Totally agree with bolded statement! I and a few others have been saying this since the start: Martinez should be focused like a laser beam on proving PREMEDITATION, not going off on tangents or wasting time on irrelevant crap. (The alternate charge, Felony Murder, is weak IMO. Saying the murder was committed in the process of committing a felony (burglary) because once Jodi attacked she was no longer welcome in Travis's home which=burglary just seems ridiculous to me.)
The defense's attempt to justify the murder on the basis of self-defense/'mortal terror' for her life/abuse was a valiant effort, considering what they had to work with:
Dr. Dick was there to provide an explanation for Jodi's incessant lies for those jurors who might have been sympathetic towards her but couldn't get past the lying. They saw the interrogation videos and the 48 Hours interview. Dr. Dick explained that she wasn't lying, she had created an alternate reality because the real events were too traumatic for her poor little brain to handle. Not lying, TRAUMATIZED! We will see if any juror bought that. (Also, she wasn't lying about not remembering anything about the stabbing, people really DO get amnesia about traumatic events. We will see about that one, too.)
Alyce was supposed to address the abuse victim/afraid for her life/self-defense story. The only thing she proved IMO was that Travis was at times not very nice to Jodi. There were some long texts/IMs that could qualify as verbal abuse and he did demean her sexually. Alyce obviously did not sell physical abuse. There was no evidence of that and the jury picked up on that from their questions. She didn't even attempt to explain the overkill, other than a sentence or two saying "Well, abuse victims who are angry as well as scared might 'over do' things". Yeah, I'd say that was an understatement!
So, justifiable homicide because of self-defense is out IMO. I just don't see anyone looking at those autopsy photos and calling it self-defense. I doubt the DT really ever thought they could sell that, but they had to try and as you said, put up a valiant effort.
That leaves the question of whether premeditation has been proven beyond a reasonable doubt, which is the burden of proof the prosecution must meet...
I doubt they would acquit....she has admitted to killing him. The judge will likely give them other lesser charges to consider if they don't believe it was murder 1.

I think they really have gotten a bit full of themselves and too big for their britches over there. I posted a comment under their "Willmott is a Doper" story to the effect that it was rather hypocritical of them to post their "Quit Bullying Alyce LaViolette" plea and then turn right around and publish completely unsubstantiated misinformation on Willmott. Double standard, much? Coincidentally enough, since they took the whole story down, I have been unable to post a comment. Apparently I've been banned, barred, suspended, something.....

I agree with you Brillig, don't think acquittal is going to happen. I'm thinking that Juan needs to sew everything up in rebuttal and closing and leave no reasonable doubt left for the jury to consider. Hope the gas station and Walmart witnesses help the case.

I would also go on the record and say that while I like that this forum is a bit more free-form than others, and the posters here are very fun to post with, I do think its in bad taste to post autopsy photos of Travis without warning and also in order to enhance one's argument in the thread.
I personally do not need to see autopsy photos to remind me why I am here. And I would always want any of Travis' friends or family who might come across my posts either now or in the future to know that I don't follow this case due to morbid curiousity. I follow it because I am sickened about what was done to Travis and I want to see whatever form of justice that is possible delivered for him.

I get that Martinez had to discredit Alyce, but on his rebuttal and closing arguments, it's time to focus on the facts and drill it in the jurors' heads the premeditation. The jury has heard so much testimony at this point, I fear the premeditation facts in this case are all but forgotten.
I really hope that his strategy is to focus on the facts and forget about all the other BS the defense is throwing against the wall. He shouldn't be falling for their trap!

While I agree is is extremely unlikely, I do not think it is technically impossible.
If the entire jury bought the whole story the DT is offering and agreed that Travis was threatening Jodi's life, so she shot him in self defense, and that she snapped when he continued to threaten her life by coming after her screaming "kill you bitch", and due to the repeated domestic violence combined with the PTSD she suffered after shooting Travis she slipped into a "fog" and stabbed him 28 times and slit his throat while in that fog... if the jury believes that, then they could acquit her. I do not think this will be the case, but it is not impossible.

An excellent summary of the case so far.
The question is, CAN Martinez let go of all the side dishes and focus on the main course? The defense team has given him so many distractions and lies to disprove or work on, it almost feels intentional! He seems so pissed off that he might just explode. That's the big challenge facing him for the rebuttal case - can he tie it all together clearly to show premeditated MURDER (not just covering her tracks), or will he blow his wad proving that Matt McCartney would lie for Jodi and that she had anal sex with more than one man?
I am starting to get the same feeling about a hung jury. Its getting crazy and I can only imagine there is at least one juror who is lost with it all.
