Penalty phase. The question today will be if Jodi killed Travis in a cruel manner.
Jodi is wearing a peach colored shirt. Not a good color at all. No handcuffs or prison clothes for her today....even though she's a convicted murderer.
The court swears in a baliff to protect the jury during their decision.
Court instructions are read to the jury. The jury is being told about the death penalty versus life with Jodi.
JM is up with his opening.
JM says Jodi made sure she killed Travis by killing him over and over again. Travis suffered. Travis knew what was coming and he felt and heard it all. JM brings up suicide and Nurmi objects (Approach) JM brings up suicide again and Nurmi objects (Approach) JM brings up suicide again. It stung when Jodi tried to cut herself, but Travis did not have that choice. That blade went into his body and it hurt. Everytime that blade hit his head, it hurt him. Jodi took a knife and stabbed Travis in the chest area while Travis was squatted down in the shower. Travis suffered pain. The stab wound went into his heart. (Nurmi keeps objecting) Travis had the fight or flight, not Jodi. Travis was stabbed in the shower. The shower door was small and the only thing he could do was fight. He tried to take the knife away from her b/c that's how he got the cuts on his hands (Objection and approach) Jodi is fit and was strong. Travis reached for the knife and his hands were cut. Travis tried to attempt flight at this point. He tries to get to the sink. He's hurting and bleeding. Blood is coming. He's hurting. It's not a papercut. He stands there and sees himself in the mirror-he also sees Jodi in the back of him (Nurmi objects-Approach)
Travis is at the sink. He can see Jodi behind him. Jodi started to stab him in the back and his head. Travis was fleeing. He went down the hallway. Jodi was behind him. Travis went down with his head facing up. He was still alive. The last thing Travis felt was the knife in his throat. That was cruel

Nurmi says what happened to Travis was cruel. (Approach) This isn't a matter of cruelty. This doesn't meet the defination of cruel. Jodi did not know she was causing this. Jodi had foggy brain. She had flight or fight. The state has not proven this was cruel

I think JM opening was kind of lame, he is basing the cruelty issue on the sequence of events (which hasn't been proved 100%). He should have focused on the extent of the damage to Travis body. It hasn't been proven that he was being stabbed while he was looking at himself in the mirror or even if the stab to the heart was the first blow.

That was a really nice thing Det. Flores just did covering the screen. The family doesn't need to see that during a recess. He seems like a good guy.

Her eyes look more fucked up than usual. She looked worse on one of her "migraine days". It's more her demeanor that's the same, up until the one tear. Then she got red. I noticed the tear when JM brought up her nicking herself with the razor when she claims she was going to kill herself. I heard earlier that she would be in civilian clothes, but that totally sucks. She should be in prison/jail garb for this phase. She and Jen are still writing notes to each other too. Just another day in the life of Jodi Arias.
