Regarding hung juries at the eligibility phase, the proper procedure is specified in A.R.S. ? 13-703.01(J): ?[I]f . . . the jury is unable to reach a verdict on any of the alleged aggravating circumstances and the jury has not found that at least one of the alleged aggravating circumstances has been proven, the court shall dismiss the jury and shall impanel a new jury. The new jury shall not retry the issue of the defendant?s guilt or the issue regarding any of the aggravating circumstances that the first jury found not proved by unanimous verdict. If the new jury is unable to reach a unanimous verdict, the court shall impose a sentence of life or natural life on the defendant.?

It is important to remember, it is NOT sufficient to reject a potential juror just because they had exposure to a high profile case. They are asked simply can you disregard and decide on evidence and law provided in this court. If they say no, they are out, if yes, they can be in.

i honestly dont know, i just remember watching some HLN clips on youtube, and a spokesman for the company was talking about his time around jodi when she was with them (he was saying she was antisocial)

I am blown away on this thread at how many people have been victims of domestic violence, know someone close that has, or witnessed actual murders. I had no idea how common it is in civilized societies, and it makes me very sad. My heart goes out to all that have any of the above. And from what I gather, the perps have all been men. Maybe the men just are not speaking up. Jodi is the exception to the norm, with what ALV was given and the soft spoken persona of Jodi, and her apparent distain for men, I think she was a believer, but after hitting the stand, she has had a wake up call. Big time, life changing wake up call.

The guy that hired her for the shoot was on NG and said she said her relationship with Travis was "an emotional roller coaster" he also said she was very odd. He said she would show up on time, and said she have to leave early to "take pictures".

Stabby didn't write about abuse in her journals or to other people but it still means she abused
TA didn't write fearing her in journals means it didn't happen and speaking of fearing Stabby to other people also means it didn't happen.
Alyce kept dropping supposed IM's about Spiderman underwear into her testimony. If there were in fact such IM's why didn't defense introduce them during Stabby's testimony?

Um not that simple, but much different. Mitigation is part of the aggrevation phase technically. State presents, (bad bad act this person should die) Def presents (character and reasons they should live).
Then the jury decides if the TOTAL of the mitigators weigh against the aggravator(s)
In this case, the state only has only one aggravator "Especially cruel" But we won't see the entire case presented, State limited to relevance of that specific one. So we'll see only what JM wants to show to support this aggravator.
DEF mitigation has a lot more room! They can bring in any dumb shit almost... girl scout badges might lend the jury to give her mercy. It's a wide range allowed. Sometimes even the murder is offered as a mitigating factor! (wont be here) I could blow you head off and my team at mitigation can use it as death fast the victim didn't suffer'. Or I could chop you up in pieces alive and they can try saying I deserved life because I am a teacher and could be of use to the prison classes.
This is a phase I find most will find interesting because it is when you will get stories about her past. Straight A student, or low IQ, choir boy, track team any morsels to help show this life has a grain of decency in them worth salvaging.
Easier to think of it as 'the 'trial' of morals' phase.

I was her court appointed conservator more times than I can count! because once a person becomes "stabilized" by the psych meds they a deemed no longer a danger......... then of course the person stops taking their meds and you can't force them because they are adults! you need another court order to force them to take the meds but then they have to meet a certain criteria in order to obtain that court order & mentally ill people like my mother are very smart about knowing when they need to put on their "dog & pony show" to fool the investigators into thinking their perfectly sane!! Grrrrrrrr........... it's a vicious never ending cycle! I have had to deal with soooooo many mental health professionals and have ended up filing complaints against them with the medical board and their employers because they were the same caliber of people as both of stabby's "professional" witness's! I can clearly see that stabby drew Travis into her web and when he finally had the strength to end, really end the relationship she ended his live because she couldn't win her sick game of possessing him!
So what the fuck went so wrong with Laviolette's testimony? Put aside your hatred and knee-jerk responses and think. On the surface she seems like a good choice. Folksy, easy to understand, experienced, well known in her field, published author. She had some decent evidence to work with, that would at least show emotional abuse and a volatile relationship.
Why did she take the case?
- Believed in Jodi's cause as an abused woman who was justified in striking back
- Felt Travis was an abuser and wanted to set the record straight
- Self promotion (could she have predicted the media interest? doubtful)
- Money
- Promote her view of domestic violence
- Conned by Jodi into doing something outside her boundaries
Why was she so rigid in her views of Jodi as victim and Travis as abuser?
- Believed Jodi was truly emotionally and physically abused
- Defense team kept her in the dark about contradictory evidence
- Jodi tricked her completely
- Paid for her views, so afraid to show any flexibility
- Unable to admit she was wrong in public
- Not actually an expert on domestic violence or testifying
Who takes the blame for this Titanic hitting the iceberg?
- Alyce? She was sloppy and unscientific, lied and covered up for Jodi
- Nurmi? He is a snake and did not prepare this witness
- Wilmott? Her direct exam and prep missed the mark
- Jodi? She lied and changed the facts on the people hired to
- Samuels? His faulty psych testing & eval contributed to the clusterfuck

there is no "impeachment trial" during a criminal case, impeachment is done thru the cross examination, which martinez has done, the most that would happen is a possible jury instruction that if they find part of her testimony false they would be able to disregard all of her testimony
