    Not necessarily because JA didn't testify to returning the 3rd gas can until recently, right? So the prosecution probably didn't think they needed to prove it wasn't returned.

    well they cold have put it on the discovey list and they just didn't pick up on it?? - cuz martinez only has to supply list and not tell them whats imprtant and her evidence list is miles long

    but it either gotta be nurmi asking for from martinez or its martinez asking who ever keeps all the evidence while the trial is going on (idk if they have this just guessing)

    because their is no way they would be asking the business for records today - the records are from 2008 - it could take months for a business to come up w/ those records right now, if they still exist

    Jodi is behind bars and facing a possible death sentence, because of Jodi, and no one else. No one made her brutally murder another human being. She chose to do so. She thought she would get away with it; probably still does; and she thinks she should not have to face the consequences of her actions.

    If Jodi ends up with the death penalty, it's because she earned it. Don't want a lethal injection? Don't brutally slash someone to death.
    and if she doesn't get the DP will you feel like your team lost? Of course she should pay for her crime but I'm not the judge nor the jury ,I wouldn't want those shoes...Alot of people have alot of different ideas of what "justice" should be in this case.

    Flores or Martinez probably inquired verbally with each company. Martinez probably waited until she committed fully to the lie again on recross (same thing happened with Cindy Anthony and her work records in CA trial).

    They need to formally request the records to get them into court along with an employee of each company to testify to the accuracy of the records.

    I remember this video! First saw snippets of it in a documentary about the brutal murder of a toddler by two 10 year olds, that rocked the UK in 1993. In a follow up panel discussion on the two boys, (the case had a huge impact here) there was much heated debate on the born evil, genetic malfunction etc., issues and this video was played in it's entirety. Good find! I don't suppose we'll ever find out what went on in Jodi's younger life, but I'm pretty sure if she was sexually abused, it would have been a big part of her defence in relation to her claims of Travis being a peadophile.

    yes i just looked again at the travis fb - they are basing everything in that one court record, they have no access to the minutes or actually anyting that happened, they are just guessing - but just because martinez name is listed first doesn't mean he was the one asking for the record, i think on that print out the state is always listed first and the "TO COMPELL: business records from wal mart and tesero" doesn't mean they are asking the business, it could also mean what records they are referring to

    and i bet nurmi would say he didn't see it even if he had and i don't think martinez would ever claim he had evidence that he didn't, because it could cause a mistrial, a chance for jodi to go free and martinez could be sanctioned

    i don't think so, cuz if he says he has the record, he has to show it if asked and it would had to have been in discovery for defense to investigate - it would be hear say if they just told flores over the phone and wouldn't be allowed in, or if nurmi could prove the never recieved this evidence, it would have been thrown out

    Martinez didn't say he actually had the records on Thursday. What he said to Stabby was "Would it surprise you that Wal-Mart has no record of any gas being returned that day"

    Jodi hadn't lied about it until she took the stand. They had proof of her buying the can but didn't know she would claim she returned it. Until she claimed that, they would have no viable reason for requesting those documents. Since she didn't claim that till last week, and it probably took some time to contact the locations to find out if they had a record of return/purchase (walmart/tesoro) in order to know to subpoena them.

    Here's the rule for switching to Daylight Saving Time. Spring Forward, Fall Back. If where you are observes DST, then you jumped ahead one hour last Sunday, Mar. 10, at 2 a.m. If Arizona does not observe DST, they stayed where they were. That means that you will have to wait one more hour to stream the live Trial. Just Google and ask 'What time is it in Phoenix Arizona?" You'll get your answer there. Rumor is that from now on Trial is going to start at 10:00 a.m. Phoenix, (MST) time.

    I bet that's certainly part of it! If Martinez had the records previously they would have to have been disclosed to defense in discovery.

    I think his investigative work would be considered work product but I'm not a lawyer so not totally sure.

    plausible scenario... still a possibility though that today's motion was generated by the defense trying to preempt the prosecution.

    That day several members of Travis' family had to get up and leave. it was too much
    Not only did the jury see the autopsy/crime scene photos, they saw them on multiple big screens throughout the courtroom--I read somewhere that the screens were everywhere you looked, there was no escape. Imagine what that must have been like.

    IMO, no one with a shred of common sense could see that and believe for one second this was self-defense. It was pure rage and nothing else.

    Is doing it this way averting a Discovery violation? Do the Discovery rules treat information the same as tangible evidence, i.e. exhibits, witness statements, etc.?

    Court will be dark Monday and Tuesday, resuming on Wednesday, March 13.

    Daylight Saving Time (United States) begins at 2:00 AM on Sunday, March 10. Arizona does not observe daylight savings.

    So next week, for the east coast, court will begin now at 1:30pm. Adjust your schedule for your time zone!

    Update: Judge wants to start at 10am which now changes east coast to 1pm!

    I'm not expert but every motion in the maricopa records show a (001) at the end for party. And according to that website (001) represents the plaintiff (Arizona). The shit is so hard to read. We need a court docs for dummies

    Happy Valentine's Day! I was hoping to get a private visit with a special visitor today, but dumb Sheriff Joe wouldn't allow it. Doesn't he know who I am? He should feel thankful that someone as famous as I am is in his crappy jail. I told the guards to let him know that I would grant him a private interview anytime he wanted. Still waiting to hear back from him.

    I think my frustrations are really starting to mount. A way I've been coping is by making a hit list. Obviously, on the very top of this list is Fartinez! He annoys me so much. I've been trying to arrange an, um, "accident" for him, but it just hasn't panned out yet. Never send an amateur to do a professional's job.

    My first attempt on his life involved poisoned Starbucks coffee. But, he only drinks coffee from Dunkin Donuts. Flores picks it up for him everyday. Go figure. Unfortunately for me, I only have contacts at Starbucks. :(

    My next brilliant idea involved a fire. I happen to know a few arson exerts *cough-Donovan-cough*. According to my exerts, Walmart doesn't carry gasoline cans anymore. Riiiight. I told her to borrow some from Daryl, but she is convinced that would backfire.

    I have a final plan that is practically foolproof. I heard about this person who put poison in her vajayjay in an attempt to poison someone during oral sex. Talk about a brilliant plan! I wish I would've thought of this a few years ago. The only hangup so far is that my outside contact is having, um, trouble seducing Fartinez. I told her to put on a dress and some lipstick, maybe throw in a thong and a pair of stilettos, but Dona....I mean my "contact" has still not been able to get Fartinez in a vulnerable position yet.

    So, looks like it's back to the drawing board for me. Luckily I am a very creative sort of person! If all else fails, I'll just go with the traditional boring ways to murder someone. I really hope it doesn't come to that. I am an artist, after all.

    Call me paranoid, but I've got a really bad feeling my diary may have been tampered with. I think this entry in particular could be construed the wrong way. I think I better be safe and rip these pages out. Let me just say this: if I EVER find out my jail diaries are leaked out, I will have one more person to add to my hit list!!!
