    A federal judge in South Carolina threw out Alex Murdaugh's civil lawsuit against a former clerk whose jury interference led to his double murder conviction being overturned earlier this year.

    Murdaugh sued former Colleton County clerk Becky Hill, alleging she violated his right to a fair trial over the deaths of his wife and 22-year-old son.

    U.S. District Judge Richard Gergel said the lawsuit -- which sought $600,000 to pay for his legal fees from the trial -- suffered a "fatal flaw" because Murdaugh would have had to pay for his lawyers regardless of Hill's misconduct.

    On Monday, Aug. 10, Murdaugh's defense team filed a motion to dismiss all four criminal indictments against Murdaugh—two murder charges and two related weapons charges — "due to the presentation of perjurious testimony and fabricated evidence to the grand jury, creating a colorable claim of prosecutorial misconduct."

    Murdaugh attorneys state that the grounds for this motion, which they will expound on in a later, supplemental motion, are that the lead S.C. Law Enforcement Division (SLED) agent on the murder investigation, David Owen, "testified that he presented physical evidence directly inculpating the Defendant to the Colleton County Grand Jury that he admitted was false and which defendant has proven was fabricated by law enforcement."

    Murdaugh's attorneys have also accused Owen of presenting false or misleading information to the Grand Jury about ammunition that matched the missing murder weapons.
