    This Dilbert hearing with the eye picture is pretty funny. If it gets let in, they are taking a risk that some jurors will see a raised arm and knife in the picture. More importantly, the jury will know that the camera was close to his face and a flash was used, rendering Travis momentarily blinded so Jodi could go for the kill.

    RE Jodi and her twitter, this isn't the first time someone in jail/prison has had people put things up on the internet for them. I've seen blogs before, but this is the first twitter account that I know of.

    The issue here is the double standard that the defense is trying to pull off. They say the prosecutor signing autographs and taking pictures with people is perpetuating a media assassination (which bte JM is not guilty of), but when they talk about JA's twitter account they call it "freedom of speech". Nurmi specifically said that this morning, that the prosecution was attacking her "freedom of speech".

    i think because dt keeps saying so much prosecutorial misconduct w/ jm - claiming he was leaking the interrogation vids, demeaning the witnesses in open court - but jodi is tweeting disparaging comments about the prosecution - kind of a tit for tat - they can't complain about jm when their own client is doing the same thing

    That looks like a dictinct possibility to me. The DT must know that some jurors might see a knife or a gun. Looks like the DT are gambling that it will not get in and they are looking for a motion denial as appeals fodder. The defense team I have no issue with - they are doing their job as best they can. I do understand why some people cant stand them or are frustrated by them. My problem is with the defense strategy and those defending the indefensible - that Arias slaughtered a man through self defense.

    That is why the judge wanted more evidence, I suspect. Donovan could be making this up. Her interview on HLN may have been lies regarding the involvement of Arias. If proof that Arias has contributed to this is submitted, the picture could change. Are phone calls recorded between Donovan and Arias?

    Legally, I'm not sure. I mean, would she be allowed to give tv interviews while actually on trial? I know she did them from jail, but I would think that this would not be allowed while actually on trial.

    In the context of the trial, the defense and the judge are constantly all over the jury about not watching anything related to the trial. Wouldn't that also apply to jurors who could come across Jodi's twitter? Yeah, I know, they might have to actually go looking for it, as they would with news stories on the internet or tv. But, Jodi is out there portraying her comments directly to the public. So, I would look at it like well if Martinez had a photo session instead of a spontaneous event, or set up his own fan club website. That would be inappropriate and jumped all over by the defense, so Jodi having a public forum, is it that much different? I'm not sure.

    True we don't have proof, but Donovan is going on tv saying that she talked to Jodi on the phone and Jodi would tell her what to put on twitter. I would think those calls are recorded, so the Maricopa County SD surely knows whether those comments are coming from Jodi or Donovan is just saying they are.

    Either way, I don't have strong feelings. I do think it's ridiculous that this idiot is addressing the public and accumulating fans. So, in that respect, I know it would twist in her gut if she lost that attention-whoring medium, which would be nice. On the other hand, you could argue that jurors "probably" won't see it or hear about it anyways. The thing is though, defense is so ready to jump all over things that the jury could see or hear, that I think by that aspect, it wouldn't be hard to argue it should be shut down.

    If it gets in, I think Juan should take a copy of the same photo and draw a German Shepherd outline and a third copy and draw an outline of Jodi with the camera in one hand and the knife in the other, and tell the jury they have several choices.

    Why did the photo guy think it was a good idea to make a slide of a digital image and project it on a screen? A digital copy viewed through the court's big screen just couldn't do it? A slide? Who does slides anymore? What is this, nostalgia court?

    My guess is, if they finish with ALV early enough today and the Judge allows the retna photo in, we'll hear from that photo guy from earlier. If the photo is not allowed, rebuttal will start tomoroow.

    I really want to know what went on with ALV in chambers.

    I think court with the jurors is supposed to start at 1:30, The Alv thing is going on now, but the judge only gave 15 min. for it.

    No matter how hard I try, I don't see the reason for the eye pictures. Brian said the picture was shot downward, but couldn't be conclusive on much because he didn't know their heights etc.
