KARLITA Here's the post I put up immediately after what I presently consider the game changing moment for me. I won't bore you but I have a bit of an academic background in Drama, and this has the elements of some of the greatest climactic moments I have ever witnessed on the stage. Hope it speaks for itself. I am not insensitive to the fear and pity engendered by the horror scenes of Travis's murder, but when we talk of the 'game-changing' moment, this is the one for me. The perfect climax! If you want to ask me more, go ahead.

They do sometimes refund cash if it is a debit card, at least my Walmart has. They ALWAYS mark through the item to show that it was returned. Nowadays they actually take your id as well and notate it in the computer with the receipt number. I also saw in a post 1,000 or so pages back someone said that they do not take Kerosene cans back. IDK if that is true or not.

Why would one need to "grapple" with these questions? Nobody makes someone a killer, you either have that in you or you don't. Circumstances and what happens in your life don't lead you to become something, they just add to the reasons that justify your actions.

I think only your first post gets stuck in moderation. Don't worry about it.

It's funny, the Jodi supporters complain about Travis' family, and want them thrown out. If anyone does anything that can interfere with the verdict, she can charge them with contempt of court. This judge has been so lenient most of the time, at least it shows shes impartial, which is most important in being a judge. Mostly I see them laughing, it is during sidebars.

Some regular spectators have been asked to leave, cell phones going off and such.

I am very curious now of the taped sex call. Someone is coming out saying it was a deliberate call Arais ( I really have a very difficult time calling her Jody) made as the initiation in her plot to murder Travis. I have missed some of the details on why this is now being brought out.

OH! And an attorney did say tonight, the way Martinez is calling her out on all her lies - well, it landed one of the woman on death row with the same technique. Course, we know it is a different jury. I feel the jury really wants to believe her. Possibly because she does not look like a killer.

Is doing it this way averting a Discovery violation? Do the Discovery rules treat information the same as tangible evidence, i.e. exhibits, witness statements, etc.?

I do not think so as it came out in cross, so it would be rebuttal, and I think you can add stuff based on testimony... I understand that filing motions is discussed first then filed, so I am sure defense and court knew it was on the way...

Hi, Denn, Jodi actually bought a kerosene can initially. In the receipt, I believe it says KERO or something. Those are blue cans. Gas cans are red. There was a discussion about this many pages ago because I was curious if one could use a kerosene can for gas. It's possible Jodi didn't know the difference when she bought the can, or Walmart was out of gas cans and only had kerosene cans.

Where will we ever see a better example of Poetic Justice, than if Mr. Martinez demonstrates that Jodi Ann Arias, despite the fact that she has had almost five years to devise and perfect all of her fabrications about the life and death of Travis Alexander and then launch them into the world with her accomplished rhetoric and exceptional memory, she is going to Death Row because she lies about gas cans. So, she bought a gas can and kerosene? Or a kerosene thinking it was a gas can. Because if so, why would Martinez ask about a gas can?

Felony murder is first degree murder in AZ. JM is going for premeditated and/or felony murder.
The gun is important to the felony, she either stole the gun from her grandfather or she stole it from Travis. Did you hear Martinez say that after the first stab wound, Jodi was no longer an invited guest, but she was now involved in burglary? Felony murder is a murder committed during the course of a felony. Look it up, it gets interesting.

That is extremely interesting regarding the various ways states stage convictions.

How does this sound? Maybe it was just very clever strategy on the part of the Police and Martinez. Let's say the police investigators got the information from WalMart and Tesoro, but planned to not request copies of the records until after Martinez dropped his bombshell in Court. Is investigative knowledge something that has to be shared in discovery? Or is it just the documented proof? Martinez had those bank statements with the Debit charge of $19.64 but he did not directly connect that transaction to the purchase of gasoline. All he did was some on-the-spot arithmetic showing that $19.64 divided by $3.859 per gal. = 5.09 gallons of gas. Now he's going to prove it with the vendor's copy of the transaction receipt. Maybe he just wanted to lay the trap for Jodi, which he did, and come up with the receipts from Tesoro and WalMart after she had an opportunity to screw herself up from the stand.

My game changing moment was that point in the trial. I posted about it earlier, so I won't repeat myself.

Ian, I read here all the time and post now and then. Most of my time is spent trying to catch up with all the pages at the end of the day. I am thinking that Martinez started to do some math, after one of the jurors asked specifically about the volume of gas...it was a very mathematical question. Maybe that got him to start re-thinking the gas and the cans. Just a thought.
