I agree..he came off as credible to me, but the fact that he had very limited access to materials and no interviews would make me dismiss his opinions right off the bat.

If Wilmott had questioned him directly about the dura in depos -- since her entire case hinges on the dura -- then he would have corrected it at that time or be judged a liar now.

She failed to do so. He made a mistake.

what i don't get is why the st team is just bringing up the duramater now?? did no one notice it in the report until dr gefner pointed it out?? - or did it come out in discovery a long time ago and thet knew it was a typo and didn't tell geffner??? cuz when i first read the report that was the first thing i saw

Quite simply, the Medical Examiner must get it right. He owes it to the court, the state, and the people. And to Jodi. He works for us. The Prosecutor needs to have one story and stick to it. End of discussion. They are "the good guys". The honest people who seek justice.

Not the careless halfwits who forgot to check their work, and didn't notice a mistake until it became a critical argument in the trial. Now it's a typo, now that it helps the defense? Sloppy work at best, prosecutorial misconduct at best. Possible grounds for appeal.

Can the jury trust someone who does not check his work, makes mistakes, and changes his story to Flores and the court? Today might have been the best day for the defense so far.

I don't understand why with all of the money the defense spent on experts they couldn't find one that could give a straight answer.

What if that blows the whole case for the prosecution? What if their best witness, the ME and his physical evidence, are now unreliable?

You're right, it's not a big deal. I make typos on death row cases all the time. The report says whatever Martinez wants it to say. If the words are wrong, I "mistyped" them.

I should say though, I do believe Dr. Horn, and that the brain was penetrated. There was a hole in the skull, that was caused by the bullet. The bullet then hit something -- inside the skull -- and exited the skull and embedded in the cheek. The xray, the bullet trajectory inside the skull, the hole in the skull, and the "landing" spot of the bullet (in the cheek) -- as well as the lack of blood in the head/face supports the idea (for me) that the shot came last.

Wilmott asked Geffner about the dura mater during his direct exam, which was part of his reasoning that the bullet did not hit the brain tissue, and that is was just a bone injury that would not necessarily incapacitate him.

I think Wilmott wanted to bring up the issue of the dura mater not being penetrated, and had Geffner read from the ME autopsy report. She did not want to talk to Horny about it though, because she did not want to give him a chance to change his story. The jury brought it up and that gave him a chance to make up the typo story. Is he sexier if he's sneaky?

you aren't wrong - of wilmont had caught it b4 when she questioned dr woof, when he had the other part of the report he misstated, then had him read the report about the dura mater, that woulda been boom - perry mason moment and could have really discredited him - but i think wilmont missed it too in the report

Their whole spiel has been "this guy has done 6000 autopsies, THAT is what makes him sooo qualified to declare for sure, 100% certain what TA's brain function would have been after that GSW. My point (and that juror's, it seems) is that doing autopsies does not qualify this guy to make that judgement. No one's been talking about what experience he had in med school or residency.

The Prosecutor is supposed to fight fair. Criminals lie but hero lawyers should do the right thing and win fair and square. Not by sloppy work or dirty tricks.

Would it be even logical or possible for the bullet to have not pierced the dura and somehow end up in Travis's cheek? Wouldn't that mean that the bullet had to skid around the bone and bounce to stop where it did?

I don't know whether the dura mater was a typo or not. But, let's say it wasn't pierced, it still wouldn't matter as far as I can see. The bullet penetrated the skull, "ricocheted" for lack of a better term, and lodged in the cheek.

There was no blood, even from the bullet lodged in the cheek. If that's the case, there was no blood in the face/head, and no hemorrhage. It still supports the idea that the gun shot came last. No blood in the head for the gun shot, which we know penetrated tissue, blood vessels, etc, by entering his cheek. Why no blood? Because it was drained due to the 29 stab wounds and slit throat.

What does any of this have to do with the murder of Travis Alexander??? This whole string of testimony today, proves NOTHING about what happened the day Travis was murdered. It's been a complete waste of time IMO. I'm just glad that it appears that the testimony will in fact, be over tonight.
