    What confuses me is from an earlier article posted back some.
    He told police Kyle liked to watch pornographic movies which featured people being spanked. Police interviewed some of Kyle Parker's other friends, who said he liked pornographic videos with sadistic and masochistic themes, and that Kyle Parker was attracted to younger girls 12 to 14 years old, something Parker denied when he was being questioned by police late

    I was wondering that too, Berm. And knowing that is wrong, why didn't someone do something about it? I guess there really isn't anything to do ~ but clearly his friend (the uncle of the little girl) should have known. The family situation was so effed up.

    I am really worried about his niece. These sickos just don't rape and murder a baby without other inappropriate behavior being exhibited beforehand. I hope he wasn't molesting his niece. This is really bothering me.

    I thought that was weird too. And if you know he likes kids, why would you let him around your kids?

    I've read elsewhere that the father and the fathers brother are MR/DD but I don't know how true that is.

    This case has definitely gotten to me. I can't stop thinking about that poor little girl

    Yeah I'd like to know too. I don't care if you're my best friend, a family member or who the hell you are, if I find out you're into children or child porn, your ass is getting reported. Also if the brother thought he saw a foot when Kyle left, he shouldn't have just went to bed. And if they were drinking whiskey, they shouldn't have been so cool with him leaving and driving. Like I said before, I side eye everyone in the house. Sounds like the whole night was set up to be a tragedy in one way or another.

    A prosecutor?s decision on whether to seek the death penalty against a man charged with abducting and killing a 1-year-old Indiana girl will come at a time when legal experts say fewer executions are being sought in the state with the high cost and long court appeals of such cases.

    Twenty-two-year-old Kyle Parker of Spencer faces charges of murder, rape and kidnapping in the death of Shaylyn Ammerman, whose body was found following two days of intensive searching after she was reported missing from her father?s home.

    The allegations against Parker include several factors that qualify for the death penalty under Indiana law ? including committing a murder along with child molesting, kidnapping or rape and the victim being younger than 12.

    A decision on seeking the death penalty often rests on the cost and on the possibility that appeals through state and federal courts can last 15 or 20 years, said Jody Madeira, an Indiana University law professor who studies the death penalty.

    ?Families may want the death penalty, but then, they are tied to the crime and the defendant for a very long time,? Madeira told The (Bloomington) Herald-Times. ?And some say they want him to go away forever and never hear from him again.?

    Owen County Prosecutor Don VanDerMoere said after Parker?s initial hearing Monday that he might take weeks considering whether to seek the death penalty or life without parole against Parker.

    ?At this point, we?re not going to make an emotional decision,? he said.

    Parker pleaded not guilty to the charges during Monday?s hearing. His public defender, Jacob Fish, hasn?t returned telephone messages seeking comment.

    Authorities say Parker drank whiskey with the girl?s uncle and then waited until the family fell asleep inside the Spencer home before abducting the toddler in the early morning hours of March 23. According to the charging documents, Parker directed police the next day to where her body was found in a remote, wooded site outside the nearby town of Gosport, about 40 miles southwest of Indianapolis.

    The average number of death penalty cases filed per year in Indiana has dropped from more than 25 to fewer than two over the past decade, said Paula Sites of the Indiana Public Defender Council.

    Parker?s attorney will likely request a mental health evaluation, but use of an insanity defense requires doctors determining that the defendant wasn?t capable of knowing that what he was doing was wrong, said Jack Crawford, an Indianapolis defense attorney and former Lake County prosecutor not involved in the case.

    But a detective?s probable-cause affidavit describes actions like Parker pouring bleach on the child and hiding her body.

    Shaylyn?s grandmother, Tamara Morgan, called the attack ?total evil torture? and said she wanted the maximum punishment.

    Records sealed in case of man accused of killing Shaylyn Ammerman

    A judge has ordered certain records sealed in the case of an Indiana man accused of abducting and killing a 1-year-old girl.

    Court records show Owen Circuit Court Judge Lori Thatcher Quillen granted the order sealing the records from last week?s unscheduled hearing after Kyle Parker?s public defender and prosecutors agreed they should not be made public.

    Security issues regarding the detention of the 22-year-old Spencer man were discussed during the hearing, The (Bloomington) Herald-Times reported

    Parker is charged with murder, rape and kidnapping the death of Shaylyn Ammerman, whose body was found last month after she was reported missing from her father?s home in rural south-central Indiana.

