That is, I believe, his only purpose in being called. The defense was fine, with their PTSD testimony....and Dr. DeMarte was probably only supposed to testify that she did NOT find evidence of it. But she went a step further, and started opining on the BPD issues. That went above and beyond rebutting the prior testimony.....it opened up a whole different diagnosis. That is why the defense is now allowed to bring in this last expert witness. He will likely confirm what their other experts have said...PTSD. Which we know is BS! LOL!

You think she was TONED? did you see the photo in pigtails with her huge cottage cheese thighs? She didn't look toned to me, but I dunno?
I do think she was....not bodybuilder kind of toned. But she and Travis used to do a lot of hiking trips and outings.....so I am thinking she had to have some stamina. More than me, certainly!!

Isn't it plausible that she 'does' have PTSD, however, it's as a result of the 'murder' itself?? There is no evidence that she had it as a result of what precipitated the murder. ..

Only if you believe her story happened as it did.....even then, it is highly improbable.

Not in believing her fairy tale version, but brutally murdering someone the way she did could result in PTSD, could it not?

Perhaps they believe in what they say, or maybe they are not ethical or maybe not professional in their actions...who knows?! But the defense has a right to call witnesses and I am totally respectful of that process. Many of the defense witnesses have turned out to be better witnesses for the prosecution. We need to trust that Juan knows a heck of a lot more about prosecuting this case than any of us do. Let him do his job. And if there is reasonable doubt in the jurors minds, then they have an obligation to act on that, as well. That is how our justice system works.
Oh I am more than willing to let Juan do his job!! I also agree that noone knows this case like he does. I realize that she is entitled to a defense but where we disagree is that I do not trust the dr. unless and until he can say that he bases any diagnosis of PTSD on anything but the ninja story. If he can testify that he bases it on something else I am all ears but if he regurgitates the same old Dr. Samuels and Alyce's claims I know that I will not find his opinion valid. I am very familiar with PTSD, and I don't believe so. It usually occurs as the result of something horrific happening to the sufferer, something of which they had little to no control over. There is no evidence to support this in Jodi's case. She was the aggressor. It would be a different story if she was the one who was attacked and brutalized, yet somehow she survived. That isn't the case here.....she had all the control, while Travis seemingly had none.

The court also excluded the Dr.?s testimony in Hawaii v. French, 129 P.3d 581 (Hawaii 2006) involving allegations of child sexual abuse.

In State v. Supulvado, 655 So.2d 623 (La. App. 1995) the court limited most of his testimony as he relied mostly on the information supplied by the defendant and he testified about effects of brain damage on emotional functioning though he is not a medical doctor.

    Strickland v. Washington, 466 U.S. 668, 687, 104 S.Ct. 2052, 2064, 80 L.Ed.2d 674 (1984). ?[C]ounsel is strongly presumed to have rendered adequate assistance and made all significant decisions in the exercise of reasonable professional judgment. Id. at 690, 104 S.Ct. at 2066.

22 The state trial court found that Dr. Geffner?s affidavit lacked credibility for three reasons: (1) the evaluation, which makes conclusions as to Clark?s conduct in 1987, was conducted five years later, in 1992; (2) Dr. Geffner did not review the court records or a transcript of the trial testimony; and (3) Dr. Geffner relied upon records from Clark?s childhood in Pennsylvania, with no records since 1976, and upon hearsay information supplied by Clark?s attorneys, with no independent verification of the information, and interviews with Clark. The state court further found that, even if credible, Dr. Geffner?s affidavit does not support a conclusion that Clark was either incompetent or insane at the time of the murders, or that he did not act deliberately within the meaning of the first special issue.

If his opinion makes as much sense as ALV and Doc Dick, then he will be written off as useless. But we can't judge what we haven't even heard, yet.

Geffner will stand on his head, do cartwheels and juggle monkeys if that's what the defense wants. It's what happens on cross and the jury questions that will be important.

The wording of your comment rubs me the wrong way. Cellulite is not really an indicator of how in shape someone in, most women have some (and i didn't even notice any on jodi). in her phone conversation with travis that was played she talked about how she had been jogging and in the police interrogation tape she could do some yoga moves so im sure she is someone who was fit and cared about exercising at least for vanity sake. Ryan Burns also said that she was stronger than she looked.

ETA -whoops, that's waaaaaaay too open to interptretation. & this is general FT, I shouldn't really have attached it to your post because my edit's ended up being more than I originally intended, as you'll see (possibly the only edit longer than the orig post) : I mean, it happens in all threads where emotions run high - just like this one. New members sign up to mds daily. You're not going to get jumped on simply because you've posted in this thread. Can't say you won't cop it for an unpopular opinion -just like here. But no-one's paying attention to whether they haven't seen your screen name because you've been in here, or because you've been lurking the whole site too shy to speak. I'm an mds noob like most of you. The first thread I really posted in was the other disliked thread. Despite that, & despite openly disagreeing with long-term members in other threads, this is STILL the only thread where I'm always afraid to speak honestly. More people have left mds after being attacked in this thread than any other. Check back for the names that never appeared again.

