    So I was just listening to Beth Karas say at exactly the same time I was wondering how when making a collect call from jail, JA was able to leave such a LONG voicemail.

    In M1 cases, if the jury comes back w/ death is that just a suggestion for the judge to consider or is that the sentence?

    That is the sentence, although the judge could overturn it if she felt the jury did not follow the law in determining the sentence.

    @summers, I think that if the jury comes back with the DP it's a 'recommendation' to the judge, and technically, she can overrule it, but it's unusual that a judge would do that. At least that's how it works in other states. I hope someone will correct me if I'm wrong.

    All the calls are recorded. The defense filed a motion early on to block JM from accessing her calls/visitor lists. Arizona doesn't have Sunshine Laws so we'll never hear them
