    I've been in an earthquake, and bad auto accident. Adrenaline there, but everything seemed to slow down to the second! I remember every second of these events. I don't know if it's the same as what Travis went through, I can only hope he didn't because that 2 minutes would be even more excruciating than the literal time.

    No there wouldn't be, the mitigation is purely to save her life. If the jury finds no cruelty, then it would go to the judge to impart a life sentence.     I missed jury instructions. If the jury finds the aggravating factor was met, then we go to a death penalty phase right? Juan will give us why she should be executed and DT will try to present mitigation.

    If they say extreme cruelty was not proven then sentencing would take place in 30 to 60 days. The Judge could give her LWOP or 25 yrs to life

    It seems a though the jury is having a working lunch. Beth Karas on HLN said one went down for a smoke and others wanted to have something to eat. I take that as a good sign we will hear something soon, if they are just having some snacks rather than taking a lunch break.

    I was attacked by two girls once outside of a night club. One punched me in the face, then I dropped to the ground and they were punching me, kicking me, and pulling my hair. I can clearly remember thinking, "they are going to kill me" while this was happening, and like you said, time seemed to slow down and I can still remember, over 20 years later, most of the details.

    Same here, I've heard she can only get life without parole, but other people was saying that she also can get parole after 25 years, and some others were saying that parole can apply to people younger than 18. So many conflicting theories hehe.
    We will have to wait and see. I really doubt that even if she has the opportunity to get parole, the judge will give it to her.

    This is why the jury will come back with the death penalty: (thanks again NCBlonde for the article on the jury in the Andriano case!)

    While jurors were discussing whether to execute Andriano, they considered that they would have no control over whether the trial judge, Brian Ishikawa, would give her life in prison with or without parole, she said.

    Jurors did not want to see a 25 years to life sentence.

    Because if they decide it was cruel, the jury is the one who decides the punishment, not the judge.

    The judge doesn't overrule anything. Here is what it is: right now they deliberate cruelty. IF they say YES, cruel. then this trial moves to phase 3. mitigation. IF the jury says not cruel, then it skips mitigation and goes to sentencing.
    If the jury says not cruel, the judge decides sentence. jury goes home. the judge can give her natural life which is LWOP. or the judge can give her life which is possibe parole AFTER 25 years. cuz that is how arizona rolls.

    I don't think the judge can overrule. If the jury comes back and says there was cruelty; and they all agree, then the DP is still on the table and ultimately the jury will decide DP or LWOP. Unless, when they get to the actual penalty phase vote and can't agree unanimously. And even then, a second (and I've read a 3rd jury if necessary) will decide life or death. And if 3 juries cannot agree, then the judge will decide.

    I attribute the 3 juries part to an article I read/posted in one of the subthreads last week. So, it seems 3 juries get a crack at deciding before the judge takes action. Unless the jury comes back today and they all agree no cruelty.

    And it gave me an idea.... since this thread can go a little nuts when there are long delays (like waiting for a verdict), we need a way to while away the time and a direction for our energy and creative juices. So I started a new thread..... a Haiku Contest for all things Jodi related.

    Bolded is ^^NOT CORRECT ^^

    No offense Sneakers but I have spent a lot of time going over these statutes...if the jury is unanimous that extreme cruelty was NOT proven, the judge will impose a sentence of Natural Life which is LWOP since Jodi was over 18 when she committed the crime.

    If she had been under 18 at the time the judge would have the option of Natural Life or Life.

    Natural Life =LWOP
    Life=possibility of parole after 25 years.
