    Does anybody know AZ definition of 2nd degree murder? Also, can't premeditation be formed at any time? I have heard that in jury instructions or arguments in other cases.

    whohoo! Thanks! I hope FB gossips didn't screw up on the Cancun one. I could be wrong but, I do believe what we are seeing in "Cancun PPL" is that killer was indeed scheduled for that trip and Traivs booted her ass off it. Oh please please Santa make this come true. : )

    I agree, there is nothing wrong with posting a different opinion. I don't think most people here object to that at all. It wouldn't be a very interesting discussion if everyone agreed with everyone else all the time. What I think most find bothersome is the endless repetition by one person of the same exact idea over and over and over and over and over and over and over again, ad nauseum.

    State your different opinion... great, go for it! State your exact same opinion 100 times, using a tone of "I am so superior and you are so stupid you can't grasp what I am saying", interspersed with commands to go review someones posts or commands to reexamine the evidence (because clearly nobody has a clue what the evidence is except this person)... is astonishingly annoying and inappropriate.
    You ARE so right! There is noone on the planet[/I]more annoying! After reading her posts you feel like there has been an attempt to brow beat her opinion into your head if only you were smart enough to allow it! Also the multiple multiple times how she speculates how horrible it is that Travis was just not as smart as she would have been or was in her particular situation. But then just to add insult to injury, she follows each and every droning post with a "Justice for Travis" type comment. Above all she wants us all to know that she is smarter than Travis and even smarter than Juan Martinez. She knows exactly how he should handle this case and he is definitely NOT doing it right. Forget about his vast experience and amazing track record...just know that she knows exactly what he needs to be doing. I have never used the ignore button either but in this case, I'm going to make an exception!

    I would think that they're bringing in the Cancun PPL person to verify that Jodi had been recently taken off Travis' reservation?

    From there, it gets more nuanced. If jurors cannot agree on premeditated murder, they are obligated to discuss the lesser crime of second-degree murder, then manslaughter and negligent homicide. But there are no "lesser includeds" for felony murder; if the jury finds Arias not guilty of burglary, then there was no murder. If Nurmi had succeeded in getting the felony murder charge thrown out, it would have more opened the door for the jury to arrive at a second-degree murder conviction and keep Arias off death row
    I don't believe Juan used the exact term trespassing but he from my recollection said that after the first stab wound, Jodi was not a welcome guest. You can deduce what you want from that but I don't think Metis is too far off saying that term. If someone comes on your property and is not welcome, I believe they are trespassing IMO...

    Under the AZ revised statutes, Title 13 Criminal Code, 13-1104: 2nd Degree Murder is intentionally causing the death of another person WITHOUT PREMEDITATION. It is a class 1 felony and carries a sentence of 10 years (min.) to 25 years (max.)

    RE: ALV's book unavailable on Amazon, perhaps she took it down to make it look like she has been selling them like hotcakes and to get people to pre-order the latest version coming out this month. She is now up to 400 reviews, 99.9% panning the book.

    Which is great, it should increase the chance of a 1st degree murder conviction. I am so glad the felony murder charge stayed in. And it would be ironically just if she got the death penalty in part because of a non-existent gun that she insists Travis owned and insists she took from his house when she left. I would love it if her own stupid, lying, idiotic story was the nail in her coffin.

    I can't answer your first question, but Joey Jackson on HLN has stated that premeditation can be formed at anytime. Even seconds before a killing.

    I think section 2 and 2B applies... pointing a gun at someone is an illegal act. and she used lethal force against a non-lryahl threat.

    I thought it had been established she was the original one. She was taken off before the airline tickets had been printed.

    Not if you watched the hearings, JM is quite clear and never mentioned trespassing. Burglary and trepassing are two sep crimes on the books, not a matter of symantics.

    Nurmi tried previously under the first judge to get the burglary [felony] removed [back under the other judge iirc.] It was denied so burglary is no doubt JMs strong one. Trespaasing could wind up a misdemearor, and then it would all fall apart. DA needed felonies to support a felony murder. Regardless, we've not seen trespassing anywhere in this case.

    The fact (as she states) is she ran down the hall, retrieved the gun from the closet before going back into the bathroom. Sounds premeditated according to her words.

    The radial artery is a lot smaller artery and it would bleed alot and probably squirt with every heartbeat. The radial artery is alot smaller. When his neck was slashed, more than likely he had already lost a large amount of his total blood volume, making his blood pressure a lot lower. The amount of blood remaining would have bled out much faster than from a smaller artery (like your radial artery)but I doubt his blood pressure would have been high enough to produce much of a squirting effect.

    Freethinker, thats what I always thought. She could have just kept going right out the front door, it's not like he would have followed her outside buck nekkid. Also the time it took to go into the closet to get the gun to defend herself, rifle through the stack of clothes it was hidden under on the shelf. Make sure to straighten the mussed stack of said clothes, yada yada yada..that all would have given her plenty of time to reflect dontcha think. She could have even held the gun on him and backed out saying, I don't wanna shoot..

    While Sandra Arias could not be reached for comment, Bill Arias, Jodi's father, denied that the family has worked out any sort of arrangement with McGraw or taken anything from him.
