Farid Fata admitted in court to intentionally and wrongfully diagnosing healthy people with cancer

Farid Fata, a prominent cancer doctor in Michigan, admitted in court to intentionally and wrongfully diagnosing healthy people with cancer. Fata also admitted to giving them chemotherapy drugs for the purpose of making a profit. The cancer doctor?s guilty plea shocked many in the courtroom, according to The Detroit Free Press. Fata owned Michigan Hematology Oncology, which had multiple offices throughout Detroit?s suburbs. Fata?s reach included offices in Clarkston, Bloomfield Hills, Lapeer, Sterling Heights, Troy, and Oak Park, Michigan. The doctor stated his plea in the absence of a plea deal and with tearful eyes, according to CBS News.

?It is my choice,? Fata said on Tuesday of his guilty plea.

In the Detroit courtroom, the cancer doctor named numerous, dangerous drugs that he prescribed to his patients. With each admittance he stated, ?I knew that it was medically unnecessary.?

U.S. Attorney Barbara McQuade will seek life in prison for what she called ?the most egregious? health care fraud case she has ever seen. McQuade said that in addition to insurance fraud, which involved a $35-million Medicare fraud scheme from 2009 until the present, Fata also harmed, and in some cased subsequently killed, his patients with dangerous chemotherapy drugs they did not need. According to government records, Fata?s medical practice included 1,200 patients. The formerly prominent cancer doctor will be sentenced in February before U.S. District Judge Paul Borman. The doctor?s bond was set at $9 million.

?In this case, we had Dr. Fata administering chemotherapy to people who didn?t need it, essentially putting poison into their bodies and telling them that they had cancer when they didn?t have cancer,? the prosecutor told the Detroit Free Press. ?The idea that a doctor would lie to a patient just to make money is shocking? Dr. Fata was unique in that he saw patients not as people to heal, but as commodities to exploit.?

The cancer doctor, 49, is a married father of three who resided in Oakland Township. Hoping it would help his case, Fata?s lawyers attempted to get the case moved from the Detroit area, according to CBS News this summer. Fata became a naturalized citizen of the U.S. in 2009 and is a native to Lebanon. Court documents from also 2013 allege a charge of ?Unlawful Procurement of Naturalization? for stating that he had not committed a crime in the U.S. that he was not found guilty of yet. In all, he pleaded guilty to two counts of money laundering, 13 counts of health care fraud, and one count of conspiracy to pay and receive kickbacks.

?I?m numb,? Angela Swantek, a chemotherapy nurse and a whistleblower of the cancer-treatment doctor, told reporters. ?I?m not surprised though; I wondered how his team was going to defend him. The charts don?t lie.?

?I left after an hour and half. I thought this is insane,? Swantek said about her short time in Fata?s office in 2010 where she noticed patients receiving chemotherapy incorrectly. She wrote a letter to the state suggesting an investigation that day. In 2011, the state informed her they found no proof of wrongdoing at Fata?s office.

?I handed them Dr. Fata on a platter in 2010 and they did absolutely nothing,? Swantek said, adding she was relieved when he was charged two years later. ?I started crying. I thought about all of the patients he took care of and harmed.?

?At a time when they are most vulnerable and fearful, cancer patients put their lives in the hands of doctors and endure risky treatments at their recommendation,? Assistant Attorney General Caldwell stated. ?Dr. Fata today admitted he put greed before the health and safety of his patients, putting them through unnecessary chemotherapy and other treatments just so that he could collect additional millions from Medicare. The mere thought of what he did is chilling.?

Some of Fata?s victims are disappointed that they didn?t get the opportunity to speak at a trial, according to Click On Detroit. Others are glad to hear him admit to his fraud.

?I don?t think there?s any justice. I lost my sister and her children lost a mother,? said Cindy Burt. ?There?s just no justice for that.?

White Lake resident Karen Baldwin said her husband, Harrison, was treated for a diagnosis of brain cancer. She is unsatisfied with the guilty plea.

?To me true justice would be that Fata drops dead,? Baldwin said, adding, ?And I go home and my husband?s at the table saying, ?What?s for dinner? I?m hungry.'?

Dave Kroff was also put through years of unnecessary chemotherapy by Fata. Kroff says that the chemo suppressed his immune system so badly that he lost both of his legs.

?He?s one of several civil suits against Fata,? Donna MacKenzie, Kroff?s attorney, stated. ?The feds have seized millions in Dr. Fata?s assets. Will any of these victims see any of it??

Multiple civil suits have already been filed, according to Click On Detroit. For example, Donna Virkus, the daughter of one of Fata?s patients, says that her 78-year-old father, Donald, was referred to Fata by a concerned physician to rule out esophageal cancer.

?It?s unbelievable. I can?t believe we put our trust into a doctor that was supposed to take care of him and ended up killing him,? Virkus said.

Donna?s father never had the cancer, a review of Donald?s medical files showed. Yet, the prestigious cancer doctor ordered two years of chemo. The civil suit alleges that Donald developed a blood-related cancer as an effect of the chemotherapy treatments. Donald later died.

Civil suits filed against the Michigan doctor over fraudulent cancer treatments include other doctors and oncology nurses as well.

Doctors take an oath to do no harm. Obviously this sociopath didn't give a shit about his oath. What a piece of shit.

I do wonder if his nurses and staff knew what he was up to. I'm sure the doctors that referred clients to him are going to be affected by this.

Always get a second opinion on anything more than a minor diagnosis if possible.
    Ugh, yes.