    Authorities say Parker drank whiskey with the girl?s uncle and then waited until the family fell asleep before abducting the toddler. Her body was found in a remote, wooded area after two days of searching.

    Quillen said Thursday she cannot discuss the case with the media and directed all questions to county prosecutors

    A message left Friday for Owen County Prosecutor Don VanDerMoere seeking comment was not immediately returned.

    Parker is being held without bond at the county jail. A plea of not guilty was entered on his behalf at his initial court hearing.

    On April 7, Quillen granted a request by Parker?s public defender for his client to undergo a psychological evaluation and authorized police to transfer him to the Indiana Department of Correction ?for assessment and classification.?

    A Muncie-based psychologist who examines defendants to determine their competence was contacted to assess Parker, but DOC spokesman Doug Garrison said those plans apparently changed and Parker was not transferred for the evaluation.

    Owen County Sheriff Sam said Parker has been under close watch by jail staff amid concerns he might harm himself.

    I'm a Christian, and I agree with you. I hate it when people say that. Not to mention that angels and humans are two different things. Humans don't become angels when they die. According to Christianity, angels are lower in the pecking order than humans.

    I'm not a big fan of people saying that. I think that sometimes bad people do bad things and unfortunately that's just what it is. Not God's plan, not God wanting an angel, just a bad man doing a horrific thing to an innocent child.

    There is book on this topic - When Bad Things Happen to Good People- it basically argues against all the common religious rationalizations that are used- such as "God needed an angel" - when horrific things happen.

    Under the plea agreement, Parker would agree to plead guilty to first-degree murder and kidnapping. All additional charges against Parker would be dismissed, including rape, child molesting, strangulation, aggravated battery, obstruction of justice, and failure to report a dead body.
    Let's hope he never ever gets out. I am disgusted that he will not have to register as a sex offender.

    The Owen County man arrested last spring in connection with the rape and murder of 1-year-old Shaylyn Ammerman has pleaded guilty to the crimes.

    Owen County Circuit Court officials confirmed that Kyle Joseph Parker, 23, appeared in court Friday and provided factual basis to plead guilty to one count of murder and one count of kidnapping. The judge has taken Parker's plea under advisement, and a sentencing hearing in the case has been scheduled for the morning of Feb. 27.

    Parker was originally facing a total of eight criminal charges. In addition to murder and kidnapping, Parker was charged with failure to report a dead body, obstruction of justice, strangulation, aggravated battery, child molesting and rape.

    Court Documents say that Parker was up drinking alcohol with Shaylyn's uncle on the night of March 23. After the family fell asleep, he took Shaylyn from her bed and began driving to nearby Gosport where he raped her, smothered her and left her behind.

    Her body was discovered by police near a downed tree the next night.


    Parker initially denied having anything to do with the child's death. He told police that the girl's uncle had found her unresponsive at the home and that they had driven to Gosport together to get rid of Shaylyn's body, court documents said.


    Parker later revealed that he had taken Shaylyn from the family's home and driven her to Gosport, where he raped and smothered her, court documents said. He also admitted to trying to destroy evidence that might connect him to the girl's death, including burning her owl-print onesie and purple pacifier.

    Dr. Donna Stewart, who specializes in pediatric autopsies with sexual battery and molestation, said after Shaylyn's autopsy that it was the "worst case of sexual trauma" she had seen in her career.

    After the charges were filed, Owen County prosecutors began seeking life without parole for Parker. Last fall, Owen County Prosecutor Donald VanDerMoere filed a motion to add aggravating circumstances to the charges against Parker.

    In the filing, aggravating circumstances are: killing the victim while attempting or committing child molesting, killing the victim while attempting or committing kidnapping, killing the victim while attempting or committing rape, killing a child younger than 12 years of age and killing while mutilating or torturing the victim.

    VanDerMoere previously told IndyStar that if Parker was found guilty of murder, he will have to prove one or more of the aggravating circumstances outlined in the filing for Parker to receive the life sentence. It is unclear if officials are still seeking the life sentence in light of the guilty plea.

    SPENCER, Ind. -- It took only 45 minutes from start to finish for an Owen County judge to hear, and then rule, on a plea agreement for the man accused of murdering 1-year-old Shaylyn Ammerman last spring.

