Bryan Kohberger’s family members were far more involved in his murder case than previously known.

Both of his parents and his two sisters were included in “most” of the attorney-client discussions before he agreed to a plea deal, Kohberger writes in the affidavit of facts submitted alongside his petition for post-conviction release.

It was during those discussions that Kohberger now says he “was convinced to falsely confess to capital murder, and felony burglary, by coercion, disinformation [and] false promises.”

Kohberger later writes in his affidavit that he “was convinced that actual guilt was not an important factor in considering plea acceptance” and claims that because “death row was imminent” he was “advised to lie” about his guilt.
“[P]etitioner was to gain a legal victory in entering a false plea,” Kohberger writes in reference to how the deal was allegedly presented to him.

That “false plea” spared Kohberger the possibility of a death sentence, something that could very well be on the table again if a judge decides to toss his guilty plea and grant his request for a trial.

Kohberger writes in his affidavit that his family was also present to hear an “elaborate, fabricated story of counsel’s horrific experience touring an actual ‘8x8’ death row cell,” which Kohberger now claims was a “gross misrepresentation” that was used to “induce a plea agreement.”

The petition was filed in Ada County Court on July 27, and it is unclear if any of his family members plan to file affidavits of their own confirming Kohberger’s claims.
