sure you are, it's the same as saying girls in short skirts should know they will get raped, a 'sick person' could take the short skirt as an invitation to rape ignitiing the rapists hard on.

Fuck's sake, Jenn! Going to pee and Travis masturbating to pictures of little boys, or Travis breaking Jodi's finger are NOT in the same category of "every little thing that happens during someone's day."

Okay, I have to this is the bottom line for me with the whole stalking issue. None of us knows whether he truly feared her, or why he kept contact. We do know he had a big blow-up with her, via text and said all of those things about her being a sociopath and the worst thing that ever happened to him. Was he being dramatic? Maybe. Was he just in the moment and angry? Maybe. Did he really mean it? Maybe.

We do know from everyone who knew Travis that the first thing they thought of when they found out he was murdered was "Jodi did it". There has to be a reason for that.

It's because they knew her, they knew Travis, and they knew what their relationship was like. That's something none of us can say.

With regards to what the jury will think? Well, I think they're going to believe that he was scared of her. Why do I think that? Because they're sitting on a jury because Jodi brutally murdered Travis. Is there truly anyone on the jury who is going to think, "Well, she slaughtered him in a violent overkill, but there's no way he could've been scared of her! He must've been joking!"

    I personally don't think so.

I think Travis knew Jodi was capable of doing something bad to hurt him. Was he 100% convinced that she could ever follow through with it? Maybe not. Still though, put yourselves in his shoes and ask yourselves if there was ever a person who acted the way Jodi did, to you/me/us, would we have some level of fearing? Even if it was just fear of thinking someone was capable of it, even if they never followed through, or even if we were sure they would ever follow through?

I think that -- unless any of the jury is buying the abuse excuse -- I think they are going to believe that he had some level of fear, because he said he did, and look what she did to him.

Hmmm.... well if one were to wait 2 years after murdering someone to decide to claim self defense, wouldn't it be too late to write in your journal from 2008 that you were being abused?

Rule 703. Bases of an Expert’s Opinion Testimony

An expert may base an opinion on facts or data in the case that the expert has been made aware of or personally observed. If experts in the particular field would reasonably rely on those kinds of facts or data in forming an opinion on the subject, they need not be admissible for the opinion to be admitted. But if the facts or data would otherwise be inadmissible, the proponent of the opinion may disclose them to the jury only if their probative value in helping the jury evaluate the opinion substantially outweighs their prejudicial effect.

Ummmm...yeah, if she had planned to need to make those things up back then, you BET she would have put it in there. But why make it up BEFORE she needed that to get her off from committing a murder.

    Stupidest line of questioning

What you say makes a lot of sense to me.

We don't know what prompted Travis to write that text message to JA. Could he have found out about the recorded sex conversation? Wonder if we will ever find out.

"While the State is trying to convince the jury that Jodi?s story doesn?t make sense, in reality, her story makes much more sense than the State?s. Here?s what the prosecution would have us believe:

That a woman of above average intelligence decided to drive 1000 miles to kill her lover and here is the premeditated plan she came up with:

    1. Steal the murder weapon from grandparents? house ? just one week before the killing. (Surely no one will ever be able to make the connection.)

    2. Rent a car 90 miles away from home to avoid detection (but be sure to attract attention by quibbling over the color.)

    3. Drive down to Darryl?s house near Monterey and borrow gas cans so as to disguise travel route (rather than just buying cans along the way with cash ? because, of course, we can totally trust that Darryl will never mention the gas cans when the police inevitably come knocking on his door, since the police will obviously be investigating all of Travis? friends, including ? and perhaps especially ? me.)

    4. Drive over to Mesa and arrive at Travis? around 4:00 am. (Note to self: Must find out when roommates might be home or could possibly come home.)

    5. Don?t shoot him immediately and quickly beat it out of town so as to avoid being seen or arriving suspiciously late at Ryan?s in Utah, who will, by then, be expecting me in approximately five hours. (Instead sleep the night with Travis and have sex with him so that my presence will be thoroughly imprinted all over the scene.)

    6. And be sure not to shoot him in the middle of the night while he?s sleeping. Instead wait until he?s fully awake and conscious (so that, in the name of all fairness, he can have an equal chance of killing me instead.)

    7. Before killing him, have him take photos of me ? with time stamps. (Just need to be sure to throw the camera in the washing machine before I leave ? rather than disposing of it along the way with the gun.)

    8. Do not drive directly to Utah up Highway 17 (even though already running quite late at this point) but rather make a detour over to Hoover Dam (maybe to take in the sights).

    9. And somewhere between Kingman, Arizona and Hoover Dam be sure to call several people on cell phone (so that there?s a clear record of my travels north out of Arizona ? in spite of the reason for getting the gas cans.)

    Yes, quite the plan?"

Alyce talking about Travis having a pattern of making sarcastic comments shows him to be an abuser.

Hmmmm, I remember Alyce's pattern of making sarcastic comments to Martinez....

well yeah, because a mentally healthy person would move on when their love interest continues to pursue other women. Mentally healthy people don't continue in relationships that make them feel like toilet paper on the bottom of someones shoe. Sometimes I think he was acting like a cad hoping she would grow tired of him. It's a lot like Charlie and Rose with a lot of butt sex

You can't have it both ways at the same time. Yes, Jodi was a crazy possessive jealous unstable disturbing horndog diary-filling killer. But not a stalker.
Sure you can. Some of Jodi's behaviors were stalking. Others were not.

Travis was at times stalked -- so was I.

Travis at times engaged the woman who had stalked him -- so did I.

Travis had sex with her even when she arrived uninvited -- so did I.

Travis was not afraid that Jodi might physically harm him -- neither was I.

My ex who stalked me for a period of time did not murder me. His did.

It's not black or white. These are fluid relationships, ever changing.

    You are so articulate <3
I've been in Travis' shoes, I just happened to live to know how right my feelings were. I can't count the times I said 'if you find me dead', or the times I even made my own jokes about it. Can't put it into words well, but, yes, I feared "I" was right while at times talking myself out of it. Even knowing how dysfunctional 'it' was, "I" was, even deciding to leave it [a few times], I never saw the knife that would be held to my throat really coming, until it was there.
