Just from the juror questions, I'm pretty sure this stipulation won't sway the juries opinion. The sad fact for Jodi, is that her side of the case is basically over, and if she was going to win, she'd be winning by now. From ALV questions from the jury, they(most and many jurors) don't sound like they're buying any of it, and it isn't looking good for her at all at this point. Now Juan's going to go in for the kill with the rebuttal. I think it's looking pretty good for Travis at this point.

Right ... the bodybugg was on Travis' arm in the pics & it was NOT duct tape. That was already confirmed in testimony. BUT did we ever hear of crime scene marker #40 being mentioned in the trial yet? Was it tested for DNA or anything? Or was i found not to be part of the evidence?

This ridiculous photo reminds me of how the OJ trial started to head south. Ito let everything plus the kitchen sink in and now Sherry is doing it with this photo/expert. I hope Nurmi and whats-her-face don't go hog wild on stuff like this or we'll be here forever.

We have the exact same timeline as before that proves her self-defense story was impossible, as well as all the other evidence that disproves it (ME's testimony, bullet trajectory, closet.) And none of the premeditation evidence is affected either.

Please enlighten me if I'm missing something here...

That leaves very little time for Jodi to stumble around, as she claims she did, and find that elusive knife and gun. It makes her story seem all the more absurd, and just makes the scant time line stand out even stronger. I don't think this was a good move for the defense.....and I think it gives a leg up to the DA that Jodi HAD to have known precisely where those weapons were, and they would have been pretty much right at the scene. Pre-meditated, NOT on the fly.
Above in bold, plus JM saved who knows how many days of this guy being examined and cross-examined and redirected blah blah blah...all in all a total non-event IMHO. If anything, as Annie points out, it weakens the defense case.

Yeah. But, I would have felt better if the stipulation was that it was "not possible to tell if Jodi is holding a gun or a knife" in said photo. That's closer to the truth. There is NO WAY to tell if she is or isn't. I don't like the prosecution agreeing to the "fact" that she is definitely not holding a weapon.

I agree, except JA never returned the gas cans to Darryl. People here have speculated she traded him the gas cans for the DVR.

I haven't heard anything about the duct tape. I definitely think it is possible that she used it to conceal a weapon.

Maybe the defense and prosecution agreed to leave it out. (Ggggggrrrrrr)

I don't think there was enough evidence in the photo to even say it was her, let alone holding a knife or gun. I like Juan's theory, it was a dog...lol.

Exactly. This is just really weird.
Maybe Martinez is just anxious to end the defense's shenanigans so he can get onto his rebuttal.

I always wondered the same thing.......why the photo was shown, but never explored. I'm now thinking that JM may weave it into his closing argument, suggesting that it held a concealed weapon somewhere, and that supports the pre-meditation theory. Couple that with the fact that both sides agree that Jodi was NOT holding a knife or weapon when the close-up photo was taken? Bingo. He will suggest that, instead, it was taped to part of her body or inside the bathroom or closet.....somewhere that it was at her fingertips when she began her assault. It was not visible to Travis, as he would never have let down his guard to get into the shower in the first place. I'd say that Jodi's goosed butt is cooked.

I agree... He certainly hasn't let us down thus far. I am sure he felt it was too irrelevant to argue over, so he put it to rest. I am without doubt confident in the way he is proceeding as I can only guess Travis' family feel the same passion.

I have spent most of my life on the east coast, but lived in Nevada for several years. Living in the desert, smart people drive their cars fully prepared for the event of a break-down. It is a matter of life or death, particularly in the summer months when the temps can soar into the 120's. You don't walk to your mailbox without water in your hand. :)

Yeah, I've pondered the gas can/DVD player conspiracy quite a bit. We definitely know that she never returned them, but I'm not sure it's because they traded a DVD player. BUT, Darryl seems to be a fairly honest guy, from what we know right now. I'm not so sure he'd go along with it if he knew there was a theft involved. HOWEVER...Matt McCartney would have definitely made some kind of deal. What that deal could have been is obviously pure speculation. I really do hope he testifies. I have a feeling he has an enormous amount of shit Jodi. Especially if he wrote the pedi letters, and it was proven, or anything else he helped her cover up about the murder. If Juan has info like that, Jodi's so fucked. Unfortunately, he could give a lot of info on Jodi's behalf, but if threatened with prison time, he might just sing.

ive traveled the same freeways jodi traveled going to Arizona, and ive never had a need to carry gas cans

i can see why she would carry alot of water though. she probably got thirsty, but could have also used it to wash herself off after the killing

At first I thought it seemed reasonable for a woman driving alone across the desert to carry extra gas, but 15 gallons just doesn't make sense from that standpoint. Especially since she bought the 3rd can just before setting off from S. Cal. to Mesa, when she already had the 2 cans from Darryl.

One other gas can-related bit of info: Jodi said during direct exam w/Nurmi that when she and Darryl moved to Palm Desert they always took extra gas along when they went on car trips. Darryl doesn't mention anything about that in his testimony, which was before Jodi's. In fact, he says when she asked him for the gas cans in 2008 he asked her several times why she wanted them, and she was evasive about answering him (got "testy" in his words.)

So, the 3 gas cans is a big deal pointing towards premeditation.

One last thing...can we please stop referring to Darryl as 'OG' (old guy)? He is 52 years old for cripes sake! PLEASE??!!

Wonder if ALV caught the 1st flight out of AZ or if there is anything else for her. I don't expect to see her, but who knows? I am very concerned about why the Defense didn't rest though. At least the jury would have gotten a good night's sleep.

I think it's powerful that the judge says to the jury, after they have waited for hours, "Ms Arias is not holding a weapon" in a picture taken a moment before his death. The judge's impartial words carry more weight than the attorneys and witnesses. For the jurors, the entire day resulted in one resounding thought. We don't know how it will factor into their decision.

I know. This could be a wild card. A definite WTF? moment.

I still can't see why The Prosecutor preferred the judge to say Jodi was unarmed vs showing them the picture and hearing the testimony. I would have taken my The Prosecutor Pen and drawn the outline of a gun or knife right above the camera flash. Something metallic and reflective is right there. Then I would take the white Jodi outline from their picture and overlay it on pictures of Area 51, Crop Circles, and Neverland Ranch to clown Nurmi and get another misconduct charge. The judge's words are more conclusive and final than any testimony or even the picture + outline itself.

Those things are important Sneakers, but on balance I see the minute before the killing carrying a lot more weight when jurors imagine the crime. Here's a picture that you can see with your own eyes (if you are allowed), showing "supposedly" an "unarmed photographer" right before the killing. It could sway the jury away from premeditation. It also makes Jodi seem slightly more credible. It fits her story and it's evidence that came out after she came up with story 3.2.

Just saying she didn't have a gun or kinfe in her hand right before the killing helps the defense case. Now the jury imagines her unarmed. Not the mental picture of a killer.

I hope Martinez is not overconfident, or distracted with the side issues. Maybe he is too impatient to begin his rebuttal case. But when I think back, there are some things that may have been overlooked. When he questioned Jodi about the day of the killing, I wish he had asked her some other things:

-When did you pack your bags?
-What clothes did you bring from Yreka? How many outfits?
-What were you wearing when you had sex downstairs?
    -When did you shower?
-Did you wash your clothes at Travis's?
-When did you put your bags in the car?
-What were you wearing to take the photos?
