Police recommend criminal charge in drowning of influencer Emilie Kiser's son (3) in May 2025

Police are recommending a criminal charge in the May death of influencer Emilie Kiser's 3-year-old son.

"Following a thorough review of the evidence, investigators have recommended a Class 4 felony charge of child abuse against Brady Kiser," Emilie Kiser's husband, a statement from the Chandler Police Department said.

Prosecutors from the Maricopa County Attorney's Office will now review the recommendation, the statement said.

Trigg Kiser died on May 18 after being pulled from a backyard pool in Chandler, Arizona, six days earlier, police previously confirmed to USA TODAY.

Court documents said Trigg's death was an accidental drowning in the family's pool.

Emilie Kiser, 26, is a social media influencer with more than four million followers on TikTok. She is known for sharing lifestyle and vlog-style content.

Something similar happened to a child. My mother was acquainted with.

At her church, there was a woman who basically free-ranged her toddler.

While she and my mom were working in the church kitchen, this little toddler girl was running around all over the place and getting into everything.

My mom kept telling her that this wasn’t safe, but the child’s mother just shrugged it off.

Then she moved out of state and to an area with lots of inground swimming and that free ranging didn’t go over so well.

Broke my mother‘s heart.

You can’t afford to take your eyes off your children when there is water around.

It’s interesting that the decision to prosecute seems so arbitrary.

Do y’all remember that case years ago, where a woman dropped her three year-old into the African wild dog pit at the zoo and he got eaten?

The prosecutor in her area figured “she has suffered enough.

No jail time. No charge charges.

I wonder what made this one decide that charges needed to be pressed?

Obviously negligence is negligence, but a lot of it depends on whether or not they feel a parent has suffered enough or not.

Free range parenting is dangerous. I completely get the mentality of allowing your child to be who they were meant to be. However, children must have structure and guidance.

Brady Kiser, the husband of parenting influencer Emilie Kiser, will not face charges in his son's drowning in May because there is "no reasonable likelihood of conviction," officials said Friday.

A lawyer for Brady Kiser said he is "grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident."

Maricopa County Attorney Rachel Mitchell said in a statement that on a child abuse charge, prosecutors must prove that the defendant "failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show."

Cases are then evaluated based on whether there is a "reasonable likelihood of conviction," and Mitchell said this case did not meet that standard.

Isn't it a law to have a fence around your pool?

I don't get this. Even if you don't have eyes on the child at all times, if you had a sensor for the door that went into the backyard, you would be alerted. If I had a pool I would have a fence AND a sensor.

Not all states have laws associated with fences around pools, which is scary.

My mom has the most annoying one. It says "front door opened" "patio door openned" but we know when the kids, especially Nev goes out and in.

Emilie Kiser is seeking to block the release of more information surrounding the recommended criminal charges against her husband in the death of their 3-year-old son Trigg.

Kiser’s legal team has moved to remove details from two pages of the Chandler Police Department report about their son’s drowning that reveal why police recommended Kiser’s husband Brady be charged with a class 4 felony of child abuse, said Matthew Kelley, a lawyer representing The Arizona Republic.

According to Kelley, Emile’s legal team’s latest move stems from concerns that, should the police report become public, the details of the case could be used to create “disturbing” content, such as reenactments with artificial intelligence.

"The section of the report Ms. Kiser seeks to redact contains information and context that is critical to provide the public a reasonably full understanding of the investigation of the drowning, the police department's decision to recommend criminal charges and the county attorney's decision not to pursue criminal charges," Kelley said.

Emilie previously filed a lawsuit on May 27 in Arizona Superior Court for Maricopa County seeking to keep records about her son’s death out of public view, stating that the City of Chandler and the Maricopa County Medical Examiner’s Office had received more than 100 requests for access to public records related to the incident.

Same. They are also saying on Reddit that a local fence company offered to put a fence around her pool for free, but she declined because she also wanted them to pay her $70k to put up the fence. Then her kid drowned. She and the husband should both be charged.
