My comment was that Jodi was using the "back" button on the web browser to go back one page. The "backspace" button would not take her back to a previous website where a boyfriend was checking email, unless maybe you had some wacky keyboard shortcuts. My point is that it is imprecise language and an unimpressive angle for a closing argument. I expected so much more from Martinez in his closing, and throughout this case. He continues to make it look harder than it is to put her away.
I hold The State to a higher standard. You expect criminals to lie. But I don't expect a medical examiner to make a critical contradiction in a sworn report in a death penalty case and call it a typo. I don't expect a detective to change his ideas to get in line with a lawyer. That is disappointing. I hate Martinez's style, I hope that's obvious. I just imagine how much better I would be doing this. Juan's presonality is repulsive (angry, resentful, mistrustful, loud, volatile) which makes it much harder to follow his arguments and support his ideas. He is always angry. He might get a conviction but it will be from the evidence (excellent) and not what he has done with it (adequate at best).
