It's hard to explain when you haven't been through seconds or minutes of something scary or weird if that makes sense? It is literally like your brain slows down during the experience and you remember everything. I don't know if that is because of adrenaline? Does anyone know?

I'm so sorry Jink about your awful experience! What did you do to get out of it?? You know first hand then what Travis might have gone through!

Haiku are tiny little poems only 17 syllables long. Not everyone can write poetry, but anyone can write a haiku!

I have to say again, I can't imagine that even one of these jurors is going to say it was not cruel. I think it has to be unanimous. And I know there may be some jurors who are iffy on the death penalty, but they can vote their conscience in the penalty phase if the can't vote for DP. I just can't imagine they would completely remove the possibility of the DP in such a henious crime.

I don't know how anyone could even consider lunch after seeing those autopsy photos. So sad.

This trial is very upsetting on so many levels.... The only word that comes to mind is waste.

A waste of a promising young man.
    A waste of the future.
    A waste for the family.

    And even....

A waste of a young woman.
    A waste for that future.
    A waste for her family.

So much money, time, energy, and effort....

    For what? Seriously. For what?

    Nothing.

GRRRRR. Sorry to post off topic, it is just seeing so much of this process really is frustrating.

I attribute the 3 juries part to an article I read/posted in one of the subthreads last week. So, it seems 3 juries get a crack at deciding before the judge takes action. Unless the jury comes back today and they all agree no cruelty.
Thank you so muc hfor clarification. I am glad that the jury's verdict will not be over ruled! Hope it's just this 1 jury and they will all agree.

It is a waste of her life too, but, I just can't help but think that if it wasn't Travis she killed, it would've been someone else, eventually.

I think their relationship was toxic and it probably brought out the rage and instability in Jodi that he didn't want to be with her and they had no future. But, I think it could've been anyone before or after Travis, if that person had become the object of her fixation. For instance, had she thought Ryan Burns was a better catch for her social climbing, she probably would've moved on to him, and had he then dumped her, I think he would've been the potential victim.

Although I think Travis sounded like a good guy for the most part, I don't think it was so much him that she was obsessed with as the lifestyle she thought he could/would give her. She said he made her feel like a goddess. I think anyone who put her on a pedestal would've become the object of her obsession. Especially if that person also pulled the pedestal away (as Travis did) and wanted nothing more to do with her.

I thought I saw something that said a judge is allowed to over rule the jury's decision. She can not give her death if the jury doesn't agree, but she can reduce it to life if the jury decides on death.
Not sure if I read it here or on another site though so it might just be a load of BS.

If the jury says not cruel, the judge decides sentence. jury goes home. the judge can give her natural life which is LWOP. or the judge can give her life which is possibe parole AFTER 25 years. cuz that is how arizona rolls.

Thanks too for clarification! Totally makes me feel so much better!
This judge I don't think would give this monster parole. Least it's my observation during this trial. She is so overly cautious for this not to get appealed.

And to think she thought she'd be famous from the beginning! (manifesto) I don't think she knows how much hate/negativity there is for her in the world. Wish she could physically feel it, for I don't think she'd survive.

Which would save even more money for her appeals (though they would go against since she wants 'death') and additional cost for her pathetic life in a cell for years. Is it $30,000 a year?

I have always been against the death penalty. In this case, I cannot say that I would WANT Jodi to get the death penalty. However, with the way I feel about her after watching this entire trial, I won't be upset if she does get it. I feel like such a hypocrite!

From this article, apparently AZ has revised their death penalty rules, to have jurors solely decide (as of the last 2 1/2 years) as opposed to judges. http://www.nlada.org/DMS/Documents/1...hjurors24.html

I think it's a good possibility that she may get the DP as the article states that since 2002, juries have voted for the DP in 14 of 18 cases, so 78% in favor of DP vs Life. That compares to judges who have only handed down the DP in 15% of the cases.

At first I found it a little hard to discern what with the references to a new law in the last 2 1/2 years vs the mention of 18 cases since 2002. I would guess that those previous cases would encompass defendants who opted for a jury trial vs a bench trial. But it seems as of now that it's only up to the jurors to decide, I would guess barring the inability to reach a consensus.

I'm no legal expert by any means, but as I understand it, jury nullification can only be done if the judge can say that no jury could've found the way that this jury did based on the evidence provided. So, if the judge thought that the evidence provided was nothing that any could consider cruel, then she could overrule.

For what it's worth, Vinnnie P just said that should the jury come back with a verdict of "proven" that they could begin the mitigation phase today, that the family might deliver their statements. It was reported that Samantha and Steven will be speaking for the family. I'm wondering if that is why Samantha, knowing she might be speaking today, dressed in all black. :( I've never seen her dressed so somberly. This is going to be so hard for them, but also so gratifying to finally be able to speak to the defendant face to face and say...

I don't want to compare what I went through to what Travis did, as he was battling a knife, but I will tell you that these girls had me down on the sidewalk for what felt like an eternity, kicking and punching me. I could not get away from them. I must have been screaming for help because eventually some people came over and pulled them off me.

For the next 4 hours, I could NOT stop shaking. I think this was the adrenaline. I was literally physically shaking, like you do when you are very cold and your body starts shivering.

Based on what I went through, I do believe that until he went unconscious, Travis was fully aware of what was happening to him and he knew he was going to die.

I've read other accounts of people who've been in situations like that, and they all describe that time slows down and their thoughts become very clear. It doesn't mean one is capable of acting on those thoughts, necessarily, but in my case, it felt like my thinking was very clear even though it was a totally chaotic situation.

Here's what to expect from the aggravation phase:

    Prosecutor Juan Martinez's opening statement
Defense's opening statement [if they choose]
Martinez puts on evidence: Dr. Kevin Horn [medical examiner]
Defense puts on evidence, if they choose [This is not expected]
Instruction on the law by Judge Sherry Stephens
    Martinez's closing argument
    Defense's closing argument
    Martinez’s rebuttal closing
Jury deliberates. They must decide if the aggravator of cruelty was proven beyond a reasonable doubt.
    Jury's decision is a verdict.
The jurors' verdict form includes this language:

    ____ Proven
    ____ Not proven

If their verdict is 'proven,' the case moves to the final phase: the penalty phase. At this juncture, the jury will deliberate a third time on whether Arias will receive the death penalty.

If their verdict is 'not proven,' the case is over. Jurors will be excused. The judge will set a sentencing date within 30-60 days. Stephens will then decide if Arias gets life without parole or life with parole eligibility after 25 years.

Yes, I agree, I went through a very traumatic attack where I thought I was going to die. I was hyper-aware of what was going on and happening. It is as if time slows down.

Anyone think the jury has finished lunch, is playing scrabble now and waiting for like 3pm? I mean, if they come back too quickly, it will look like they didn't take into consideration everything that was brought forth by Juan and also the DT.

Actually, one of the defendants who was convicted is being retried due to Judge being a pill popping junkie among other things and I seem to remember the family there having to have those approved first.

If ever there was an horrific case it was this one.
ITA- I watched this trial and it was the worst, most haunting trial ever. I will never forget the victims. The worst part is the mainstream media would not cover it because of the racial issues!
