I was late.
This is a daubert hearing, it is to qualify an expert witness in court to let them testify. No jury is in the room (Thanks Harlette)
Jodi is sitting in the juror box. Travis' family is behind her.
Brian Neuimeister is on the witness stand.
They moved Jodi somewhere else. Brian is now talking about his experience. They have Travis' shower photo up on the screen. They are talking about camera stuff. (I have no idea what is going on) (I think Nurmi is fixing to bring up that there might be somebody's in Travis' eye)
EX 1 is admitted-It's data stuff. Brian was able to see a picture in Travis' eyeball.

How many times have you testified? A dozen in Macicopa.
He only enhanced the audio in this Jodi case, not pictures. JM says the motivation for testifying before was to be "qualified" in this area.
Approach
The last time Brian testified was for Juan's office on another case (LOL) He's just been retained by Juan's office again for another case coming up. He's also testified about videos.
He enlarged Travis' eye. He drew some lines EX 4. Do you see better than anybody else who has 20/20 vision? No

Nurmi is showing EX 4 and talking about how the lab has better equipment to see the "person" in the eyeball.
Brian says that you can not see the person and you can't identify the person in the eyeball.

Nurmi is now bringing up stuff JM did to Alyce is closed chambers. Nurmi is fixing to play something. They are playing an audio of JM with Dr. Sameuls. (Jesus Christ-not the dr. again) Dr said that Jodi was depressed. (Sorry, I'm not hearing anything that JM says that is mean) (So far it all sounds like BS)
Now an oral argument between Nurmi and JM.
EX 1 was admitted in. Nurmi is going on about how mean JM is to doc. Nurmi thinks he's a bully.
JM is talking now. JM says Alyce should be upset based on what was recovered. JM says there is an ethical problem with the defense attorneys. JM says Doc was evasive. JM says Doc was a failure. JM says he is not responisble for any media stuff. JM is bringing up how Jodi is tweeting and how she violates the courts rules. State wants to court to make her stop. JM brings up how Jodi talks about him on twitter.
Nurmi- Nurmi calls it a shell game.( Nurmi hasn't bought up if the twitter account is actually Jodi's) Nurmi thinks JM is disrepects doc for not calling him doc.
Judge- state's conduct-no evidence- denied. Judge finds that JM was not in any way outside the bounds.
Twitter account- Nurmi says she has freedom of speech rights. Nurmi thinks JM needs to provide evidence.
JM- JM is just bringing it to the court's attention. Judge says she is not going to take in action. She says it can go through the sheriff's office.
There is a 1:15 sealed court with Alyce today.

I'm kinda torn about the tweeting.
On the one hand, it will piss her off if it's taken away and she loses her audience. So, there's a point in favor of censuring it.

She denied motions for mistrial for prosecutorial misconduct on all counts. She will rule on whether or not the pupil evidence is admissible when the court reconvenes at 1:15 (4:15 eastern time) for the sealed hearing involving ALV. Not sure if that's something we will be able to hear, or not?

Why discourage Mousy or other folks from looking Bobby up? It seems like learning about him is part of learning more about Arias. We see in the photo that she probably used coke when she was 15, for one thing. Also, he lived with Matt McCartney, another lover who still claims a connection to her - whether from loyalty or a mutal hold over each others' secrets. It doesn't seem like there's much chance of exposing Bobby as an illegal if he was employed as a background actor on Lost.I just find it weird that I cant find him on the US Census on Ancestry.

Juan's lucky no jurors saw that behavior. Signing the autographs and appearing on a tv segment were not wise choices, and not what most would consider entirely proper behavior for a prosecutor, especially during a trial. His behavior had the potential to prejudice the jury and invalidate the trial so it was reckless at best. Since the behavior was shown on tv, jurors might have seen it there and I think that will be argued again in the future (refer back to the "fantasy world" where jurors are able to completely avoide media coverage of the trial).
I don't think the defense expects a mistrial to be declared for any of these issues, but they are putting it all on the record for the appeal. Who knows how these events will be viewed down the road.

The defense is 0 for 2 today so far. I'm going to say that Judge will rule that goofy picture/reflection testimony of TA's eye will not be allowed in, leaving them 0 for 3 on the day.
I'm with you. Perhaps it could be something brought up in the mitigation phase or at the sentencing hearing with regards o lack of remorse?
We won't see/hear Alyce. It's a sealed hearing. If Judge decides not to allow that stupid eye reflection testimony then defense will rest. If she lets it in (highly doubting it will come in) then he will be last defense witless.
Bring on the rebuttal case!
