The Gold Coast man accused of murdering a New Zealand tourist is in protective custody after he allegedly told his lawyer he was assaulted by a fellow prison inmate.
Gable Tostee, 28, reportedly has bruises and a laceration on his face after an alleged scuffle.
Mr Tostee was charged with murder after Warriena Wright fell from a 14th storey balcony at Surfers Paradise on August 8.

The release of a damning police affidavit ahead of Monday's bail hearing for accused murderer Gable Tostee has been described as "absolutely worrying" by civil libertarian Terry O'Gorman. On Friday Channel Nine aired details of an alleged transcript from a lengthy audio recording on Mr Tostee's phone, purported to be from August 8 when New Zealand tourist Warriena Wright fell from his 14th floor Gold Coast apartment. This was followed Saturday by a spread from News Corp with a detailed breakdown of conversations, including Mr Tostee saying Ms Wright was lucky to have not been "chucked" from the balcony after a heated exchange.
The audio recording also intimated that Mr Tostee had feared for his own life after Ms Wright became aggressive and tried to hit him with an object. Advertisement With Mr Tostee due to face a Supreme Court bail hearing on Monday, Australian Council for Civil Liberties president Mr O'Gorman said the public release of the affidavit was "an unattractive development" with the ability to skew the course of justice. "There is a view that access to court documents in respect of matters before the court has the potential to prejudice potential jurors at a later date," said Mr O'Gorman.
A criminal defence lawyer for 38 years, Mr O'Gorman said the publishing of the affidavit also took away the ability of the defence to request a suppression of argument, given details were already in the public domain. "The question, therefore, has to be asked...where has the affidavit come from?" said Mr O'Gorman. "Was it supplied to the media by the police?" Aside from the police, court officials and Tostee's own legal team would have access to the documents. Media are also able to apply for court documents, though permission is not always granted.
Mr O'Gorman said he had never seen a bail affidavit in a high-profile case published before a bail hearing since the Fitzgerald Inquiry into police corruption in 1989. He said if it was proven that police had directly supplied certain media outlets with details of the affidavit there should be an investigation by the Crime and Corruption Commission, not the in-house Ethical Standards Command. "It raises an incredibly vexed issue, particularly under this government and police force," he said.
"There seems to have been a change of QPS (Queensland Police Service) policy in regards to exclusives given to news organisations. "If you have senior police deciding who they give scoops to - and who they freeze out - that comes at a price. "The price is that the favoured organisations will be less willing to criticise police. "That is fundamentally wrong." Mr O'Gorman sighted a story run by News Corp last month, also on Mr Tostee, which detailed police allegations under the banner of 'exclusive', and also a Channel 10 series which will see reporters embedded with police.
However officers close to the Mr Tostee investigation were also said to have been furious at the release of the affidavit prior to the bail hearing, but were not willing to speak on the record. Any potential investigation by Ethical Standards would have to commence on Monday, if warranted, when appropriate people return to work

