Where are you seeing this? I can't find it on the Court Calender or Case information. I show Jodi's case number is CR2008-031021

And I think the most important part of that filing is that IF she was not offered this plea deal and it went to trial, she would muddy the VICTIM!
That is what I got out of that plea bargain crapola. and I am glad Juan never responded at all.

Question - I know the judge told the jury that they will create their own deliberation schedule. Are we privy to that schedule? Anyone know what it is? TIA!

[QUOTE=Sneakers the Wonder Dog;3410717]No. If guilty M1 then aggravation phase and then if aggravators found then mitigation phase. Then sentence of either LWOP or DP.

If I understand the procedure correctly, once they find her guilty of M1, there is an Aggravation phase. This is where JM has to prove the aggravator of Cruelty beyond a reasonable doubt. If the jury finds the aggravator of Cruelty, there is then a Mitigation phase (Disco Donna - can't wait) where the Defense puts on evidence of any mitigating factors that may be present. Jury then deliberates the aggravating vs mitigating factor(s ) and decides Life or DP.

    1. Is there a significant time lapse between Aggravation Phase and Mitigation phase? If yes, how long?
    2. Will Victim Impact statements be heard? If yes, what phase?
    3. If jury chooses Life Sentence, is it definitely LWOP?

Huffington Post reported that an one hour notice will be given to attorneys, families, and media once the jury reaches a verdict.

(HLN) Jurors pay for their own lunch?? AZ is whack, or do other states do that as well..? no jury in AZ has been sequestered in 80 years, for example.

There's no evidence of any murdered pillows.

There'd have been pillow blood all over the scene.

We're in a recession despite what our crooked politicians, CEOs, Wall Street & criminals like Ben Bernanke & Henry Paulson tell us.

Hopefully the fact that the jurors have to pay for their lunch rather than depending on taxpayers or a stipend will make them return with a GUILTY verdict sooner.

I'm sure the defense will try to delay if there is an Aggravation and mitigation phase but I don't think Judge will allow it.

Victim impact statements come at sentencing I think, but I could be wrong. JM may be able to call a family member to testify about their loss during mitigation in rebuttal to her witnesses.

If jury goes Life sentence then it's LWOP. Period.

FWIW, regarding the noise of a gun - don't discount ambient noise particularly the insular effect of air conditioning (therefore no windows open) during a Phoenix, AZ summer.

On average, air conditioners run through the same range of noise levels as the dishwashers, but are often perceived as quieter because decibels are related to distance. If you're in the kitchen when the dishwasher runs, it will sound as loud as 60 decibels. An air conditioner won't sound that loud unless you're standing right next to it. Local ordinances regulate how loud an air conditioner can be. In Los Angeles, for example, an air conditioner can't be more than 5 decibels louder than the ambient noise.
Read more: Air Conditioner Decibel Levels | eHow.com http://www.ehow.com/info_12174751_ai...#ixzz2SXXWG7SF

    According to the NRA:
"Gunshot decibel levels, measured by John S. Odess, M.D., ranged between 143.5 from a .22 short to 174.4 from a .458 Win. Mag (American Rifleman, "Hear No Evil," March, 1996)."

Subsonic "gallery" rounds can be as low as 90 decibels, but the average is 133 for all calibers as measured at certifiedreloader dotcom.

IMO, add in the deadening sound (no pun intended) of water running and the insulation of the fiberglass shower stall and I don't think the noise would be as loud as you think if you were not in the bathroom with Jodi, Travis and the gun.
I hope that when the world comes to an end, I can breathe a sigh of relief, because there will be so much to look forward to. - Donnie Darko

I find it seriously disturbing that our jurors are paid $12/day (plus gas for the mileage from the court to their zipcode) and yet her defense has cost nearly $2 million.

I know that it is part of our civic duty, but $12/day is ludicrous. And, I remember after my day of jury selection (with judge Stephens actually) receiving my check for like $2 for gas – oh yeah, high rollin!! I made sure to cash it tho, just out of principle!

i don't believe any of it happened in the closet

Oops. Explained that REALLY badly. Don't worry, either do I. I wasn't limiting the gun retrieval to the minute & whatever of the attack. Was there really a door from the bathroom to enter the other end of the closet? Whether yes or no, it COULD 've been as the simple as "oh, I'll just get you a towel" & she comes back with a gun. I havn't spent much time analysing the shower photos, so most people here are easily more knowledgable than me, but the sitting photos strike me as unusual, & that blurry face shot (standing)looks (to me) like a person suddenly shocked or surprised, whether that's because he thought he was alone or because he had already seen a gun, we'll never know. But no, I don't believe she ran for the gun with him hot on her heels either. I'm not strongly attached to any theory, because there have been a lot of good ones & even those could all be wrong.

    Hilarious!

Plus, she would have thrown the pillow in the washer with everything else. She wouldn't have room for it in her backpack and it would look far too suspicious carrying a shedding pillow to her car.

I was on a 7 day jury last August...we got $10.00 a day, and on the 3rd day it went up to $25.00 a day.

The raise barely covered lunch and mass transit fees.

Seriously!?! $12 a day?? I was on jury duty years ago on a federal case and I was paid 40 plus gas if I remember correctly.

The pillow could have been injured some other way that day. It was only a piece of fringe that was probably pulled off, not a sign of gunshot. If the piece they found was only 2-3 inches, it could not have been from cutting a rope. It's kind of hard to cut that small a piece and why would anyone do that?

    Ours is $10 a day.

    Arizona:
    Compensation
As a juror, you will receive a mileage reimbursement for each day you serve. Compensation for mileage is the same amount paid to state officers and employees by statute.

If you are selected to sit on a trial, you will also receive a $12 per diem. Some courts pay the $12 per diem to jurors even if they are not selected to sit on a trial. Additional compensation is available to those jurors who serve on longer trials (lasting more than 5 days) if their employers do not pay them while they serve.

I've considered the rope story .... Just wonder what you all think about the possibility that the rope did happen but jodi brought it .... Good reason to have a knife handy. She did introduce the ky remember??
