Does it take of 2 stab wounds off the total and turn this overkill into 25 stabs, slit his throat and shot in the head. Hey maybe as a violence pusher, he can say liars panic easily?
Well, if the motion is approved at least I will get one more day in court! Yeah, Jodi ruins every fucking thing. I just can't get over what they hope to accomplish with this new Dr coming in except to ruin his career as well?? I think that would make a great t-shirt! Would have a picture of her with the words "Jodi Ruins Everything" and might have some pictures of the Starbucks, Tootsie Pops, Pop rocks and Toblerone. Can someone please Photoshop that for me????

I can't believe this guy is going to go out on a limb for Stabby. Another misguided "professional" who was probably manipulated and lied to by the motley crew. I hope the Judge does not allow him to testify and further muddy the water. Jen's cross should have been enough already. I bet Stabby is insisting she doesn't have BPD and it's sticking in her craw that Dr. D was so effective. She calls a lot of shots in this Defense, and she can't have her reputation ruined by being labeled BPD. She doesn't give a shit about the disgusting things the world saw and heard, she wants to set the record straight about her lack of mental health issues. Forget about the murder, Stabby can't deal with any diagnosis of her that she can't control.

Thats what I'm thinking. And didn't Dr. Samuels indicate he considered another diagnosis but eventually decided on PTSD?
I hope you're right, that the judge will say this exact thing to the DT - that they had prior knowledge of this so they don't have any real NEW evidence with yet another psychologist.

Freethinker quote; "You go with RAGE?? So you are on the defense team then. So much for premeditation."

Oh no. Not in the least. This was absolutely premeditated. There are many premeditated killings are rage-full. Her rage and hatred for him is the reason she planned his murder. It was the vehicle that drove her to plan and execute. I'd also throw psychotic jealousy into that mix too. She doesn't think like us. We might get angry, jealous, even rage-full, but our emotions do not drive us to plot harm. I'd say she was seething for months before the murder.

CONFIRMED - As reported here earlier, Dr Geffner is the proposed surrebuttal witness for the def. He is a colleague of Alyce LaViolette and will rebut Dr DeMarte's claims of BPD.

    570. Voluntary Manslaughter: Heat of Passion - Lesser Included Offense

A killing that would otherwise be murder is reduced to voluntary manslaughter if the defendant killed someone because of a sudden quarrel or in the heat of passion.

The defendant killed someone because of a sudden quarrel or in the heat of passion if:

    1. The defendant was provoked;
    2. As a result of the provocation, the defendant acted rashly and under the influence of intense emotion that obscured (his/her) reasoning or judgment;

    AND

    3. The provocation would have caused a person of average disposition to act rashly and without due deliberation, that is, from passion rather than from judgment.

Heat of passion does not require anger, rage, or any specific emotion. It can be any violent or intense emotion that causes a person to act without due deliberation and reflection.

In order for heat of passion to reduce a murder to voluntary manslaughter, the defendant must have acted under the direct and immediate influence of provocation as I have defined it. While no specific type of provocation is required, slight or remote provocation is not sufficient. Sufficient provocation may occur over a short or long period of time.

It is not enough that the defendant simply was provoked. The defendant is not allowed to set up (his/her) own standard of conduct. You must decide whether the defendant was provoked and whether the provocation was sufficient. In deciding whether the provocation was sufficient, consider whether a person of average disposition would have been provoked and how such a person would react in the same situation knowing the same facts.

[If enough time passed between the provocation and the killing for a person of average disposition to "cool off" and regain his or her clear reasoning and judgment, then the killing is not reduced to voluntary manslaughter on this basis.]

The State has the burden of proving beyond a reasonable doubt that the defendant did not kill as the result of a sudden quarrel or in the heat of passion. If the State has not met this burden, you must find the defendant not guilty of murder.

    Instructional Duty:
The court has a sua sponte duty to instruct on voluntary manslaughter on either theory, heat of passion or imperfect self-defense, when evidence of either is "substantial enough to merit consideration" by the jury.

