Her hair is now longer, and her glasses make her appear different, as well. Also, she is smiling and happy here. I'm sure she isn't thrilled to be in court, facing JM!

There are many approaches. A skilled lawyer will sift through the mass of testimony and cut right to the heart of the matter. The jury does not have an infinite attention span. They can't follow every argument. They might dislike someone who yells. He does not need to prove 100 lies. Just do a good job of proving the 5 most relevant & important lies.

When dealing with groups of people and the "general public", appeal to the lowest common denominator.

    1. Put things in simple, plain terms
    2. Wrap things up in clear, take home points that make good sense
    3. Appear likeable, and not argumentative
    4. Don't make yourself look like an asshole, even if you are right and justified being angry
    5. Efficiency, get in and GTFO!!!

In my opinion, Martinez has taken the bait. He has been drawn into a land war in Russia, so to speak. He is fighting many battles on many fronts and it is taking away from the focus on the most important matter in the case, premeditation. The defense attorneys are a lot smarter than you might think. They know their opponent and they are toying with him - don't think so? How about making him prepare all weekend for an issue they dropped. Nurmi/Wilmott look bad because their client is a nightmare, but they will save her life. Unfortunately, Martinez seems to be helping...

Oh, don't misunderstand me.....I am not doubting the ability of the defense lawyers. I think they have a nightmare of a client, to say the least. I just don't view Martinez as anything other than amazing. He hits a home run, and disproves every theory that the defense is throwing at the DA. He has to, because the burden of proving this case lies ultimately with him. Every witness the defense has put on the stand, JM has handed their assholes back to them on a silver plate. He has convinced me (and I went into this, giving Jodi the total benefit of the doubt) that she is guilty of murder in the 1st. No doubt in my mind.

Also, I want to add that this trial appears to flow like molasses for several reasons, the most obvious being the limited court time, per week, that has been the norm. And the fact that Jodi was on the stand for 18 days? And, the law which allows jury questions to be asked. I just don't think that JM is the reason this has been soooooooooooooo tedious. XO

Um...premeditation must be proven (beyond a reasonable doubt) by the prosecution.

I wonder if this will irk the jury members who are getting paid not nearly that (do they get paid in AZ? I know they do here, but sadly, it's peanuts) and cause a resentment towards him, since he is clearly unprepared and doesn't deserve NEARLY what he is getting?

That's great. I'm glad he can command more money what with the ethics he surely has and the actual work he probably puts into his cases =)

EXACTLY! You would think - having a sane, rational mind, that if he was interested in little boys in their undies (which I do NOT believe at ALL) that he'd probably not be interested in collecting tit shots, no?

    Also:
I'd like to thank TawniDilly (I hope I spelled that right) cuz watching her uploaded vids on my tv (it can play YouTube) is soooooo much better than being stuck watching HLN or skippy streaming. Worth the wait for them to be uploaded, so thank you!

One example of how to get the job done so to speak: watch videos of David Walgren, the DA in the Michael Jackson/Conrad Murray case a couple of years ago. His cross-exams were concise, organized and surgically precise...no wasted time on side issues, no shouting or arm-waving, always polite -- and devastatingly effective.

I agree with you on all 5 of those points. I love JM myself and I don't mind his demeanor to a degree... but I know "some" people may not appreciate it. I know others may not agree with you or me but one thing I think we can all agree is that we all want the same outcome of this case and that is that she doesn't get by with murder and go free.

I know you didn't ask me, but my prediction is guilty - murder in the first degree (premeditated).
I may or may not change my answer about this later, but I believe they will give her life without the possibility of parole.
If I change my answer I may say DP. but I'm waiting until the rebuttal and sentencing phase for that.

I am not so sure Mr. Martinez is going to be able to prove pre-meditation without the gun. Everything she did after killing him, does not come into play. I had to say it. Hope he can, because it will sure make me happy.

THIS!!! Did anyone else notice this? Martinez was about to nail him on all the things he left out, Martinez turns his back on Doc to hand paper to defense, Doc takes out his pen and starts scribbling in his notebook, the same one he refers to moments later to recall all the things he left out because of "typos". After he refers to it, Martinez had it entered into evidence. I'm pretty sure Doc was not supposed to be adding to the evidence while sitting on the stand!

Yes, defense has to prove self defense if they want to use it. They are the only ones who can.

THIS! It was at the end of the morning testimony today. The attorneys were at the side bar. Jodi looks all suspicious and grabs her yellow notepad, stands up, turns around and appears to take a step---then the stupid camera shot goes back to the attorneys at the sidebar! I was like, what was she about to do with that notepad!!!!

Is anyone else getting a bit depressed at this point? I'm not sure if it's the yellow cast that hangs in the courtroom or the talk about JA's mental health or thinking about Travis' last moments. Strange. It all seems especially depressing to me today. It's not that I think that she won't be convicted. I'm almost positive she'll found guilty. Such a weird feeling tho.
Just wondering if anyone else feels the same.

Yes, pre-meditation beyond a doubt by prosecutor. I am not convinced he can prove it though, without the gun. This is starting to bother me. Will the jurors get bogged down with all the excessive testimony? Or, do they have a good idea at this point. I was told once by an attorney, that jurors make up their minds in opening and closing statements. I have no idea about that, but I want her to at least get life in prison without parole.
