donovan can be the manager and my bodyguard. I'm sure the Aussies will love her spirit and she's really good at rugby. Gus can be my sugar daddy and we will probably do a reality show so everyone can keep up with my life after the trial. Nurmi already said he will rep me in Hollywood so he must stay behind in Phoenix. Sad face!
We will have karaoke contests and serve coffee and Cinnabons. I already have the recipe. And best of all I can do my LDS mission at the same time. After a couple years of teaching Australians how to be good Mormons, my sould will be clean and I can take a freaky Australian Mormon for my husband... whoa, both my hands were sinking down into my lap! So, Travis' brother and sisters are back in judge's chambers with counsel and Jodi.
Can you imagine how it must feel for them, standing right next to her in such close quarters - much closer to her than they ever are DURING court (and the court room is rather large)?! I can't imagine the restraint to stand so close to her and not act out at her. Not to mention, she is probably smirking at them knowing they've been listening to their brother's name and character being dragged through the mud. So many prayers for them!

TA didn't drive 1000 miles to lure Stabby into a seated naked defenseless position in a shower so he could stab her to death, slit her throat and shoot her in the head. If he had it would all be over but the crying by now, he'd be on death throw, probably half way through the appeals process.

In general, I am glad we have court rules that attempt to keep things fair. I believe that while there are instances where the result seems unfair, that the rules in general are a good thing, and part of what distinguishes America from, say, Saudi Arabia or some other country where an accused person has no rights at all and there is little or no justice.
However, in this particular instance, I think that whatever Jodi said in those texts should have been allowed in, particularly since the defense is using the "trash Travis" defense and relying so heavily on his half of the conversation to try and make Jodi look like a victim and Travis look like an abuser. Sadly, they don't let me make the decisions.

Travis isn't on trial--in spite of it seeming that way. His reputation doesn't matter as far as the law goes in this trial. But you can't bring in history of other crimes committed by defendant for fear she'll be convicted on the theory that she is a bad person rather than she committed this crime.

I think they were saying that he doesn't GIVE the defense witness (whether it be Jodi or someone else) a list of the questions HE is going to ask, so we get the "caught unawares" factor on Juan's cross even if we don't get it on the jury questions. I believe that is what they were getting at.
Not entirely sure, but I think that some questions cannot be asked for legal reasons. And the defense and prosecution argue over whether some of them are legal (prejudical or something???). Just guessing really.

Sure, privacy is sacred, no doubt....BUT Travis made a commitment to a sect of organized religion that prohibited this kind of behavior. Had he not been affiliated with Mormonism and trumpeted its benefits and morals etc, it would have been a different story for him. Remember, at least 2 of the women, he had romantic interest in, he challenged them to read the Book of Mormon. The bottom line is, yes...a private sex life is completely acceptable as long as that person does not adhere to the dogma of organized religion in a very public way. Travis was very visible spokesman for his beliefs. Great. Its OK to believe what you believe but if you are a public figure on any level then....the risk is obvious. Either don't do it, or don't get caught or ....the best scenario : confess ones weaknesses with the intent towards healing . There are lots of scenarios where people have led double lives, i think keeping ones PRIVATE sex life a secret is not really that bad... don't you think? I don't get your point. I don't know of any religion that condones sex outside of marriage. Or thinks that anyone is without sin. So Travis slipped up like about 90 % of young men his age in his generation.

I totally agree on this one. Something made Travis react in the way he did, in those messages. The jury should be allowed to see the context of why he said what he did. The defense is saying "read THIS and see? He calls Jodi a sociopath, and the worst thing that ever happened to him! See how ABUSIVE he was to her?" But, just like the infamous sex tape, revealing only part of the conversation can make the situation appear far different than it actually is. What I mean is that JM does not have to give the defendant a list of his questions in advance. She has the evidence and knows what he will probably ask. The jury will ask questions based on ALV's testimony. It should be the same thing. Does that make sense?
