Hi Freethinker. It's not new news that the Defense put forward the motion to take the DP off the table because of Flores' testimony, but it is new news (at least to me) that they have appealed to the Supreme Court after being turned down in Criminal Court. Thanks for this! The DT are doing anything that they can possibly do to slow down or halt this trial! I'm not sure how they think this is going to be of benefit to Arias? The State's evidence against her isn't going to change.

Great idea tia..I forwarded this to the court clerk and she is stapling a green tag to it for submission. NG says she is bringing the twins and a Spidyman cardboard cutout for photo ops. Jodi would love to take the photos, but she doesn't remember where she left the camera
What's been bothering me this morning is that Juan kept bringing up that ALV spent 45 hours interviewing Jodi. I think HLN reported on her visitor log this week, due to Jodi's twitter account. What if the jail's records show that ALV wasn't actually there 45 hours? It's been nagging at me.
Also Metis (I would quote you, but you use such a large font) As the eldest sibling, wouldn't Travis have protective traits in regards to his siblings? And if it was only the grandmother raising them with no grandfather, wouldn't he then be a father figure in the household?

This is a very long post filled with dire predictions that you state you know will occur in the future to harm various groups of people. All because ALV faced backlash.
I disagree with your conclusions. You don't know what will happen. Your predictions are very 'dramatic'. The whole world is not watching this trial, and neither is the whole USA. This will not affect justice and fair trials forever because no expert witness will be willing to testify. Cases where ALV testified will not be reopened, there are no grounds for it. That's my prediction. Let's meet back here in a year and see who was right, shall we? I'll mark my calendar.

I thought it was strange timing. It was on a page dated April 13, but it didn't seem right. If I remember correctly, didn't Flores clear that up on the stand?

well every thing i have read says they would be allowed to empanel a new jury if there is a deadlock in penalty phase, but i found it doesn't happen too often, i only have found 2 cases so far, it looks like if the jury is deadlocked, the prosecution then lets the judge to sentence LWOP - i think it may be more appealable if that happens, because the defendant can have an appeal on just the penalty phase and have the death penalty overturned.
i think because the law has not kept up w/ technology and this is the first time this has ever happened to this severe degree, the law doesn't not know what to do. defense atty's are arguing if this is allowed to continue, then they will never get an expert to testify for their clients in any hi profile case again, and then no one will ever get a fair trial. it will be interesting how much effect it will have on this trial because if they use it for an appeal, it would have to go all the way to the supreme court because it is brand new territory, but i bet after this trial there is going to be an attempt to change laws to try to censor what can be written on the internet - and i have no idea what would happen
When Lenore Walker, who Alyce mentioned as a hero/mentor, was going to testify for OJ Simpson there was a similar outrage. Of course there was no social media then but people protested, wrote letters, made phone calls, etc.
There is no grounds for appeal based on anything that happens outside the trial itself. Alyce didn't change her testimony due to outside pressures and her behavior on the stand certainly belies the fact that she felt "intimidated" on the stand. The court record will reflect she battled with the prosecutor, asked him if he was mad at her and one point suggested she would put him in a time out. Hardly seems intimidated to me.

you know that is interesting idea, i wonder if ppl in family court who have had infavorable outcomes because of alyce will try to appeal now because she has proven she has such a biased towards men? cuz this testimony can be used now to impeach alyce on every case she will and has ever testified to in court, so besides ruining her career, she might have put any case she has ever been invloved in, in jepordy

i don't think an appeal on these grounds would work, but if the try it, it could last years and years until it reached the supreme court where the can agree or deny hearing the case because it is a new issue

FYI - I just wanted to let you all know that several posters on another website have reported computer problems after viewing the JAII site. I only mention it now because I just a had a problem restarting my computer. Make sure you have adequate virus protection, firewall and pop-up blockers if you're going to view dubious websites.
Also, from that same website, regular posters have decided not to make any contact with people they haven't known for awhile.
I don't think it's just paranoia. The controversy over Alyce started weeks before she even took the stand. Now that she is claiming internet attacks, then opening her own twitter, it's not far-fetched to think that the Jodi supporters would launch a "counter-attack."

A few things to take away from Alyce and her biased testimony:
Stabby didn't write about abuse in her journals or to other people but it still means she abused
TA didn't write fearing her in journals means it didn't happen and speaking of fearing Stabby to other people also means it didn't happen.
Alyce kept dropping supposed IM's about Spiderman underwear into her testimony. If there were in fact such IM's why didn't defense introduce them during Stabby's testimony?
Could Alyce have ladies underwear commonly known as "boy shorts" mixed up with little kid underwear? Alyce also stated that Stabby was the one who mentioned them, not TA.
What happened or was wrong in Flores' testimony? I must have missed it.
While I agree that it's of paramount importance that the defense be allowed to mount a defense, I disagree with Alyce's decision to answer every juror question with some tidbit about Travis' life, his abusiveness, or his abusive family.
This woman's obstinacy is doing the defense no favors. Practical, level-headed people, experts or not, acknowledge both sides of an argument, if even to a small degree. Her inability to apply even a small amount of the same criteria to Jodi's upbringing reeks of an overt inability to remain unbiased. Further, it is inherently obvious she is being coached, which further weakens her credibility.
In addition, her snarky attitude towards the prosecutor, combined with her desperate need to control the courtroom, makes her all the more just an unlikeable person.
I think she has done a lot of damage to the defense's case.