    Owen County Prosecutor Don VanDerMoere explained that the deal -- which would see Kyle Parker sentenced to 60 years in prison, but not registered as a sex offender -- was "not what I wanted," but was the best possible outcome, due to problems with evidence and witnesses that could have threatened the case in front of a jury.


    Before Judge Lori Thatcher Quillen ruled, VanDerMoere called two witnesses to give impact statements: Shaylyn's parents, Jessica Stewart and Justin Ammerman.

    Parker's defense attorney Jacob Fish called only one witness: Parker's own mother, Christine Patton.

    Parker himself did not make a statement.

    "You took my loving, sweet and beautiful daughter away from me, her brother, her dad and everyone who loves her. I hope you live with your guilt and it torments you for the rest of your life."

    "My name is Jessica Stewart, I am the mother of Shaylyn, the beautiful, smiling 14-month-old baby who was taken from us in a brutal and senseless way. Writing this feels surreal, like the last year has been a bad dream I can't up from, but it isn't a bad dream. This is now my reality.

    A year ago, I was able to hug, kiss, feed, talk to and dance with my beautiful girl. It's hard to believe that so much can change in just one year. There's not a day that goes by or a minute that passes that I don't miss her and would give anything to hold her again but I can't, I'll never get that chance again. Shaylyn will never get the chance to start running, talking, start school, lose her first tooth, have her first crush, graduate, get married or have kids. At 14 ? months old, her life was cut short tragically and in the most horrific way I could ever imagine. I still get images in my head of what all might have happened that night, wondering if she was crying for me to save her. I talk to her every day and tell her that I wish I wouldn't known, I wouldn't kept her home where she was ALWAYS safe with her brothers and I, I'm sorry I wasn't there to save her and I would trade places with her in a heartbeat if I could so she could have her life back.

    Shaylyn is my only girl and her two older brothers looked out for her. Now they're scared that someone might take them like they took baby sissy from us. Her brothers will never know their sister other than by their brief memories with her, and the photos that hang on the walls. They will never get to teach her to play ball, to fish, or to drive a car. Instead, the memories of her now include all the things they wanted to do while she was missing to bring her home. But she never came home, and my boys are still struggling to understand why.

    It's so hard to imagine how someone could be so brutal to such a sweet, beautiful and loving baby girl. She was always so happy and dancing and smiling. I don't understand how or why someone would want to take that beautiful little girl away from this world. She couldn't been anything she wanted when she grew up, why take that little light away?

    I believe the person responsible for the horrific death of my baby girl deserves the maximum penalty, but that is not going to happen. The penalty he is facing now may provide some justice for Shaylyn and keep him from harming anyone else, but there is no penalty that can ever erase the devastation and loss or heal the trauma that has been inflicted on my family, especially her young brothers who have been emotionally, and psychologically harmed by the death of their baby sissy."

    Justin Ammerman, Shaylyn's father:

    "I Justin Ammerman, wish to express my feelings on the plea bargain with Kyle Parker. I am Shaylyn's father. She was my only child; the love of my life. When I found out that she had been murdered I wanted to find the person responsible and kill them. When I heard all the awful things he had done to my daughter, I wanted to die too. I could not believe anyone would want to let someone guilty of murder have a plea bargain.

    Kyle, why did you do this to my baby girl? Please, Kyle, change your plea and admit that you hurt her and left her out in the cold and the bad weather. Please, judge, do the right thing and accept this plea."

    Christine Patton, Kyle Parker's mother:

    Parker's mother said the statement her family gave in March 2016 will be the only public statement they make about the case.

    She asked that vandalism to her home and threats to her family stop.

    SPENCER, Ind. -- The man accused of abducting, raping and murdering a 1-year-old Owen County girl last year will spend decades in prison for the crime -- but will not face life without parole.

    Kyle Parker, 23, reached a deal with prosecutors to enter guilty pleas on one count each of murder and kidnapping for his role in the death of 1-year-old Shaylyn Ammerman in March 2016. Because he didn't plead guilty to a sex offense, Parker won't have to register as a sex offender.


    Shaylyn went missing from her father's home overnight, sparking an intense manhunt. When her body was finally found, apparently dumped miles away near the bank of a river, the small community of Spencer was outraged.


    When police announced Parker, a friend of Shaylyn's family, had been arrested for her murder, many called for prosecutors to seek the death penalty.

    But a plea deal reached earlier this month and accepted Monday by an Owen County judge will spare Parker a capital sentence.

