    It wouldn't shock me if Ms Arias didn't get the DP. I can see the premeditation in her actions but it's vague premed. There is no one neon glaring fact.
    Yes her grandparent's gun was allegedly stolen, but no direct proof that she had it.
    Yes, he was stabbed but there is zero proof that she packed a shiv
    Yes, the gas cans, and this to me is the strongest premed factor.
    Added together it all makes sense to us but we have details the jury doesn't and the jury may find her age and sex to be stronger than what we see as premeditation factors.

    The jury has already found her guilty of premeditated murder.
    They now are deciding on life or death due to aggravating and mitigating factors. How much did Travis suffer? Does Jodi have any redeeming qualities? We are to hear from The medical examiner again on the cruelty/suffering. And then from Travis' family and friends as well as Jodi's I assume.

    I'm waiting to see how JM presents Dr Horne's testimony goes before I hazard a guess on how they might vote and what the defense response is. Will Jenny try to go after Horne again and risk further alienating the jury?

    Wednesday testimony will be painful to listen to and graphic in nature. TA suffered 28 stab wounds and then a slit to the throat. He saw her stab him in the back in the reflection in the mirror.

    I thought the state was going for cruelty as the factor for the death penalty. I could be wrong though.

    Angie you are absolutely correct, premeditation will not factor into whether she gets the DP at all. Premed. is what got her convicted of M1.

    Right now we're in the sentencing proceeding of the trial which consists of 2 parts, the aggravation phase and the penalty phase. The judge ruled in 2009 that the state had proven the aggravating circumstance of a crime committed in an 'especially heinous, cruel or depraved manner'. (She ruled against the 'heinous' and 'depraved' prongs saying the state hadn't proved them but they were able to prove cruelty.) So we'll hear from the ME about the blood evidence down the hall and the defensive wounds on Travis's hands proving he was conscious during the stabbing and did suffer.

    The state must prove cruelty beyond a reasonable doubt and the jury must be unanimous in its verdict. Then, assuming the jury finds cruelty applies we go on to the penalty phase where the defense presents whatever mitigating factors they feel are sufficient to call for leniency, i.e. LWOP instead of DP.
