    I imagine he got at least one juror like me. I had no problem seeing the 'legal' punch line within minutes. It's glaring he is showing Alyce makes up shit, made up her own guide she used ad naseum and it's value and her crediblity for any clinical bases is worthless. It's so bad, it can be applied to pure fantasy and fairytales.

    and it is the states position that she stabbed him first. It is based on what ME told us.
    So once she begins stabbing him, it's not a situtation where she stopped. She killed him 3 times over. And that can also be factor over in to the premediation factor.

    The premeditation here can be as long as a week or inbetween the stabbings we're talking a minute maybe two minutes.

    The court is well aware of the law and I won't regurgitate it.. it can be done in a very quick fashion.

    So this defendant kills Mr Alexander 3 different ways. And there is, at least for purposes of 320, which is what we are talking about, there is evidence sufficiently substantial toward that aspect toward that charge.

    As for the ALTERNATIVE of first degree murder, the felony murder is the state's contention that we listed 3 that apply, ah crimes. But the assault is most suiting.
    When she began stabbin him, no one can debate the fact that Mr Alexander if he were alive to be asked, did you really want her to be in your house when she began stabbing you. I am sure he would have said no I do not, I don't want her to stab me anymore.
    And that point she is no longer a guest, she's not an invited guest, her status has changed from that of an invited guest to that of a murderer. And if that is the case, the assault, the stabbing that continued after that forms the predicate for the felony. Um the issue has been briefed you have all that before you so I incorporate that into my argument and ask you to deny the defedants request for a rule 20 judgment of acquittal.

    The reviews are still there. My husband wants to buy the book, but I told him NO WAY. Then I told him the price and he backed off. Maybe when it shows up in the dollar store we'll get a copy.

    I followed it. He was paralleling Snow White's life and circumstances. They were like Jodi's.
    The perfect thing came out. Snow White was cast out of the house, but ALV got a little huffy and said Jodi wasn't cast out, she CHOSE to leave. Hope the jury caught that, as it showed she COULD and DID leave the situation.

    That leaves her with even more time between education. Interesting, wonder why JM didn't bring that up, surely he would know it was 1974 not 1980. Unless ALV got a different masters in 1980? Regardless, I think he did a good job of proving her defficiancies in her education with regarding being able to diagnose. If she can't "read" the tests that diagnose, how can she diagnose anything?

    Under oath, knowing JM would know, she testified she got her Masters in 1980 Even bragged she finished it in 2 yrs. This would mean she wasn't even going for it six yrs earlier like she has frauded on the College site listing w the 1974 date. She embellished SIX years at the college listing.

    It would not be a long shot in my state. Several years back, my house was burglarized. Several more houses on my street were also burglarized the same day. One of the items taken from my house was an antique Japanese short sword in a carved bone scabbard case. It was very beautiful, ornate bone carving, but frankly I did not consider it very deadly, I considered it mostly decorative and had bought it to go in my Victorian safari/explorer themed study.

    The police did catch the burglar a day or so later, and one of the items he still had in his possession was that sword. The police were thrilled, because that enabled them to charge him with a felony (armed burglary), since he was "armed" by the time he left my house. He had only stolen jewelry and electronics from all the other houses. He was convicted, and because of the "armed" part, he got several years instead of the usual couple months for an unarmed residential burglary. So at least in my state, stealing a weapon is enough to upgrade a criminal offense significantly. I would imagine the laws are similar in Arizona?

    I agree, there is nothing wrong with posting a different opinion. I don't think most people here object to that at all.     Ok I'm sure it has been discussed but I lazy today and don't feel like hunting for it..smite me later.. But in the ME's testimony which I concur with the most probable order of injuries were stabs, throat slit, then gunshot. In supporting this most probable of theories, what was the estimated location of where his throat was cut? Reason why I'm asking is I was thinking about an arterial bleed, (I snagged my wrist on a hurricane fence when I was a kid and severed an artery and it sprayed sorta kinda) so my thinking would be that an arterial bleed of TA's magnitude would have done a bit of spraying as well unless his blood pressure/volume had become low at that time. So there would have been an area where there was some type of spray pattern or very large puddle. I would love to hear Dr. Henry Lee's theory on this crime scene. I hate to sound morbid but I have always found crime scene reconstructions/blood spatter patterns /ballistics absolutely fascinating. Someone please refresh the kid on the the kid on the short bus...

    Weird about the days the men folk attended trial. The Enquirer quoted mom as saying she was only doing it because Jodi said her life depended on it and that she was very tearful over it. Mom and her sis just don't seem right to me. I think they tried hard to be good parents, instill a work ethic in their kids and even turning Jodi in for growing pot on the roof. They have been manipulated and abused by Jodi for a long time. It's clear how Jodi felt for her mother, yet the mother still loves her and doesn't want to see her get the needle. Mamma and her sis seem oddly detached to the reality of trial. It all makes me wonder about the strange dynamics of the family.

    I know that similar support came from family members in what I said above about what happened in our family. His parents (in their late 60's and ill) put up their home to get the perp out on bail. They attended the hearings when their health allowed them to. They found it hard to believe their son did what he was accused of. Like the Jodi case, there was photographic evidence and video of the crime. Aunts and uncles and cousins provided the perp with handyman jobs while he was out on bail. Holidays with his siblings and their children were cancelled due to bond agreements that he not have contact with children (not that his siblings wanted him around their kids). It really fractured the whole family. My husband and I chose to support the victim and her mother with groceries, gift cards etc and we encouraged other family members to not forget about the victim. I know of a couple family members who reached out to the victims, but mostly they all thought it had to be a misunderstanding, it couldn't possibly be true. I think they also thought the issue could have been handled without the law involved. The victim was the perp's child. I've known these people for around 25 yrs and they are good people, who did the best they could in raising their children. They never imagined they would ever be in this situation. They have lost 4 grandchildren over this and the respect of their other children. The perp's siblings sided with the victim and were angry with their parents over their support. They just aren't thinking rationally and are letting emotions drive their decisions. Reality will set in and they will simply have to come to terms with it. Family get togethers have been forever changed, that's for sure. This case was front and center in the news and social media locally. His parents literally were too ashamed to leave the house and were fearful as some of the comments on the news stories were threatening.

    I just can't imagine how awful it must be to be in their shoes. To be under a microscope due to something horrendous that their child did. I just have to give them a break for now. I look forward to their interviews when this is over and hear what life was like when Jodi was growing up.

    Maybe Donovan is the only person being friendly towards them. Somehow I don't get the feeling like they are best buddies. They need to see this trial and the evidence and they need to be there for Jodi. I'm sure they know she's guilty, they are just hoping for a verdict that spares her life.

    The oddest thing I found in my observations of our family is that no one ever asked him if he did it. The closest I heard was someone paid him for some painting and suggested he buy some new clothes since penney's was having a sale. He responded with something along the lines of where he was going, he didn't need new clothes. I guess my point is that life doesn't prepare us for this sort of bullshit.
