    thanks Shell, I've seen it in reading appeals and seen cases remanded back or appeals denied on these issues. It seems it is labeled 'prosecutorial misconduct' if the offense is by the State, and if def does it, they get admonished at the time is about all from my interpretation. Corrections of anything I get wrong are welcome. lol

    Most seem to be.. say that if the prosecutor were to throw out a statement about something not in evidence, the Def must object to preserve the error for appels, or on appeal it appears without objecting, the def thereby had 'waived' right to complain about the error.

    Sad thing is, Jodi is trying to claim that Travis attacked her and made her mind scramble.

    The real truth is that the only person who wasn't able to think or act in a logical way was Travis, because he was the one being attacked. He was the one who was so severely injured. And he is the one who died a tortured, painful death.
    Yes! And that HE was the one who was likely attempting to run down the hallway and flee!

    Mistrust is one thing. Full on frontal attack is another.

    I certainly understand mistrusting an expert who is testifying for the defense. Believe me, I am giving him the side eye too. But I want to see what his testimony is before I make any judgments.

    You should expect more motions from the def, that's their job. It isn't just for trial, but to preserve issues for appeals, standard practices.

    Annie I think it's his side. i.e, they rolled him on his side to take this photograph. The upper part of the photo looks like the fold of his underarm, and to the left, it looks like part of his forearm in the shot. I imagined he had been rolled on his side with his arm bent at the elbow to take the shot. I'm just guessing of course, because I couldn't find an exact match to that blood staining on the chest photo's before they cleaned the body.

    During mitigation (if we get there) the defense will put on all kinds of witnesses about poor abused Stabby and how her art was one day going to one day hang on the walls of art galleries with Van Gogh's and Monet's.

    The State will put on evidence showing her utter lack of remorse, the fact that she lies, lies and then lies some more, and then how her art is really just some jacked up tracings from magazine ads.

    What we can expect in the following week/s.

    FIRST-DEGREE MURDER :

    If the jurors unanimously decide Arias is guilty of first-degree murder, the case would then move to the aggravation phase.

    That is the prosecution's chance to present additional evidence that the death was caused in a cruel manner. Arizona law defines it as when the victim suffers physical pain or mental anguish and the defendant knew or should have known that the victim would suffer.

    The jury would then deliberate for a second time to determine if the aggravating factor of cruelty is proven beyond a reasonable doubt.

    If the jury does not find her guilty of cruelty, the case ends and the judge sets a sentencing date within 30 to 60 days. At the sentencing, the judge decides whether to sentence Arias to natural life in prison or life with parole eligibility after 25 years.

    But if the jury decides cruelty is proven beyond a reasonable doubt, the case moves to the sentencing phase.

    This is the defense's opportunity to ask the jury for leniency and present evidence to support why Arias should be spared the death penalty. Witnesses may include Arias' friends and family. Arias could also make a statement to the jury.

    The jury then deliberates for a third time to determine whether Arias should be sentenced to life or death. Their decision must be unanimous. In the case of a deadlock, a mistrial would be granted and a new jury would be chosen for this phase only.

    If the jury votes for the death penalty, Arias would be sentenced immediately and is likely to be sent to death row within hours. If the jury opts for a life sentence, the judge will set a sentencing date within 30 to 60 days and, at that time, will sentence Arias to natural life or life with eligibility for parole after 25 years.

    SECOND-DEGREE MURDER :

    If the jury rejects first-degree murder but finds her guilty of the lesser charge of second-degree murder, the judge will sentence Arias to no less than 10 years and no more than 22 years in prison.

    Arias will get credit for the time she has been incarcerated awaiting trial.

    Another betrayal. She must feel such rage at everyone in her life. Matt McCartney has now betrayed her again by not testifying for her, her "ally, the only one who would never betray her".

    When the jury comes back with M1 she'll be put on suicide watch, dressed in a paper nightie, no pencils, no safety razors.

    I agree totally, the men and sometimes even her family in her eyes always were at fault for not thinking of her first. It's all a manipulation game with her and when she figures it out that it isn't going to work, she gets pissed. I have to think that she knows the jury isn't getting manipulated by her words on the stand and with the 3 less than stellar defense witnesses so far. I wonder if when she does get sentenced and it is for life or DP, she gets up out of the chair, grabs Nurmi's pen and tries to stab one of them with it and claim ineffective council.