Mauritius! Lucky you! I'm on the 'less expensive' Atlantic side in Lanzarote. I'd love to go to Mauritias, but I've never been to the Canaries either. I'm looking forward to photographing the volcanic landscape! It's been such a long winter in the UK, don't you think? Our spring daffs and croci all froze and died this year. It's great that we can keep up with developments in the trial!

When JW asked Dr. D about the deletion of the pictures and said ?you know she was a professional photographer? she made it sound like Jodi was a camera expert who has a BFA in Photography. NO, NO, NO, she was a high school dropout who worked as a server and liked to take pictures that does NOT make you a photographer. End rant.
I think WT hit it on the head with that last email causing her to crack. Here she is living in a broom closet, after leaving her boyfriend of four years to be with Travis. She converted her religion, fucked him 8 ways from Sunday, and he had the audacity to reject her. I believe that she planned his murder from that point. I also think that she went there she decided to give him a chance to change his mind by using sex. When that failed, she carried out her plan.
There is a lot of ?I think? up there, so this is all just an opinion. I also want to clarify that I am not knocking or insulting servers. I was just trying to point out that her profession was not as a photographer.

IMO, what JA knows (and not with any skill) is photo editing. I've known photography all my life. My Father was a press photographer, and although photography is art (IMO), it is also steeped in graphics, and even math! You need an eye, for skill, and you need a good sense of intuition and depth if you are going to create art! Art that is interesting that is! JA doesn't have these qualities and it shows! All her drawings remind me of HER! They show narcissistic qualities, as if she is drawing herself, in chameleon form, over and over again! And they are childlike at best! The best natural photographic shot I've seen of hers is this:

It has depth, (and depth of field) and is particularly poignant in light of her murderous actions. And I'd bet anything it was an accident with a good lens!

but JD discredited their witness IDing unethical behaviors so its a free ball game again. Samuals agreed with BPD he just added NOS to it. So the def will have two or their own witnesses disagreeing

Dr. Robert Geffner wrote a treatment manual on how to identify and treat sex offenders. I have learned about all I need to about him. You can't rehabilitate sex offenders!

According to Stabby, she would have only used a gun to kill someone because she would want to make sure it was as humane as possible

THIS! This is exactly what I thought too. Jodi's running this dog and pony show from her side of the courtroom. The worst thing you can do to someone with this type of personality disorder (personally, I think she has histrionic and narcissistic disorders as well) is to unmask them. Fate worse than death for Jodi's kind. I don't think she cares one hoot about being called a murderer. Just don't call her crazy.

At its end, a single juror will have made about as much as most of us make in a 5-day work week. It's sickening. Oh, and Nurms and Palin will have made more than most of us earn in a couple years.

Maybe that's what ultimate made her decide to take Travis out... he called her a sociopath.

I'm partially kidding... but I agree with you. When somebody has a personality disorder, the things that set them off don't make sense to normal people.

My NPD mother goes off the deep end if you correct her or point out that she's wrong...

So, assuming for shits and giggles, this new sur rebuttal witness is allowed. he works with the queen of the dwarves, or supervises her as he is a PHd? what can he possibly say that isn't a regurgitation of what the last defense relic said? what would be that point? have jurors saw their arm or leg off to get out of jury duty at this point?

and my next question would be, if he is there to rebut < is that a word? > Dr Demarte, and I have a mongo girl crush on Dr D, his background appears to be with childhood trauma, and sex offenders...would he be there to rebash Travis? Haven't the bottom feeders sunk low enough?

@ Crickets, watched some of that Dr. , seems I answered my own question, more bash the victim... how awful, how awfully sad. (vomit)

I'm not discussing him until we know he will be a defense witness. As of now, we don't know it will happen. And even if it does, I don't think it will add any relevance to the case.

So, what about Nurmi's petition to the judge to include manslaughter in the heat of passion. He wants the lesser degree added to the jury instructions.
