    A friend that I lived with had family members in jail and in prison. Everytime they would call, I would hear a recording that basically stated that the call was coming from a correctional facility, and gave me the option of either accepting it or not.

    Don't think things have changed. If we were not home, the call would go to voice mail, but it was just the recording, never the person's voice.

    A little more about the process: The mitigation phase comes after the aggravation phase. This is where both sides present evidence of mitigating factors for the jury to consider in deciding whether to impose the DP. "The state may present any evidence that demonstrates the defendant should not be given leniency, including any evidence regarding the defendant's character, propensities or other acts." (AZ criminal code, Title 13.) That should be interesting!

    Both sides will have a chance to rebut, then the jury will deliberate as to whether the DP is appropriate or not. Their decision must be unanimous either way. If they are unable to reach a unanimous decision they will be dismissed and a new jury will be impaneled to deliberate on the DP only, not guilt or innocence. If that jury is unable to reach a unanimous decision the court will impose a sentence of natural life (LWOP.)

    I know Sheriff Joe claims JA got no preferential treatment but I don't believe him... she seems to have been pampered compared to the general (jail) population. I would love to be proven wrong but I doubt anyone could find a TV or even a radio interview of a convicted edit: MURDERER giving an interview immediately after their conviction (and not in handcuffs taboot).... anywhere really, let alone Maricopa County.

    So in this case, she will either get LWOP or the DP, right? I ask because I thought they could come back with Life with possibility of parole.

    With a M1 conviction the only sentencing options are DP or Natural life (LWOP.) No parole.

    Are you sure about this? I could have sworn I read that if the jury does not vote for DP, then it is the judge who decides either LWOP or the minimum (25 years) or above for M1.

    I wonder if the jury will be asked to consider that Jodi would be helpful to other inmates. To me, it shouldn't be assumed. I think Jodi would probably be just as selfish and manipulative in prison as she was before the murder. She seems to have a strange hold on that Donavan woman, which might mean that she likes follower-types... Not a mitigating factor.

    Paraphrasing, 'If the defendant is convicted of first degree murder, the trier of fact (the jury) at the sentencing proceeding shall determine whether to impose a sentence of death. If the trier of fact determines the death penalty is not appropriate and the defendant was at least 18 years of age at the time of the offense, the court shall impose a sentence of natural life (LWOP.)     Thank you for this... it's nice to have it explained so clearly. Jodi doesn't want "natural life", so I wonder what the defense will say to the jury.