    That is one time even her own words plus her journal show how upset she was. Except her lie trying to say TA welcomed her for a week at his house. I'm pretty sure I remember a friend telling it like TA didn't want her there. She was turning a murder in her mind all the way back to Yreka.
    Be interesting to know who made her give the Futon back, I bet it's someone she's tried to throw dirt at in the trail along the way.

    Sneakers, do you remember seeing the report of police surveillence right before they arrested her? The box of bullets found at her mother's.

    It's not fresh in my mind, but as I am now recollecting, when Arias left Mesa for Yreka at the end of April, it took her three tries. It was on one of them that Travis gave her the bird--like she was never going to get out of there. The first time, I think, was when she wrecked the BMW. So she came back for a few days to torment him. Then she left again in the UHaul, (that was parked around the corner.) Then she came back for another goodbye. The third time is when she finally skedaddled--but not for long. I think that's what happened on June 4. She left, Travis went up to take a shower, she came back and played picture games; saw she wasn't getting anywhere, went into a rage and killed Travis. I don't think Travis consented to the picture taking session. He permitted it. That's my story and I'm sticking to it. Obviously, Arias was obsessed and had a very hard time separating herself from Travis. It was her well-established pattern to use a zillion phony and 'loving reasons' to be or to remain in his presence--totally humiliating herself before she finally snapped. That's called stalking last time I checked.

    No-one here has ever suggested there's ANYTHING that lessens the horror of what she chose to do to Travis & I'm confused that you would think that? I can only assume you missed a page? Everyone involved in discussing other cases of brain injury, particularly Phineas Gage, has said we believe she IS guilty. We bring this up not to prove her innocence but to support the argument that SOMEONE should've used scientific modelling to prevent the possibility of confusion over the issue.

    If posters here have a vague recollection of people being conscious & capable of movement & speech following a penetrating brain injury, then chances are, a juror or two will also. It surely wouldn't have been a difficult thing to have a decisive explanation VISIBLE in court. If we can do it down here for our little hick town trials, surely the prosecution could've managed it for something this high profile?

    Thankyou zeebee, I stupidly assumed it'd be .05, like it is down here, or .08 as I've heard it is some parts. I try not to assume. It usually gives me a good bite when I do. So having said that, my comment was anything BUT fair & I will edit the original, or maybe even delete it, because you're quite right, with laws like that he may not have done anything wrong at all.     I started rewatching a bit of her cross exam. This was priceless. Wish whomever created this had included the part where she says the gun was in a holster. I hope the jury asks for a read back of this.

    Does anyone know if the jury can ask for a read back of the Jury questions and her responses?



    Jury questions and answers are part of the transcript so I would think they could.

    I still say JM missed to highlight for the jury a very important point when she claimed not once (to Flores) but again under oath the only hand gun she's ever seen has a long barrel. Then Ma'am, you didn't find and see a short barrel .25 in Oct 2007!
    Busted but an important bust imo because any point for putting the gun in her hand is a premed point!

    I'll reserve my opinions of this sur-rebuttal witness until Wed. Maybe he's taken into account her many MANY lies and will dx accordingly.
    The best thing he can do for the defense is to say it like it is. If he says she has many disorders, that might garner sympathy towards the defendant. Maybe that's what he's going to do. Say that she has all of these mental disorders and can't help herself. That would be a real twist!

    If the jury votes for the death penalty, Arias would be sentenced immediately and is likely to be sent to death row within hours. If the jury opts for a life sentence, the judge will set a sentencing date within 30 to 60 days and, at that time, will sentence Arias to natural life or life with eligibility for parole after 25 years.

    SECOND-DEGREE MURDER :

    If the jury rejects first-degree murder but finds her guilty of the lesser charge of second-degree murder, the judge will sentence Arias to no less than 10 years and no more than 22 years in prison.

    Arias will get credit for the time she has been incarcerated awaiting trial.

    So in reading the above i understand the jury must be unanimous in their decision to return 1st degree; only a simple majority to decide if the crime was cruel and finally they must be unanimous again to return the DP. Right?

    Just going to say right now that he's going say that Stabby was a poor abused woman who suffers from PTSD not BPD. Gerffner and Alyce are tight. Thick as thieves. Only thing I'm interested in is his cross and many lies it will be revealed that Stabby told him. New lies? Same old lies? A mix of the two?
