The Judge needs to review the amended Daubert Rules


In 2011, Rule 702 was again amended to make the language clearer. The rule now reads:

RULE 702. TESTIMONY BY EXPERT WITNESSES

A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise if:

(a) The expert’s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;

(b) The testimony is based on sufficient facts or data;

(c) The testimony is the product of reliable principles and methods; and

(d) The expert has reliably applied the principles and methods to the facts of the case.

(As amended Apr. 17, 2000, eff. Dec. 1, 2000; Apr. 26, 2011, eff. Dec. 1, 2011)

While some federal courts still rely on pre-2000 opinions in determining the scope of Daubert, as a technical legal matter any earlier judicial rulings that conflict with the language of amended Rule 702 are no longer good precedent.

If the jury can't just see for themselves what is or is not visible in the enlarged picture, then it should not be allowed. If the "expert" has to draw an outline to demonstrate what he thinks is there, then it is too subjective.

My my, very telling post. Do you know what, I've been waiting on someone like you questioning others' outside the US's right to 'comment' on the US justice system. Just a FYI, the US's justice system is pretty much the talk of the whole world at one time or another whether you like it or not. I don't have a problem with ANYONE commenting or questioning on the UK system, it's not a slight on me or my countrymen, I accept it as being part of a 'participating world'. If I'm confused about anything in YOUR justice system, if I can't find what I'm looking for on google, I'll ask, and many of your fellow countrymen are happy to oblige. As I do in return, and guess what, if someone sees flaws in the UK system, I love to hear their opinions, because 8/10 times I'll agree with them. You need to take your head out of your arse.
