Unfortunately, JM never went back to those texts. Nor have we heard or seen the supposed Facebook message he sent her. We really haven't even heard more about the stalking claims, or doggy door, nor any testimony from people who knew more about her obsessive behavior. I know it's out there. IMO, more needs to be done to show motive. Hopefully that's coming in rebuttal and closing arguments. Sometimes jurors need it all spelled out for them...that's where I'm coming from. Although we see it, I want them to see it too. The couple people on here who are questioning things make me really nervous.

That is probably why JM didn't go there. The angry messages, I think JM's failure to focus on those was merely part of his method to prosecuting her. Everyone knows that Travis was not a violent person....was not the manipulative abuser that Jodi is attempting to portray him as. There has got to be a reason why those messages were not introduced as evidence by either side. For JM, he wants to stay as far away from those as possible, because he doesn't want the jury to take these messages out of context and view them as support of what Jodi is claiming. Because it isn't true.
The 'stalking' of Travis is not allowed into evidence. It's too prejudicial, and there's no foundation (no proof, really) to prove that Jodi was indeed stalking Travis.

Motive is not necessary. It really isn't. In television, they need motive because it makes the case more interesting. In RL, motives are broad things.

Let's play devil's advocate and say that Travis did abuse Jodi in some way (or that she perceived him to be abusive, even if he wasn't). There is motivation on her part to kill him.

Travis called her a sociopath and threatened to let everyone know how horrible she was. There's motive.

    Travis dumped her. There's motive.

Travis wanted to date other women. There's motive.

Travis was going to Cancun with someone else. There's motive.

Travis was alive and she wasn't going to be a part of his life for much longer. There's motive.

To nail it down to one thing is foolish and a waste of time. Throw a dart; one answer is as likely as the other. In reality, Travis's death is probably a combination of all these things, and more.

And I think if any of the jury have been paying attention, then it wouldn't be too hard for them to pick up the threads like I have. I think the actual problem is that society has been trained badly by television. They want everything explained in a neat little package along with physical evidence, and that's just not how it is in real life.

Like I've said, I don't know how you could look at the facts of the case and be unable to draw the proper conclusions. If people still doubt premeditation or feel that it hasn't been proven, then the only thing that will satisfy them is a confession of Arias, or a video of her going step-by-step in her plotting.

The evidence is all right there. It isn't that hard to put it together.

yes I know it's a moot point but there is no gun at this time. There is a difference between burgulary and theft they (the pros) will have a tough time proving burgulary if it ever gets that far.

yes but she did not enter his domain with the intent to deprive him of his gun .She took it after the fact which is theft, still a felony .They are two different things.

In AZ a self defense claim is an affirmative defense. They only have Stabby's word which isn't worth a plug nickel. She has more lies than Carter's has pills.

Pre-meditation has been proven. I wrote it out for everyone to read. If they can't be convinced by that list, then they will never be convinced. Juan has gone over the premeditation numerous times, and I'm sure he will cover it once again in his rebuttal case.

On another note, do we think that JW was going over Jodi's story about self-defense again simply to remind jurors of the claim of self-defense?

And I know this is unpopular, but I still feel sorry for the doc. I know he's getting paid, and I know he isn't organized. I suspect that he only took this case because they literally had no one else. He seems to care -- perhaps a little too much -- and that has gotten him into steep trouble here. I think Jodi was good at putting on a show for him, and he was truly convinced of her 'illness'. He bought her a book because he was concerned. I don't think someone who is just in it for the money would actually do that.
Love your premeditation post. I don't feel one bit sorry for Tricky Dicky. He put himself in this position. If he was truly concerned about her "suicidal tendencies" he should have notified the medical staff at the jail. A failure to do so indicates an unethical behavior to me. As an "expert witness" he showed a remarkable lack of knowledge with regards to the tests he performed and the results of said tests. With regards to testimony on Dissociative Amnesia, according to what I've read science does not accept this “hippocampus theory” as being factually proven. This link provides a good breakdown of his testimony and why he's full of shit. http://kristinarandle.com/blog/category/jodi-arias/

Yes.Yes.Yes. In AZ self defense is an AFFIRMATIVE DEFENSE. Meaning the defense must PROVE she acted in self defense.

