I'm curious if I watched a different trial to some other people here. What Martinez was doing hardly constitutes to screaming or even yelling in my book. He wasn't going psycho or crazy or acting like a raving lunatic. If that's what you really think I'd hate for you to ever meet a real crazy

I've wondered the same thing. It doesn't read like screaming to me either, or out of control in any way, but some people are more sensitive to that sort of thing than others.

Example: Where I live now, people are very laid back, and my communication style is sometimes seen as too direct. I now try and keep this in mind when dealing with people from this region. One time, a few years back, I went to the movie with a friend who was from this area, and another friend of mine who was visiting from NYC. While waiting in line, the NYC friend and I were discussing a topic from the news, and having what I would call a lively discussion about it. After the movie was over and we parted ways, my local friend told me how upset she was, because I had been screaming so hatefully at my NYC friend, and he screamed back. She found it upsetting and said I needed to call him right away and apologize because it was all so horrible. I was surprised, and that was not how I remembered it, but I certainly did not want to insult a friend, so I called him, and said "Hey, I'm sorry if I upset you earlier", and he was like "Huh?? When?".... "when I was yelling"..... "huh? when were you yelling? wtf are you talking about?. So obviously, what both my NYC friend and I saw as a lively discussion, my local friend saw as horrible, vicious, yelling and fighting.

Nobody was right or wrong, people just have different perceptions.

With the direct exam, they get to take the conversations all over the place. When he takes over, it's a different ball game. They do seem to learn that he plays hardball pretty quickly, though!!

Its interesting that Alyce and Samuels use the same level of resistance and terminology to impede Martinez. This says to me it is defense tactics/strategy to disarm Martinez. The laughing and cracking up by the court room was really only JA supporters and the mitigation specialist. The outburst seemed coached as well. If I didn't know any better I would think this tactic belongs to Wilmont as it feels like female bullying. You know how that goes, one female does the taunting and the gaggle of other females stand around. The real bully is ready to stab you in the back.

Did WT ever post that list? I couldn't find it. Breach of Trust made a very good point. The word domestic means pertaining to the home. Travis and Jodi never co-habituated. I think they only lived in the same state for a few months. They were hardly ever anything more than a long distance girlfriend/boyfriend. The few months they were in an official relationship Jodi lived in Desert Palms and Travis lived in Mesa. It's really stretching it calling it domestic violence.

Completely agree with all of this. I started looking around the rest of MDS about a month ago and it's ridiculous how much this thread is being shitted upon. It's become a whole new topic for Sr. MDSers to talk shit on all that post here. (I'm surprised they haven't created their own separate thread for it.) And to talk shit on people who don't have time to venture out and participate in other threads?? Sorry, but I simply don't have time for it. I barely have time for this thread and since I am so tied to this trial, my time will be spend in this thread. I've kinda' come to the conclusion that those that talk shit are those people that talk shit in the real world just to make themselves feel better. I know I'm sounding like a bitch, but I just don't have tolerance for all of that. And it makes no sense to complain about the stuff they complain about. I don't get the JM is a dreamboat bit, but to each their own. I am a Keith Partridge kinda girl ...dating myself big time..I believe JA will be convicted of murder 1 and should be. I just don't like JM style. I live in NYC and am used to loud. I can be kinda loud too. He just is over the top for me. Unless I have a couple vodka and sodas in me, I have to turn the volume down. Nah, Martinez asks do you have a problem with your memory in just about every trial. The defense knows this and tried to head JM at the pass. If you were the defense attorney you would make it your business to know how JM does things. Showing resistance by asking the prosecutor if he is angry is a tactic IMHO. Though I have to say, Alyce asking if JM wanted the truth was a serious zinger.

I know if I were on that stand in a professional capacity, there is no fucking way I am going to let Martinez or any other attorney stand there and SCREAM at me during questioning. I'd have shot back a lot worse than what LaViolette did insinuating possibly a little short man syndrome causing that misdirected anger of his...or I'd end up being cited for contempt because I'd refuse to answer him until he ratcheted down the volume of that shit.

I would do neither. I would answer the questions as calmly as I could, injecting as little emotion into it as possible.

As for whether or not you should behave as you've said; damn right, you're a professional. So you should act like a fucking professional. Suck it up and answer the tough questions. ALV's job isn't to sass the opposing party; it's to make sure she gives her best information to the jury in order to save Jodi's life. The trial isn't about her and her compulsive dislike of anything that has a cock and balls.

In fact, her behavior could be a problem if the jury seems to like Juan Martinez. If she's too rude and difficult towards the prosecutor, she may well lose any credibility she has.

I agree. I went to observe a trial for work once, and the expert witness was difficult, rude and belligerent (worse than Alyce). I came away thinking, what a nutter!
