Do you guys think JA could use ALV as a reason for appeal. ALV was really bad. Can't believe she lied about testifying for "one or two men" in criminal trial. Very bad, among many bad moments. She was in way over her head. She had no biz testifying in a death penalty case.

Which I guess would fall under her DL being incompetent?

Thanks for posting this, I missed last Friday & have been wanting to watch it. What a riot. Judge's face is priceless (1:06). Tried to get a screen shot but happened too quickly.

1st question of the day & seems that Alyce is really trying to get the point across that she didn't have access to all the info. She's just validating more & more why her testimony should be discredited.

Juror Question: "Please explain why you feel Jodi is not manipulative either before or after the killing based on the review of statements & interviews?"

Alyce: "Based on the information that I have, um . . . I . . . I don't see a . . . a pattern of manipulation in the way I would define it. Um, I . . . I haven't seen that aah, in terms of her trying to ahh, and I?m not sure exactly what this is in reference to so it?s a hard question for me to answer but um, I think anybody can be manipulative. What I look for is patterns & I didn't see them in the materials that I read in terms of her relationship with Mr. Alexander so I'm not sure how else to answer that."

I think JA will use Willmutt and Nurmi on appeal, as ineffective counsel, and ask for the conviction (if that happens) to be overturned.

The look on AL's face when Juan was asking for specifics on the 1 or 2 men she claims to have testified for was priceless! Shekept looking at the defense table nhoping they were going to end this line of questioning due to privacy issues. That was probably one of my favorite Juan moments!

(sorry I didnt wnat to quote the big messages, just this part)

Can they just ask for an appeal every time they are found guilty? Is there a max number of times you can appeal your case? What happens then, if they can not find enough people to be unbiased on a jury? Can an appeal be denied or is everyone given the right to appeal when they do not agree with the outcome?

Im sorry!! I hope someone can answer

Of course, it would be funny as hell if JM plans on calling Alyce as a rebuttal witness. Maybe JM knows Alyce wants to leave bad, and JM told the judge that as soon as the defense rest...he plans on calling Alyce. There were a few questions he tried to ask her-but Palin objected b/c they were beyond the scope of the jury questions. Maybe he wants to call her to ask her a few of those questions.
That... Would be interesting. You called it if it happens!

I don't know if the Zimmerman trial will be televised because this current case has messed up the timing. It was supposed to be starting June 10 here in Orlando. The parents of Trayvon just settled $1,000,000 with the HOA here, and the trial hasn't even begun!!

Stabby will cite the numerous changes in her attorneys, the number of times Nurmi tried to jump ship, her ineffective experts and anything else she can dream up.

DP convictions get automatic appeals. The convicted can raise all kinds of issues on appeal. That does not mean that they will be successful just that they can/will/do.

Morning MDSers! So I was reading through all your wonderful posts yesterday and I didn't want to put out a mile long of quotes but it seems a lot of talk about Stabby's finger. I have been noticing for a while now that she keeps that hand under the table a lot since her testimony ended. Not all the time, but a lot more than she did when the trial first started. If she is in fact, double-jointed it wouldn't be too hard to make it look that way. The only problem is that she would have to consciously remember to keep it that way at all times and I would think that would get tiring? Maybe she puts the hand under the table to get some rest?

I truly pity any Attorney or Judge who reviews these trial transcripts in an appeal process.

I agree. I'm not overly vindictive, but I like the idea of her having as few privileges as possible while she drags out her appeals.

I don't think ALV's problem was because she had never testified in a death penalty case, I think her problem was her bias and her obstinate attitude. ALV wasn't hired for her death penalty expertise, she was hired because she was willing to say Jodi was innocent and battered and always, always in the right. Which ALV did. The DT rejected many other experts, who I am sure had more experience, in order to have ALV and her bias. I don't think Jodi could make a successful appeal based on ALV not being believable enough, or being too biased. "My expert agreed with everything I said and supported me totally" is not really a valid basis for an appeal.

If she gets DP there will be numerous appeals. I just read Richard Ramirez (The Night stalker) was sentenced to death in 1989. This dude brutally murdered fifteen people. He almost killed five more. It said his first appeal was heard 2006...that's a long time since 1989.

It's a nuanced concept. In the State of Arizona, in this Case, in this Courtroom, the "Jury" is required to maintain an attitude of neutrality and impartiality with respect to the Trial Process. (Let's set jury selection aside for the moment.) Collectively and individually, members of the "Jury" are admonished to not discuss the evidence with anyone, until they are required, (again collectively) to discuss it among themselves during deliberations while arriving at their final verdict.

The maintenance of an attitude of Impartiality in the minds of individual 'Jurors' during the presentation of evidence is illusory and not strictly mandated. Proof?

"Were you mad at Travis while you were stabbing him?"

What's Neutral and Impartial about that?

That's a question, posed by one 'Juror' under the rules and asked of the witness, (Defendant) by the Judge. It would not have been put to Arias by the Judge unless it qualified as a question that could have been asked by one of the attorneys representing one side or the other. We have agreed that the attorneys are neither neutral nor impartial. Neither is the 'Juror' who asked that question.

Think about it. It's a significant issue. No?

What I meant was her lying and being impeached shows DT chose someone incompetent. I get what you're saying and totally agree. She was a mess.

She probably will, but no way will she get anywhere with it as Nurmi and Willmutt have been far from ineffective--i think they've done a pretty good job considering what they had to work with...notice how many lawyers were jumping at the bit to represent her, considering all the publicity? None. Jodi probably cries herself to sleep wondering where her "Jose Baez" is.

Alyce had never testified in a CRIMINAL case never mind a death penalty case before she took the stand in this case. I was just reading this:

Alyce LaViolette was hired by the defense team as a professional expert witness. Why would a professional expert witness need a support team to prep her before testimony? Her role in this case is to tell the truth about her opinion and her observations about Jodi, and Jodi’s relationship with Travis. It borders on bizarre that she would feel the need to bring a team of old friends and supporters into the courtroom or even allow them to attend.

She is supposed to be there to state her professional opinion and to answer all questions with candor and honesty.

Think about it. What would you have thought about the professionalism of Dr. Richard Samuels if he came to court each day with a team of friends and old elementary school buddies? What if during breaks or before his testimony we saw him getting shoulder massages and pep talks from these supporters?

It is my deepest belief that no one who sits on that witness stand, who has taken that seat with the intention of answering each question with honesty and candor and who will not attempt to deceive or mislead, needs a support team or neck massages.
