    I did not realize they had already asked for that and been denied. I suppose we won't hear about that part until after the guilt phase is complete, but if its been denied before, I don't see a good chance for that getting in.

    Wonder when we'll know if the judge lets a surrebuttal case in. That makes me think there's a chance that Samuels an LaViolette would be back since so far we've only heard from the state's psychologist. Ugh.

    I say, they had their chance. The defense put on a case for 2 and a half months. They had plenty of time to get in what they needed to get in. I hope the judge sees it this way.

    HLN touting is bullshit. Hype to get people suckered in when their ratings had taken a down turn. This is far from big let alone in the world. Most major networks you don't even see any daily or even weekly reporting of it. He won't do a book on this case. IF she's found guilty, there's appeals. It would be inappropriate / unethical for him to do a book will still a prosecutor and her appeals not completed.


    I would expect a nice press conference though, he's done those on other high profile cases.

    The 43-year-old Martinez's own story is inspiring: The seventh of eight children born to illiterate Mexican farmworkers, he immigrated to California when he was 6. He says he resolved as a youngster to learn English: "The people around me who were successful spoke and read English well. You didn't get far if you couldn't do that."
    He managed a drugstore after earning his undergraduate degree, then entered law school. He finished law school at Arizona State University, worked for Community Legal Services helping tenants for a few years, did some defense work, then joined the Maricopa County Attorney's Office in 1988.
    Martinez is almost a foot shorter than Kimerer, and still looks like the distance runner he used to be in the high desert of rural Victorville, California. His high-pitched voice grates at times, and he has a short fuse with adverse witnesses. But he does seem to earn the grudging respect of juries.
    Martinez's forte--he's now unbeaten in 14 murder trials--is his relentless passion for his cases and his attention to detail.
    What complicated this bizarre case even more was the lack of a plausible motive for murder. In most homicide cases, the reason eventually becomes apparent, even though prosecutors legally don't have to provide one.

    But the usual motives--money, jealousy--never emerged in this case, no matter how hard Juan Martinez tried to provide one. A seasoned prosecutor with the courtroom demeanor of an adrenalized boxer, Martinez accused some witnesses of lying to protect Falater. In open court--sometimes with the jury present--he tossed out allegations that made headlines, but often weren't confirmed by testimony or evidence.
    But Martinez conceded nothing. Instead, he argued that Falater had stabbed Yarmila in a rage, then calculatingly drowned her. Falater had committed an almost perfect murder, Martinez told the jury. Unfortunately for Falater, he said, the drowning was committed in full view of a neighbor, Greg Koons.

    Martinez derided the idea that Falater--a product engineer and unit manager at a semiconductor plant--had been stressed out at the time of Yarmila's demise. The prosecutor also alluded to Falater's own admissions that he'd been ingesting No-Doz for about a year, contrary to his Mormon faith's prohibition on caffeine. He pointed out that Falater had cursed during interviews with New Times

    Falater testified that Yarmila was the only person he'd told about his sleep deprivation.

    huh? We didn't only hear from the prosecutions shrink. DEF had their chance with theirs. They were in the Def CIC. Again, Sur-rebuttal is for NEW evidence, limited to ONLY that evidence and NOT ever a second shot to rehash. I can't image what Numbnuts is using for his new evidence or legal argument, probably some case from 1895.

    I don't see but the one time they have asked for surrebuttal. Are you finding this information that they have asked before from some other place other than the Superior Court website? Only reason I am curious is that the defense just rested last week so more than one request would have been documented before they even rested? Makes no sense to me. We all knew they were going to request it, Nurms and Palin are trying to delay at any and all costs. They know what their client did but they are obligated to stay her execution (so to speak).

    Couple comments just on reading a couple pages of the threads: 1) No, stabby is no "artist". she imitates. she wants to be known as this "free spirit". laws of attraction, artist, explores different religions, eco-friendly, blah, ad nauseum. she has some talent, but then anyone who is given pencils and paper can be considered, depending on the judge, "artistical"
    2) I am not a photographer, I like to take pictures. Because I have an expensive camera, taking photos is pretty easy. some look wonderful, from "my point of view". I take lots of family pics when we go on vacation. Difference is I am NOT in EVERY single photo. Stabby LOVES to look at herself, so she takes TONS of pics of mostly herself. My family, when needing a picture (xmas etc) randomly say, Oh, let MOM take it, she is the photographer in the family. I, too, find the media/defense calling stabby a "professional" photographer extremely irritating. Because she takes a boatload of pics doesn't make her a professional. Using an expensive or good quality camera doesn't make her professional. And so, to that point, here is my take on the camera being in the washing machine. Stabby had NO freaking CLUE that forensics would be able to retrieve deleted photos from the memory card. I have taken thousands upon thousands of pictures on my expensive camera, and would assume water would WRECK it. would NOT even occur to me take card. My opinion is that stabby being classified by defense and Alyce as being "too smart" as a professional photographer that she would TAKE the card or the camera is silly.