It looks like he was targeting patients with Medicare and in a low-income area, too. I bet Medicare doesn't pay for a second opinion, and there is probably no way some of these people could have paid out of pocket to see another specialist. What a horrible person.

That sucks so much that nobody acted on the one chemo nurse's complaint. But yeah, the other nurses probably won't come forward if they knew he did that while they worked for him. They would lose their license or be banned from participating in govt/state healthcare programs or whatever, and it would be hard to find anything that paid that well. Nurses are always in demand though...no need to work for this piece of garbage.

    I can't believe this.

This might be a stupid question, but do doctors get money for prescribing any and all meds or just certain ones? Like...how did this make him money?

This is so fucked up. Will the families of those that wrongfully died get to sue this doctor? Because they fucking should.

When you are being treated for cancer you are in the office a lot. I was there 5 days a week for six weeks. Everytime you go in there's a charge for the visit, as well as whatever treatment they do. If you are doing chemo it may well be administered right there in the doctor's facility and you pay them for doing the treatment as well as for the drugs which have quite a hefty charge.

I also wouldn't be surprised if an unethical physician was able to collect kickbacks for prescribing certain treatments for his patients.

I'm sure they will sue, but they may be unable to collect much. I'm sure he had malpractice insurance, but I don't know how they pay in a case where fraud was being committed, and he's going to be in jail, so it's not like he'll be earning much.

Prosecutors seeking sentence of 175 years

Sentencing begins Monday for fraudulent cancer doctor Farid Fata
Prosecutors seeking sentence of 175 years.

DETROIT - Patients of a Detroit-area doctor received "stunning" doses of a powerful, expensive drug that exposed them to life-threatening infections, an expert testified Monday as a judge heard details about a cancer specialist who fleeced insurance companies and harmed hundreds of people.

Dr. Farid Fata is headed to prison for fraud and other crimes. But U.S. District Judge Paul Borman first is hearing from experts and former patients about the extent of his scheme to reap millions of dollars from Medicare and other health programs.

Nearly three dozen ex-patients and family members, many dressed in black, chartered a bus to attend the hearing, which could last days. Some will testify Tuesday.

"This is a small fraction of the people this guy has hurt," said Terry Spurlock, 52, of Holly, who had three more years of treatments after a tumor on his neck disappeared. "He gave me so much treatment, it stopped my immune system."

Fata, 50, pleaded guilty last fall to fraud, money laundering and conspiracy. The government is seeking a 175-year prison sentence, while the Oakland County man is asking for no more than 25 years.

The government said 553 people have been identified as victims, along with four insurance companies. There were more than 9,000 unnecessary infusions or injections.

"There is an aggressive approach to treating cancer. This was beyond. This was over the top," said Dr. Dan Longo, a Harvard medical professor and deputy editor at the New England Journal of Medicine, who testified Monday as an expert for prosecutors.

Longo was asked about patients who were given a drug called Rituximab, which can weaken the immune system if overused. It's typically given eight times for aggressive lymphoma but one patient got it 94 times. Another got it 76 times.

"It's a stunning number of injections of that drug. ... That creates a susceptibility to infectious agents of various sorts," Longo said.

If you didn't like these docs or couldn't see them for some reason you were out of options. There were no second opinions. Looking back it is all rather frightening to me. I wouldn't be surprised if something like this was going on at that time. These docs' patients had to trust them blindly.

Here- they took an old mall and converted half to a big medical center. About 90% of the doctors around here moved their offices to this mall medical center. You can get x-rays, lab work, cancer treatments- then you can walk out into the mall and go shopping.

Telling stories of deep anguish, patients and their relatives described Tuesday how a Detroit-area cancer doctor wrecked their lives through excessive treatments and intentional misdiagnoses while he collected millions of dollars from insurers.

A federal judge set aside hours to hear from victims of Dr. Farid Fata, who faces sentencing this week for fraud, money laundering and conspiracy. Some entered court with canes. Others wore elastic sleeves on their wrists, their joints weakened by years of unnecessary chemotherapy. They said they were betrayed by a soft-spoken doctor who won their trust but left them broke and devastated.

"Ten minutes just isn't enough time" to speak, said Laura Stedtfeld, who blames Fata for her father's death.

"Farid Fata, I hate you," she said, her voice rising as she turned toward the doctor seated 10 feet away. "You are repulsive. You disgust me. You are a monster. ... Clearly you're a coward because you can't even look at me now. You poisoned, tortured and murdered my dad."

Fata, 50, looked away, staring at the edge of the defense table, as two dozen people took turns speaking in court, just a fraction of the 553 victims identified by the government. A box of tissues and small bottles of water were available for anyone who needed to pause.

Prosecutors want Fata to be sentenced to 175 years in prison, while the Oakland County doctor is asking for no more than 25 years. Fata's sentence likely will be ordered Thursday or Friday after U.S. District Judge Paul Borman hears from experts.

But Tuesday was reserved for patients or relatives from all walks of life: a mechanic, a tool-and-die worker, even a doctor like Fata. Some of his patients didn't even have cancer but were treated for it.

"Even though I am not dead, I am a shadow of my former self. ... I have days when I cannot stand," said Maggie Dorsey, who can't comb her daughter's hair because of painful joints. "I trusted him. He trusted my insurance and my co-payments."

Not enough, as far as I'm concerned.

There's little worse than faking cancer, but telling healthy people they have cancer, and then destroying their health and lives with unneeded treatments is 100x worse.