The hair color change. The lack of receipts in AZ. The lies piled on lies. The mysterious knife and it's most convenient placement in the bedroom by Jodi. Travis in a vulnerable position, and a killing that took less than two minutes.

I don't understand. If you can't get to pre-meditation from all that, what do you need?
I think Jodi planned the murder

I'm just saying, by the jury questions-there are one or two jury members that have some doubt.

Gas cans-maybe. The state has yet to prove for sure about a 3rd gas can.
Floormats- don't believe the state can prove Jodi threw them away unless them find them with the KY, backpack, knife, clothes, and gun.
The LE didn't even test the kool aid stains. There was nothing on the check in paper about there being missing floor mats or stains in the car. Just the word of the budget guy.
Jodi had sex/or sexual play with Travis that day. So we have to assume at some point-she was an invited guest in the house.
Gun-They can't prove she stole her grandpa's gun. There is no gun (unless they find it)
Hair color-They can't even say for sure one way or the other if she her hair was whatever color on June 4th. Who knows?
Licence plates-They can't prove Jodi flipped them around.

I'm not saying Jodi didn't plan her murder, b/c I believe she hated Travis, and I believe she planned the murder b/c she wanted him dead.

We "maybe" know way more information than the jury does. Of course most of us know or suspect she planned the murder. What may seem like a closed case to you, may feel much different to somebody that is sitting there with limited or controlled information.

Can you prove theft on something that doesn't exist? I know this is all smoke and mirrors so don't jump on me about bringing this up.Yes it makes sence in a convoluted way I'm just questioning if Martinez can make it stick .He needs to get the murder 1 charge to stick first I assume to then further get the burgulary charge to take effect.
Quote Originally Posted by Ian 1 View Post

Martinez stated that, although Travis initially invited her into his house, logically that invitation would have been withdrawn immediately after Arias stabbed him the first time. Thereafter, she was in his dwelling 'without his consent' and therefore, from that time forward until she left, she was committing the 'felony' of burglary. Arias went on to kill Travis during that time, so it is concluded she committed a killing, (murder) while engaged in the commission of a 'felony' (burglary). That adds up to first degree murder. Nothing has to be 'taken' to qualify the offense as burglary. Just being in the house unlawfully is enough. Aggravating circumstances, (Extreme Cruelty) were then added after a separate court hearing on the subject of the 'Aggravators.' Hence, the Death Penalty qualification. Makes sense!

The reasoning may be complex, but the conclusions are logical. That's the beauty and purity of the law.

    No?

This may be an old issue, however it's a good point. Has anyone ever broke a finger, or injured a finger, on the hand they write with? I got stitches on my ring finger on the hand I write with. You cannot write unless it looks like a 4 year old did it! How is the murderer able to write in her diary just days after Travis 'broke' the finger? Ugh.

Premeditated doesn't mean planned, just that she thought of it before she killed him. There's no time specification for premed, it can be moments. By her story, she chose to run in the closet and get the gun rather than run out of the house. Then the rest, stabbing and slitting his throat, just because she doesn't remember, doesn't mean she wasn't trying to kill him.

Also, tying into what chelsey d mentioned about her first encounter w the murderer in jan 2008... Her finger was not broken in Jan 2008... I hope JM refutes this pedo 2008 stuff because he just seemed to glaze over it. There needs to be more to totally throw that idea out of the jurors' minds and show the murderer to again, Be A Liar.

No doubt. My father had a doctorate, and in fact it was in Philosophy. Just getting an associates degree pretty much kicked my ass. You are absolutely right.

Would someone clue me in as to whether or not there will be court today? I have been very busy at work and have not been able to follow as closely as I would have liked. Thanks! :)

Jodi can write with both hands. I broke the ring finger on my left hand, and even though it was properly splinted, I couldn't even use my arm. Years later I broke the thumb on my right hand, and had to swipe my card and scribble my signature to pay for things. My handwriting never recovered. But, Magic Jodi, can write with both hands and it looks identical. I did notice in her journal entry of Jan. 24, that she said her writing was messed up because she was in a moving car. Looked the same to me.