    yes, in the rebuttal case, we have only heard from 1 witness so far - the prosecution's shrink. Thats what I was referring to. And since the DT has already filed a request for a surrebuttal after only hearing from her, it makes me think they will want to bring ALV or Dr. Dick back for some reason.

    I was wondering though, if the judge were to allow a surrebuttal, I suppose she would have to say that the state gets to go again. I think she should deny the defense's request. For many reasons.

    It's amazing what can be retrieved with the right software. I was talking to a CSR at Data Doctors and he told me they once got information from a hard drive that was submerged in salt water for a couple years. They take the platters out of the hard drive and put it in a new chassis and fire it up. The only way you can make sure that nothing is able to be retrieved is to physically destroy it. Sometimes even fire won't do it.

    There was no Sur-rebuttal before but Nurmi said in the misconduct hearing in Feb he was going to ask for one. IIRC, JSS's expression to that announcement was fun to watch. This was the hearing where the Judge also had to tell Nurmi that he was listing arguments that the court has already ruled on previously. Meaning.. DENIED dummy. LOL I'm not worried. Nurmi must live at a copy center and hasn't figure out that vomiting to the court isn't successful.

    You are kind of implying SUR rebuttal is a second bite at the apple for the Def and that isn't what it is.
    Lets say they are arguing that the dx of BPD is 'new' and they should be allowed to rebut it. Alyce can't, she's not a pyschologist. If the Judge felt the 'new' was cause to allow surrebuttal then most likely you will see a new shrink, not one like Samuels who has basically been discredited. Jury questions alone tell us the jury doesn't buy into Samuels at all. The def would be insane to use him for anything besides wiping JA's butt after she shits.

    I'll see if I can find some appeal decisions that might help make it clearer.

    Yes, it is frighteningly amazing! With complete sincerity I can tell you that if I were to do something totally batshit crazy at this moment, the police would have their hands full! just what I google during the day is cuhrazy (especially since this particular trial started) Can't even imagine the tenacity that has to go into the actual planning of a murder, the cleanup of a murder or the lies made up to cover up the murder! Stabby had one thing against her from the start of all this, she isn't THAT smart, nobody ever is.

    I understand that the sur-rebuttal is for new evidence. I hadn't realized that Nurmi told the judge he was going to file for one (back in February).
    I agree, it would be extremely stupid for the DT to call either ALV or Samuels again. I guess they would have to find someone else? thats what I don't understand. Who else would stand up for JA and try to rebut Dr. Demarte?

    Maybe they just want to preemptively file because they're going to want to rebut other witnesses? I guess I'm just not sure.

    Hard to say without seeing what he filed on. Lets say the worst scenerio, Judge allows it. I'm not worried at all. They can't bring in Lenore Walker lol we know she's not on their side. So whoever they bring in, says oh yes she was abused. Most so called 'abused' experts are exactly like JD said, its not a recognized for licensing area. So again, it's a wash.

    No matter what, they can't get anyone to explain this kind of overkill. The new person would be coming in to a jury that no longer trusts or believes the def with their goofy experts.
    Sad for us addicts it would delay, but I don't think the def can overcome what has already happened. Try to beat this jury over the head with a bigger stick isn't going to cut it if you ask me. Once JM brings in Walmart for premed, I don't see how the hell the def can wiggle out of that.

    That's PTSD as in Post Trial Stress Disorder. Chief symptom: uncontrollable twitching. Triggers: Alyce LaViolette and Richard Samuels, possibly Kirk Nurmi, may be others.

    This new syndrome will appear in the Revised DSM V along with the Fog, Batshit Crazy and Bitch Has Problems.

    I cannot understand why the defense did not file these new motions before the trial began. They just said that the judge may allow another expert in for the defense, and also for the jury to consider heat of passion, when they deliberate.

    I feel if the judge agrees to these motions, the dp is going to be harder to get, which makes me wonder if someone should offer life in prison. Course, the defense is trying to get her off on manslaughter. That is what they have been going for since day one. Alot of the HLN attorney guests have said they are just trying to keep her from death. I think Nurmi had this up his sleeve for a while.
