I have actually done research on this for a work related incident. In Arizona, you are allowed to tape any conversation, as long as 1 person knows that it is being taped. I'm not sure about a Dr(he is NOT)/ patient relationship, but in general, yes.

Yeah, Arizona is one-party consent. California is 2-party consent. Jodi was in California at the time, so, that phone sex call shouldn't have been admitted, but it was anyways.

The issue really is that Dr. Dick doesn't tape interviews because, according to him, the process of taping inhibits the flow of conversation so he'd rather work the old fashioned way by inconspicuously jotting down notes during the course of the interview. The law/issue of 'consent to be recorded' wouldn't really apply here since Jodi Arias and her Legal Counsel would have signed a blanket consent agreement as a condition of him agreeing to perform the evaluation services. In plain words, Dr. Dick didn't record because he, and he alone, didn't want to and no one can force him to.

From the old school, as they call it, he'd rather go by writing as client speaks & to hope that he gets it right as opposed to being perfectly positive?

Maybe Juan Martinez thinks he is punishing Jodi by yelling at her and her lawyers and experts? I don't see it working - it only makes the trial a painful experience for the jury. Punish Jodi with the truth, not by raising your voice and ranting. A better lawyer could have made all the same point in about half an hour. Martinez took nearly an entire day of court to cross examine one expert witness.

Premeditation? Will we ever even talk about this in the court??? Or is there more yelling to be done?

Why would Martinez question Dr. Dick about premeditation? Thats not his area. And it was not allowed in direct.
I believe he successfully discredited one of the defenses key witnesses which is what his job was today.

Dear Diary,

I am sitting here in court listening to my life be taken away by some bumbling fool who can't keep the simplest of my lies straight. How hard is it? I told Doctor Dildo the same lie like a hundred times. Most of the story is me being in a fog. He only has to remember like, four things. Jennifer is trying to lead him, but honestly, I think this clown needs cue cards or something. I cannot believe he is getting paid $250 per hour. My testimony was 100 times better than his. He is supposed to be the the "trial expert"? If Doctor Dildo gets $250 an hour for that crap fest then I think I should be paid for my testimony. My rate should be at least $300 per hour. I will have to make sure I discuss this with Nurmi immediately.

I am feeling a Martinez Migraine coming on. I wonder if I should faint or something? I'm trying to go into my trance. It is very disassociative of me. I zone out and look kind of like a zombie. In my head I am traveling a million miles away to my happy place. In my happy place there are mirrors everywhere, so I can see how beautiful I am at all times. There are 24 hour Applebee's and Starbucks on every corner. And there are tons of admirers who adore me without ceasing...and we have buttsecks. Lots and lots of buttsecks.

Oh crap, what was that? Something just brought me out of my happy place. Of course, it was Fartinez, objecting again. Ugh. I wish he would die already. Hmmmm, I wonder if I have time for a hidden message to the gallery? I am communicating with a certain someone who shall not be named. Let's just say that I have a plan B if things don't go the way I want them to.

I have come up with a wonderful way of stealing paper from the courthouse. I am really sneaky about it. I take a piece of paper, surreptitiously fold it up and stick it under my thigh. Next I maneuver myself and the paper until the paper is in the back of my pants. Then I do a little wiggle and the paper falls right into my butt hole. When I get back to the jail, I've got several (mostly clean) sheets of paper to draw on. It is such a high to steal paper right there in front of the sheriff deputy and the judge. I just love being deceitful.

Speaking of deceitful...I will give it to Doctor Dildo. He pulled a really good one on Fartinez today. When his back was turned he was writing in his notebook all the things he was supposed to already have in there. He did it in the nick of time too. It was only a few moments later that the notebook was admitted into evidence officially.

Oh, what's this? Looks like court is over today. Be back in a few.

I have a little secret I am dying to share. I have a new LOVE interest in my life. I can't say too much, but I will tell you she is a latina lover that is almost as gorgeous as I am. Today was really erotic. We kept exchanging glances throughout the day. And at the end, we engaged in some whispering...but this was no "vanilla" whispering, it was "sex whispering"! The defense does not have to prove a thing. The burden of proof is solely on the prosecution. Defense doesn't have to call any witnesses....however, in this case, it was probably a good idea. Well, I thought so.....until I have listened to their witnesses. Maybe they should have stayed silent?

Not sure what you mean by JM bringing up premeditation right now while the defense is up. JM knows better than that. That would give the defense the ability to get their stuff together and explain away more of her lies. I agree with you that he could take a different approach to this as it may turn off jurors but then only time will tell. I find it frustrating to watch on HLN because they keep pausing and going to commercials every 5 minutes so that makes it more difficult to watch.

Actually it is my understanding that because the DT is asserting self defense, they do need to prove that, which is why she took the stand. If she had stuck to the two ninja story, the burden would have remained with the prosecution, and she could have sat silently.

it was already decided by a judge the defense/prosecution is not allowed to bring up this being a crime of rage compared to premeditation, thats why martinez just gave the facts and didn't call it premeditation, its the defense trying to sneak in the crime of passion from this guy, based on is assesment of the crime scene, thats why palin keeps getting shut down on side bar

Just frustrated with Martinez's micro-focus on meaningless details. He is fighting big battles over nothing points. Jodi killed Travis. Jodi lied. Jodi's own expert called her the "perpetrator of a horrible violent crime". Jodi said she did something horribly wrong. This is all stuff we already know.

There is only remaning question to answer - can Martinez prove premeditation? Or will he confuse the jury with such a hot mess of overargumentative crapola about anal sex, lube, Starbucks, self-help books, The Secret, and Casa Ramos.

I don't think it (sex tape) did any real harm, JA seemed like to narrator & instigator on that call. And it portrayed her in a way that she will never recoup from, she was going to lie & lie about Travis to portray him in such an evil light with or with out the sex tape. So I am sorta, kind of glad this was admitted into evidence, because we got to hear his deep soulful tired voice & the whole thing was G-rated in my eyes (aside from porking in the ass) BUT JA wanted to portray herself as this poor beaten down abused & used dirty little secret of Travis' & we (at least I) didn't see that, it just left a sour taste in my mouth of her when they played it early on in February & that was the day I believed wholeheartedly in her guilt & premeditation.
