    The same Sheriff Arpaio who refused to allow the "starving" defenDANT to be provided supplemental nutrition, have her lawyers provide her with lunch, who had a deputy come in to argue to the court that he, the Sheriff, was not pleased with security measures in the courtroom regarding the defenDANT. But he allows her to schedule and hold an interview in his jail, minutes after the verdict is handed down? He's a disgrace, and we wouldn't be here now in this predicament save for his idiocy.

    With all this "I want to die bullshit", it's plain to see how Jodi has always operated. When she doesn't like something (Travis leaving her; getting M1) then threaten suicide. Make everyone jump through the "poor Jodi" hoops; validate her pain; stick around until she's ok again; let her have her way. She doesn't want to die. She wants to manipulate everyone until she gets what she wants. Her little wheels are turning in her head while she plans her next round of crap to get out of this. God help the people who have had the misfortune to have been in her life in any way, shape or form. I am seriously getting to the point that I wish she'd have a friggin' heart attack, drop dead and do everyone a huge favor.

    What I find interesting is that there have been no new motions filed by either defense or prosecution in this case. Whatever happened probably means JA went rogue again and even her lawyers didn't know what she was going to do. She did go off on them as heard in the hallway after the verdict yesterday. She is not about to listen to them on anything. This is HER show and she is going to play it out how SHE wants to do it. She is an idiot.

    Yes, they may want to derail the rest of this case by forcing the judge to error. I would not put it past them or Stabby. If they can force the judge to error, they can file for a new trial. I can see them doing this since they have tried about every low down tactic they could think of in this case. Stabby cannot do anything to overturn the underlying juries verdict. BUT, the defense could force an error. I think the judge it too smart for that to happen.

    Faking "incompetence" from a legal standpoint is very difficult. You have to be really, REALLY incompetent before this would become a factor, and Jodi absolutely is not. However, they have to go through the steps of having a professional check her out, just to be sure.

    Here are some examples of what was NOT considered incompetence:

    What Does Not Constitute Substantial Evidence
    Courts have held that each of the following factual situations,
    standing alone, did not present substantial evidence of doubt about defendant's mental competence:

    • Defendant's bizarre actions or statements.
    • Statements of defendant's family that defendant suffered from migraine headaches
    • Defense counsel's statements that defendant was incapable of cooperating in his or her defense. People v Welch, supra, 20 C4th at 742 (disagreement between defense counsel and defendant about which defense to employ did not require court to order competency hearing).
    • Mental health expert's testimony that defendant was immature, dangerous, psychopathic, or homicidal, or similar diagnosis that includes few references to defendant's ability to assist in his or her own defense. 20 C4th at 742. See also People v Hays (1976) 54 CA3d 755, 760, 126 CR 770 (psychiatric reports found defendant depressed and suffering from mild psychosis but expressed no doubt about defendant's mental competence).