    Instead, he will serve 60 years in prison. With good behavior, that time could eventually drop to 45 years. Parker would be 68 years old by the time he could conceivably first be eligible for release.

    Owen County Prosecutor Don VanDerMoere made it clear he thought the case could be jeopardized in front of a jury because of problems with witnesses, specifically their "multiple, impeachable offenses" and evidence of searches for violent, pornographic images on their electronic devices.


    Murder in a small town

    The charges against Kyle Parker were almost unthinkable.

    For 36 hours, Owen County authorities had mounted a frantic search for 1-year-old Shaylyn Ammerman, who had disappeared from her crib in the early morning hours of March 23, 2016.

    Her father, Justin Ammerman, told police he'd last seen her around 1 or 2 a.m., when he'd kissed her goodnight after an evening of drinking with his brother and a family friend.

    ?Last time I saw Shaylyn was in her bed and I leaned down and I said, ?Daddy loves you? and gave her a kiss and hug good night,'" Ammerman said.

    In her owl-print, zip-up sleeper and Winnie the Pooh blanket, Ammerman thought his only daughter was safe for the night; Shaylyn was too young to get out of her crib on her own.

    A day-and-a-half later ? after her body was found lying near the banks of the White River, miles away, in a rural area near Gosport, Indiana ? police officially declared 1-year-old Shaylyn Ammerman a homicide victim.


    At the time of the announcement, the Ammerman's family friend, Kyle Parker, was already behind bars. He would, in short order, be accused of abducting Shaylyn from her father's home, brutally sexually assaulting her and then strangling her to death.

    According to Parker's stepfather, Mike Patton, the 22-year-old confided in him that he had burned Shaylyn's clothes ? her own-print sleeper and her pacifier ? in an effort to hide his tracks.

    In a probable cause affidavit, Owen County Prosecutors say Parker confessed his role in Shaylyn's death to his stepfather ? who then contacted police with the revelations.

    "Mike [Patton] stated when he spoke to Kyle on 3-24-16 during a smoke break from the interview, Kyle informed him that the police would have the truth once they found Shaylyn's body and the DNA with it," the affidavit says. "Mike stated he knew right then that Kyle had taken Shaylyn and raped and killed her."


    A subsequent autopsy determined Shaylyn had died of asphyxiation ? and that she had numerous, "very apparent injuries" sustained in a sexual assault. Dr. Donna Stewart, who specializes in pediatric autopsies at the Kentucky Medical Examiner's Office in Louisville, told investigators this was "the worst case of sexual trauma" she had seen in her career.


    Facing life in prison ? or even the death penalty ? Parker told his stepfather he intended to kill himself.


    He was placed under suicide watch ? separated from the rest of the jail population in a padded cell. Dressed in a suicide gown, Parker had access only to paperback books and jail staff, who checked in on him every 15 minutes.

    ?We have him under constant camera surveillance and perform 15-minute checks which include talking to and physically seeing him, checking to make sure he is alive and breathing,? Owen County Jail Commander Marjie Ryan said at the time.

    In September 2016, prosecutors announced they would seek life without parole for Parker, then facing charges ranging from child molestation and kidnapping to rape and murder.

    Then, in February, prosecutors indicated they had reached a plea deal with Parker. If accepted, the deal would mean 60 years in prison ? but not life without parole.


    Word of the plea deal came as a surprise to at least one person: Shaylyn's mother, Jessica Stewart.

    "Every day I have images in my head of what that night was like for her, and there is nothing that he could say or do to ever make me forgive him," Stewart said.

    On Monday, before hearing whether the judge would accept the plea deal, Stewart offered only a few words to Parker.

    "You took my loving, sweet and beautiful daughter away from me, her brother, her dad and everyone who loves her," Stewart said. "I hope you live with your guilt and it torments you for the rest of your life."

    Faced with withering criticism after the details of a tentative plea agreement were reported earlier this month, VanDerMoere kept a straight face and kept working.

    It was only at the very end, as he made one final plea to Judge Lori Thatcher Quillen to accept the plea deal he'd reached with Parker, that his composure dropped for a moment.

    Red-faced and seemingly holding back tears, VanDerMoere made this pitch: This deal might not be perfect justice, but it's as close to justice as we'll get.