The man accused of murdering New Zealand tourist Warriena Wright was not on his Gold Coast balcony when she fell to her death, a court has heard.
Gable Tostee, 28, was denied bail in the Supreme Court on Monday, although Justice Debra Mullins said the case for murder appeared difficult to prove.
Yet, Justice Mullins said there was a reasonably strong case for manslaughter, which is unlawful killing without intent.
Mr Tostee is accused of killing Ms Wright, 26, only hours after the pair met on the mobile dating app Tinder on August 7. Advertisement Justice Mullins asked Crown Prosecutor Sarah Farnden whether Mr Tostee was on the balcony of his 14th*floor Surfers Paradise apartment when Ms Wright plunged to her death about 2.20am the following morning. "The prosecution case is that the applicant wasn't on the balcony that Ms Wright fell from?" Justice Mullins asked. Ms Farnden replied: "That appears to be the most likely scenario."
New details of the case emerged during the brief bail application and have been detailed in a transcript of an audio recording obained from Mr Tostee's mobile phone. Police allege the pair went to Mr Tostee's Avalon Resort apartment not long after meeting on Tinder. The pair allegedly*drank and had sex, in which Ms Wright was violent towards Mr Tostee. Police allege Mr Tostee tried to stop Ms Wright breathing, before locking her, protesting, on his balcony from where she fell. Justice Mullins said*the case for murder would largely depend on evidence of what occurred immediately before Ms Wright was allegedly locked on the balcony.
"It strikes me that it will be a difficult case for the prosecution in relation to murder if he wasn't on the balcony at the time," she said. "That must depend on what comes out in evidence as to what occurred in the apartment before Ms Wright ran out onto the balcony. It's a reasonably strong case for manslaughter...on the materials that stand at the moment." Ms Farnden said the audio retrieved from Mr Tostee's mobile phone was still being forensically examined. Mr Tostee has been held on remand at the Arthur Gorrie Correctional Centre since August 15, when he was arrested and charged with murdering Ms Wright. He has denied any involvement in Ms Wright's death.
Police opposed his bail during Monday's hearing, arguing there was a risk Mr Tostee would commit further offences if released. However, Mr Tostee will have another chance to apply for bail when his defence lawyers return to court with more information requested by Justice Mullins. Justice Mullins requested more details about Mr Tostee's autism, a condition he was diagnosed with some years ago. "It just struck me that it may not be an irrelevant matter," she said. "The real shape of the crown case is still not clear. There's obviously further investigations in relation to the recording. I'm concerned that [Mr Tostee] seems to have been previously diagnosed as being on the autism spectrum somewhere and that has explained his lack of sociability."
The application was adjourned until a date to be set. Outside court, Mr Tostee's solicitor Michael Purcell echoed Justice Mullins' comments, saying the prosecution's case for murder was weak. "We're heartened by her honour's comments that it appears to be a weak case for murder by the prosecution and that is our position and we feel strongly that that will be borne out in the court process in due course," Mr Purcell told reporters. "My client and his family look forward to the continuing process and we'll be investigating additional material for a further bail application sometime in the weeks to come."
Meanwhile, the release and publication of a police affidavit containing the lengthy audio transcript from Mr Tostee's phone last week, has drawn criticism from police and leading civil libertarian Terry O'Gorman. Documents filed at the Supreme Court trial ahead of Tostee's bail application, revealed that in one section of the recording, sounds of something being hit or thrown could be heard while a male voice complains after being 'beaten up'. Later, the man's voice is heard saying: 'I should never have given you so much to drink. I thought that we were going to have fun. The recording also includes audio from a phone conversation between Tostee and his father, believed to have been made just after Ms Wright fell 14 storeys to her death. The 28-year-old can be heard saying: 'Me and her had sex and it was like, the more that she drank, she just got more violent for some reason. I can't remember what I did but I absolutely did not throw her off my balcony. I would never do anything like that.'
The document claims the recording started at around 1am, the Courier Mail reports. Tostee, 28, has been charged with the murder of Ms Wright, 26, who suffered a fatal fall from the Surfers Paradise balcony in Queensland on August 8.? Police say they decided to arrest Tostee on August 15 after finding the recordings. The documents assert that an fight erupted at around 2.13am. A male tells the woman she is being too rough during sex, according to the police document.
The male voice is also reportedly heard saying, 'I will do what you want, I will be your sex slave.' The woman is told to leave without taking any of her belongings. The man is alleged to have said 'If you try and pull anything, I'll knock you out, I'll knock you the f*** out', the Courier Mail report adds. Police documents claims that the female voice apologises and pleads, 'Just let me go home.' The man allegedly replies: 'I would, but you have been a bad girl.' A phone call is then reportedly made to a lawyer. Police claim that CCTV captures Tostee leaving the building. It is alleged that the Gold Coast man then ordered pizza within an hour of Ms Wright's death.

