    The burden of proof would be on her to show that at the exact moment of the murder she did not know right from wrong. This is very difficult to prove. Moreover, if she did prove it, the best she could get is a verdict of "guilty but insane." In Arizona, she would be committed by the court to a mental institution for the criminally insane, and if and when she were released she would have to go directly to a regular prison for the rest of her life.

    It would not work out for her the same way it did for Mary Winkler.

    Frankly, I kind of hope that's what happens. Death and regular prison is too good for her, in my opinion.

    No offense but you sound like you want to slant the def theory 'snapped' when there isn't one thing to suggest she 'just snapped'.
    She had a week from the time she stole the gun, hundreds of miles and many hours to turn the car around.
    Murder doesn't mean any breaking point is needed. Some people have one, and others are just cold blooded killers.

    More reasonable imo would be that the bullet got kicked there when the roommates or cops went through. The blood would have been dry and tada, sit on top of the blood crust just like it is.
    The prosecutor has pointed out many times, it is just sitting on top. If it had been there in wet blood, at any time, especially that deep puddle of blood, it should have not been just sititng on top.

    That ME is questionable. Any ME that is slicing "liquid" brains is full of shit in my book.

    It was never proven she stole the gun. Neither the stolen gun nor the murder weapon have ever been found. Legally, there's no such proof. Sure she drove hundreds of miles, so what happened after she got there? Perhaps nothing, perhaps she's just a cold blooded murderer. But maybe not. If those answers were obvious there would be no need for trials.

    ETA: Bundy was a serial killer. There was no breaking point.

    thanks, unfortunately it's a big club we were forced into.
    Funny part for me is I never felt anger. After I was done with the legal, burial, supporting everyone else aspects, I fell right into sobbing grief.
    Only time I felt anger is when he murdered again after his light sentence let him out. Now he just got out again! He's old but .. doesn't take much strength to blow someone's head off.

    i am so sorry to - its hard enuff to lose some one you love - but then to have to go thru the horrors of a trial is just beyond what some one should have to endure - or an over burdened police dept that doesn't follow up on leads and don't find the killer until the prisoners tell all the guards that an inmate is boasting about it while he is in prison for a theft charge - but i digress........ but i do know how you feel

    Trial isn't a 'need' it is a RIGHT according to our constitution. They could have a movie film of the murder, she'd still lie, deny and scream I want a trial. She has nothing to lose and a lot of attention to gloat about.
    She wanted a plea deal, they turned her down.

    Not all things have to be in black and white proof. That is exactly why our laws address circumstantial evidence.
    Many things require one to have common sense to connect the dots. Gun stolen, gun used, same caliber ... not rocket science.

    Honest question, no judging... How many of you could be a defense atty? A public defender? Either as a stepping stone in your career or for the paycheck or because you believe in the justice system... Whatever. How many of you could do it for a living?

    Some people are truly innocent and deserve a day in court. But others.... Its so damn obvious they are guilty--- but you still have to give them your best. Could you do it? WOULD you?

    i don't think i could unless it was for something like the justice project for ppl who were legitimately railroaded - though i am getting ready to volunteer to be trained to be a court advocate for foster kids

    The man had a bullet in his head, and there was a bullet casing on the floor close to his corpse. The type of bullet is consistent with the gun that was stolen. There were four guns in the house that the burglar could have taken, but only one was taken -- the one that happens to be consistent with the bullet found in the man's head. More importantly, there were several items of large value that this supposed burglar didn't take. Even before the murder, the police were suspicious of the burglary in California, and they noted it in their report.

    That bullet came from a gun, and that gun came from somewhere. If she legally purchased a .25 handgun, there would be a record of it. No such records exist.

    Are you suggesting that she stabbed Travis 29 times, slashed his throat, and then the ninjas came in and shot his corpse?

    I could definitely be a prosecutor, no problem. I'd be a damned good one too. As for defense attorney - I could do it if I could pick and choose my cases. I could never defend a Jodi Arias, and I could never revictimize a victim. It's all too close to home for me. So yeah, I'd probably be a pretty crappy defense attorney.

    I'd rather be a prosecutor any day. I could only do the defense angle if I truly believed my client was innocent.

    If she "borrowed" it, then it's felony possession of a firearm in Travis' home, which is burglary, which makes his death felony murder, which again is first degree murder and trumps any justification defense.
    Thank goodness the judge is going to give jury instructions. It's 100% impossible for her to be found not guilty unless the jury completely disregards the judge.
