    From what I have read, the prosecution can empanel up to 3 different juries to try and get the DP as a sentence. So, if this jury is unable to come to a unanimous decision, Martinez has 2 more goes at it. If it doesn't happen, then I think the judge decides. I posted something about it in one of the sub-threads, but I'm not thinking clearly enough to recall it right now!

    Yes

    As long as all the jurors voted for one or the other, it could be M1. That was the beauty of adding the felony murder option, just in case.

    So it could have been 11 of one type and 1 of the other, and it still would have been M1.

    I feel bad to a degree but at the same time not bad enough for her to have gone free or of a lesser charge. She truly did do this to herself and yes I feel bad that she was too messed up to be able to just leave the relationship and move on.. that is a hell in and of itself.

    Don't dis the Coconut..he was playing devil's advocate..After the CA trial I was scared to get my hopes up for what I knew the verdict should be. Thankfully we had jurors that were as like minded as most of us in here and they saw through the bullshit.

    Thank you guys, for answering my somewhat dumb question. I had been so focused on the evidence that I wasn't paying much attention to the jury instructions. :p