The defence team for accused balcony killer Gable Tostee has been given more time to prepare a bail application, on the basis their client was previously diagnosed as being on the autism spectrum. Justice Debra Mullins said the diagnosis could have a bearing on how the court viewed what happened inside Tostee’s Gold Coast apartment the night a New Zealand tourist plunged to her death. The court also heard the Gold Coast playboy probably wasn’t on the balcony when Warriena Wright fell.
Tostee, 28, has been in custody since mid-August when he was charged with murder. The pair met via the dating application Tinder. Justice Mullins said although the case for murder appeared difficult to prove, there was a reasonably strong case for manslaughter. She requested more information about the autism diagnosis after reading sworn statements by police, Tostee and Tostee's parents. She said his previous diagnosis of being on the autism spectrum was referenced in the Crown's material, but was not addressed in defence documents.
"It just struck me that it may not be an irrelevant matter," Justice Mullins told Tostee's lawyer. Defence barrister Anthony Kimmins replied that he wasn't sure when Tostee last visited a specialist, and sought more time to find out. The application was adjourned to a date to be fixed.

You know what's weird? As I was reading that, even though I think this guy is a misogynistic piece of shit, I kind of think he didn't push/throw her off. If she was as loopy as she fucking sounded, I could see her either losing her balance, or like you said, trying to climb down.

from stuff i read from him on forums and shit, i'd say he was misogynistic too, but during that conversation he kept asking her if he could make her food or walk her home and offering to let her stay. i think he got the feeling that she was a nutcase once she got aggressive and didn't actually want to have anything to do with her.
i mean, i'm not going to say that i don't think that in the back of his mind he was thinking that if she would just calm down, he wouldn't mind having sex with her again but to me it sounded like he was trying to minimize damage - to him, to his stuff, even to her.
i've known chicks who get a bit bi-polar when they are drinking. i know i have done similar things when i was young, drunk and depressed... running hot and cold, trying to insanely control the situation and thinking it was awesome that i was making a guy feel as uncomfortable as me. it's not hard to play the insanity card and then fall back on being a nice girl when shit stops going your way.
matter of fact, i've probably had that same conversation with a guy, and the result was me, running crying down an unknown neighborhood with my shoes in my hand until friends were able to catch up and herd me home.

It's funny (not really, but it's MDS funny) that that's actually one of the first things she says in the transcript, or at least I think that's what it says: Female: “I am psycho drunk and not to test her.”
Her lawyers are saying she fell because she was afraid for her life...but...I don't know if I buy that. I think she was trying to get away from his apartment, not HIM, necessarily.
The only thing is, it doesn't appear to be a verbatim transcript, which would explain why it seems so disjointed and weird. It's actually a pretty crappy transcript. Not that drugs and/or alcohol wouldn't also have a weird effect on choice of topics, but still.
It's interesting, like blighted said, how the news vs the "alleged" transcript paint such radically different pictures. The articles make it sound like he trapped her and chucked her over the edge. The transcript reads like he was tolerating it and going to just make her go home until she tried to club him in the head or something. Then he got pissed and locked her on the balcony to teach her a lesson, maybe let her back in in a few hours when she was good and humiliated.
I dunno, what stands out to me is where he said, “It is all on recording you know. It is all being recorded." Not really something you remind someone before you kill them.

Like BB said, he had the benefit of knowing he was being recorded & therefore could say anything he liked. He could accuse her of attacking him, make statements about his "injuries" etcetc. It doesn't mean it really happened quite the way he makes out. All it means is that he makes a habit of recording shit to protect himself legally - & he does it because he's been through accusations before - often.
He protects himself by making statements that show him as the victim so the girl has no credibility if she accuses him of shit like forcing her onto a balcony ledge during sex (& he described an incident like that himself on the BB forums & didn't get that he was the one in the wrong) .
Besides, if you read it carefully, it wasn't the supposed violence that upset him so badly he ordered her to get out without getting her clothes & ph, it was her saying the word "vagina" & telling him to stop because she had to take a shit. I'm wondering if maybe he opened the sliding door and pushed her out onto the balcony, and accidently pushed too hard and she fell over? Maybe he really didn't mean to push her over it and kill her, but he was definitely mad and I think planned to lock her out.
It also sounds like he was drunk and possibly on drugs or something, because after when he was talking to his dad he was saying things like he couldn't remember, and he hoped he had imagined it....maybe his memory was fuzzy.
