    The man convicted in the 1979 killing of 6-year-old Etan Patz was awarded a new trial Monday as a federal appeals court overturned the guilty verdict in one of the nation’s most notorious missing child cases.

    Pedro Hernandez has been serving 25 years to life in prison since his 2017 conviction.
    The appeals court said the trial judge gave a “clearly wrong” and “manifestly prejudicial” response to a jury note during Hernandez’s 2017 trial — his second. His first trial ended in a jury deadlock in 2015. His lawyers said he was innocent.

    The court ordered Hernandez’s release unless the 64-year-old gets a new trial within “a reasonable period.” The Manhattan district attorney’s office, which prosecuted the case, said it was reviewing the decision.

    New York City prosecutors say they will ask the U.S. Supreme Court to restore a murder conviction in the 1979 disappearance of 6-year-old Etan Patz after an appeals court overturned the verdict in July.

    The Manhattan district attorney’s made the disclosure in a court filing Sunday asking the 2nd U.S. Circuit Court of Appeals to hold off on enforcing its decision in the case of Pedro Hernandez. The former convenience store clerk became a suspect over 30 years after the first grader vanished.

    The ruling presents “substantial legal questions,” prosecutor Stephen Kress wrote. The district attorney’s office has now “committed to seek Supreme Court review,” he said.

    In overturning the conviction, a three-judge 2nd Circuit panel ordered Hernandez freed unless he is retried “within a reasonable period.”

    Kress asked that the appeals court wait until the Supreme Court’s filing deadline of Oct. 20 before sending the case back to a lower-level federal judge to set a retrial date. That could be put on hold indefinitely if the high court agrees to weigh in on the case.

    A notorious 1979 missing-child case is headed to trial a third time after New York prosecutors vowed Tuesday to retry the man whose murder conviction was recently overturned in the disappearance of 6-year-old Etan Patz.

    A new set of prosecutors now will need to bring back witnesses, elicit memories and try to persuade another jury that Pedro Hernandez lured and killed the boy as he walked to his school bus stop in New York City.

    “After thorough review, the district attorney has determined that the available, admissible evidence supports prosecuting” Hernandez on murder and kidnapping charges, Manhattan Assistant District Attorney Sarah Marquez wrote, adding that prosecutors “are prepared to proceed.”
    Hernandez’s lawyers said they were deeply disappointed by prosecutors’ decision.

    “We remain convinced that Mr. Hernandez is an innocent man. But we will be prepared for trial and will present an even stronger defense,” attorneys Harvey Fishbein and Alice Fontier said in a statement.

    Hernandez is due in court Monday for a discussion of next steps. Under federal court rulings, jury selection for his retrial must begin by June 1, or he must be released from prison.

    The U.S. Supreme Court reinstated the murder conviction of the man found guilty of killing 6-year-old Etan Patz on Monday.

    In a 6-3 decision, the justices granted an appeal from Manhattan prosecutors, undoing a lower federal court's ruling that had previously overturned the verdict against Pedro Hernandez. The court's three liberal justices dissented.