    "Blame me that we don't have evidence. Blame me that we've got witnesses that are impeachable. But leave that family alone. Send him for 60 years to the department of corrections and let this be done," VanDerMoere said. "Your honor, I ask you to accept the plea deal in this case. It's not what I want, but it's the right thing that has to be done."

    A Troubling Case, a Troubled Case

    By the time investigators found 1-year-old Shaylyn Ammerman's body dumped near the banks of the White River, Kyle Parker was already in custody.

    Parker, a friend of Shaylyn's uncle, Adam Ammerman, had been drinking at her father Justin Ammerman's house into the early morning hours on the night Shaylyn disappeared.

    Adam Ammerman told police that Parker stayed up drinking by himself after the rest of the house had gone to bed.

    Later in the evening, he heard the front door slam, and looked outside to see Parker leaving.

    "Adam stated he saw Kyle Parker walking away from the house and he was carrying something," investigators wrote in a probable cause affidavit. "Adam advised he yelled at Kyle to say goodbye but Kyle would not turn around. Adam informed detectives that he thought he saw a foot dangling from Kyle's side but was not certain so he went back to bed."


    Police quickly narrowed in on Parker as the primary suspect in the case.

    An alleged jailhouse confession to Parker's stepfather, Mike Patton, made that official.

    But beyond that, investigators found themselves on less solid ground.



    Parker gave police multiple, conflicting statements – at times implicating others in Shaylyn's death. Although he reportedly told his father the DNA evidence would point police to him, none of the DNA investigators were able to recover matched Parker's. Parker also reportedly told his stepfather he'd used bleach to try to cover his traces after sexually assaulting the 1-year-old, but police found no bleach on Shaylyn's body or clothing.

    Making matters worse, the primary witnesses in the case had problems of their own.

    Without specifying who he was referring to, VanDerMoere, in a short exchange with Master Trooper Stacy Lee Brown of the Indiana State Police, noted that several witnesses in the case have "a large number of impeachable offenses." At least one of the witnesses had previously been charged with rape.

    Furthermore, a forensic sweep of electronic devices that multiple witnesses had access to turned up online searches for violent, pornographic images.


    To drive home the point, VanDerMoere read a list of search terms found on the devices to Brown:

    "Who's Your Daddy #4?" VanDerMoere said. "How about one with a white female who was bound with a rope and had a gag in her mouth? How about one that said girls want to get punished by strangers? And these search terms weren't associated with Kyle Parker, these are associated with our witnesses, correct?"

    Brown agreed that was correct.

    "How about girls eaten alive? How about girls hanged? Girls snuff?" VanDerMoere said. "Multiple people had access to these computers during the time frame of our investigation, is that correct? And this is all evidence that we can't hide from a jury."

    Brown, again, said that was correct.

    "The only piece of evidence that came back conclusively was related to a third party, not Kyle Parker," VanDerMoere said. "None of that helps our case."

    VanDerMoere said he eventually came to the unwelcome conclusion that the evidence could very well jeopardize the case if it went in front of a jury. He decided, he said, that risk was too much to take.


    "A lot of hay has been made in social media or the news about plea agreements, why they're bad, why they're good," VanDerMoere said. "The fact is, as a prosecutor, I'm responsible for finding the truth. Not what I want it to be. This is an appropriate resolution. It doesn't provide closure for everyone, but it's the best we can do. It's the functional equivalent of a life sentence for Kyle Parker … we have chosen to put him away for the rest of his life, because that's what he deserves."

    Judge Lori Thatcher Quillen appeared to share VanDerMoere's displeasure with the maximum sentence reached in the plea – 60 years – but ultimately accepted its terms.

    In addition to avoiding a life sentence, Parker will only have to register as a violent felon upon release, rather than as a sex offender.

    Quillen spared few words as she announced her decision.

    "The facts of this case were the most gut-wrenching I have ever heard. Your actions were pure evil on that evening," she said. "Many in this community rightfully wanted you to receive the death penalty or life without parole for this crime. What I can legally do as a judge versus what I would like as a parent and member of this community are totally in conflict. It's clear to me, based upon the gruesome facts of this case, that you, Mr. Parker, have no moral compass and no decency."

    With that, she sentenced Parker to 60 years in the Indiana Department of Correction. Because he was convicted of murder, Parker will have to serve at least 75 percent of his sentence. With credit for good behavior, he would get out at the earliest in 45 years – at the age of 68.
