I don't know. I don't know enough about the discovery rules in AZ. He had no way of knowing of what she would testify to under oath though and no way of knowing if she would stay wedded to her story of returning the gas can until recross.

How does this sound? Maybe it was just very clever strategy on the part of the Police and Martinez. Let's say the police investigators got the information from WalMart and Tesoro, but planned to not request copies of the records until after Martinez dropped his bombshell in Court. Is investigative knowledge something that has to be shared in discovery? Or is it just the documented proof? Martinez had those bank statements with the Debit charge of $19.64 but he did not directly connect that transaction to the purchase of gasoline. All he did was some on-the-spot arithmetic showing that $19.64 divided by $3.859 per gal. = 5.09 gallons of gas. Now he's going to prove it with the vendor's copy of the transaction receipt. Maybe he just wanted to lay the trap for Jodi, which he did, and come up with the receipts from Tesoro and WalMart after she had an opportunity to screw herself up from the stand.

My game changing moment was that point in the trial. I posted about it earlier, so I won't repeat myself.

Suppose they couldn't cobble together the exact list of chips, sodas and sunflower seeds to total $19.64. and forgot the convenience store counter closed at 1 a.m. Perhaps they'll claim she dropped the hose and the 5.09 gals. was spillage and she was in such 'mortal terror' at the prospect of being immolated by a 'highly falammable substance' that her 'fog' overtook her once again and she fled the scene, shaking like a chihuahua with her brain frozen like a laptop. You can't put out a fire with a gun and a knife. What ingenuity! She may be done.

I'm thinking of the diary entry from Jodi where she tried to say it was Travis' claimed (by Jodi) pedophila that made her sad vs her testimony that states that she didn't KNOW about the claimed (by Jodi) pedophilia until nearly a year later.

Pointing this out would show another case of blatent lying (as the gas cans) to the jury. I'm hoping it does come up only because I'd love to see what she can scheme together for a reply. This, and why Travis was allowed to write 'bad' things in his public blog, but she couldn't in her private diary....

Apparently this was a Big Thing back in 2007-2008, which I totally missed. He also watched 2 similar videos, one was a faster version of this one and the other was of drunk people dancing to the song with boxes on their heads (remember Jodi talking about him showing her a silly video of people dancing with boxes on their heads?)

Anyway I thought it was kinda eerie getting a glimpse of his last hours and endearing that he liked that kind of silly stuff, and sad too.

and if she doesn't get the DP will you feel like your team lost? Of course she should pay for her crime but I'm not the judge nor the jury ,I wouldn't want those shoes...Alot of people have alot of different ideas of what "justice" should be in this case.

Personally I couldn't care less whether she receives DP or LWOP. However, potential jurors are polled on their pro/against stance on the DP, so 'technically' it shouldn't be an issue for them come the sentencing phase. I realise there's room for error there, just sayin' a potential juror has a cop out right at the beginning.

Thanks guys. We did the Spring forward bit too at school, Ian1, but DST begins at 2.00am on the last Sunday in March in most of Europe. So 'till the end of March, it's business as usual over here then, not sure why I was getting so confused, maybe i go into a fog.

That question and the timing of the question about the filling up of three gas cans in Salt Lake City was elegant and inspired. It demonstrated the Art of Lawyering in it's highest form. It certainly had the desired effect. It revealed how the laser-beam purity of one simple truth can penetrate a murky swamp of lies. It gave all of us a euphoric rush and had the desired effect on the lying, soul-destroying skank in the witness box.

KARLITA Here's the post I put up immediately after what I presently consider the game changing moment for me. I won't bore you but I have a bit of an academic background in Drama, and this has the elements of some of the greatest climactic moments I have ever witnessed on the stage. Thank you Ian, I tend to agree with most of your posts also. I think I misread about the trial game changer to be something other than the gas can scene. After you responded I went back and reread your post and I think I must have misunderstood not realizing it was about the gas. I loved that moment in the trial and I do agree it was a game changer and I think we have much more to come. The prosecution has really just begun in my opinion. I would very much like to read your original post discussed above if you are able to locate it.