& again sorry FT, I know your post was about something specific &I've answered about something very general that you didn't intend to discuss

Plus she was able to do that headstand against the wall during interrogation

I dont think an out of shape person would be able to do all that

PHOENIX - A mutual friend of accused murderer Jodi Arias and victim Travis Alexander is speaking out for the first time since he testified for the defense in January.

Daniel Freeman was the friend caught in the middle. He was closer to Alexander, but so charmed by Arias he considered her part of his family.

?She was like a sister. She was part of the family and in my family when you?re a friend you?re family,? said Freeman of his once close relationship to Arias
Freeman said what most people don?t know is that he was closer to Alexander, but wanted to give Arias the benefit of the doubt when fingers instantly pointed her way after Alexander was found dead.

Arias faces a possible death sentence if convicted of first-degree murder in the June 2008 killing of Alexander in his suburban Phoenix home.

?I kind of defended her and said ?you know I don't know if she did it or not, but I can't treat her like she has unless I know, and the person I know wouldn't have done it,? said Freeman.

Freeman said he now realizes he really didn?t know Arias all that well.

On the day she was arrested a friend called to ?rub? it in, but the news came an hour after his brother committed suicide and Freeman was consumed by a different tragedy.

?At that point, it really didn?t matter," said Freeman.

Freeman visited Arias several times in jail, but the visits soon stopped. He just needed to move on.

?People would tell me to go see her when I was in town. I would think about it, but then never went,? said Freeman.

In 2010 Freeman was told he could be called to testify for either the prosecution or the defense and not to watch news reports.

He didn?t watch the news and his friends held back telling him things.

?My grandmother has watched the entire trial and hasn?t told me a thing,? said Freeman.

So Freeman had never heard Arias? third and final claim that she killed in self-defense. He only knew the intruder story.

Arias? attorneys called him to testify with only two choices, come on his own free will or be subpoenaed.

?I was just there to tell the truth and whoever called me would've got the same answers? said Freeman.

When Freeman took the stand he said Arias didn?t look like the Jodi he knew.

?Whey started the questioning that?s when I realized they were trying to paint Travis as the bad guy. Sitting on the stand, I kind of smiled because I knew that wouldn't work. He was a good guy - there wasn't anything bad in anything I ever saw,? recalled Freeman.

Freeman remembers looking over to Arias wondering what was she thinking, but only got a blank stare in return.

He also recalls looking over at Prosecutor Juan Martinez chuckling with Detective Estaban Flores. He said he knew Martinez was about to make him a witness for the prosecution and he welcomed it.

?At least it crossed my mind and whether or not it crossed his I don't know. But what crossed my mind was he realized I was just telling the truth and that I wasn't for the defense and that most of what I said he could actually use,? Freeman told ABC15

Arias? final story that Alexander physically, emotionally and sexually abused her was too much for Freeman.

?To me, I see someone who was a good man being dragged through the mud. We all have our weaknesses; we all have the things in our lives that we struggle with that are vices and it's not often that we have all our vices and dirty laundry dragged out for the whole world to see.?

In court, Freeman told jurors Arias and Alexander fought, but nothing out of the ordinary from a typical couple.

He said Alexander wanted to move on, but Arias just kept coming around and Alexander had trouble saying ?no? to her.

"When you're living a lifestyle that conflicts with your belief's to the degree with what Travis was doing, to me, that was why he said he couldn't marry her. He told me that before he said 'I love her, I care about her, but I can't marry her.'?

And as for Arias? latest claims in court, Freeman shakes his head.

?I don't believe her story. He (Travis) was murdered.?

I really liked Dan Freeman, and I thought he was an honest witness. I was glad to hear that his recollection of Jodi and Travis seemed to support the prosecution far more than the defense. I did not find his sister to be a very good witness, at all...for either side.

I took a walk outside today with my pups, and realized that I have been WAY too obsessed with this trial. I love you all but it's when it comes to the point of obsession that I have to step back. I am on verdict watch with the rest of you, I will not be able to see the closing arguments and regrettably the defense surrebuttal but trust me when I say that I am with each and EVERY ONE of you. I want justice done for Travis. Please remember him as you go about your daily duties/chores this week. That is what we are fighting for! Remember his family in your prayers or whatever you think about daily. They need your support. That is all I can say....I'm emotional and I feel the end of the trial coming. I just want to keep focus in what is important, not only in my own life but the justice that should come. Peace and love!

For PTSD to really work, Samuels SHOULD have said that the traumatic event was Travis physically attacking her and putting her in a situation where she had to defend her life with violent force. She was traumatized by his violent attack, her fight to the death to save her life, and being forced to take the life of someone she cared about. Then Alyce should have said that the killing was the culmination of an emotionally abusive and mindfucked relationship where his aggression was increasing over time until that awful day.

IF her version is true, I think PTSD could happen.

But, the defense also shit the bed and Samuels tried to claim (quite laughably) that she got PTSD from her "heinous crime" and not "the fight for her life", and how 30% of criminals have amnesia about their crimes, etc.

Even the best paid fabricators could not put together a convincing argument after all those billable hours - nothing tied back to self defense.

Would anyone making a guess on verdict date please post their guess here. Shelljet is charting them manually to see who gets closest. Please specify day you think verdict will be returned and whether you think am or pm of said date. Please include whether you think it will M1, M2 or manslaughter.
