During the Snow White analogy when Juan said that Jodi was sent away from her house at a young age, LaViolette corrected him and said that Jodi wasn't sent away but "chose to leave because she felt abused and because she felt controlled [by her parents]". This shows that Jodi can, and did, leave an abusive, controlling relationship, even a long-term one. I really hope that the jury read that the same way I did.

Oh she's insincere about that alright. If you know something you're about to say is going to cause offence, the 'sincere' way of doing that is to acknowledge 'this may offend X but it is my professional bla bla'. She knew what she was going to say would be offensive to the family and was trying to play it 'cute'.

I can't make up my mind about it. But for the sake of the trial, she cannot afford to make any kind of contact with any juror, visual or otherwise. She will by now know the way camera pans the gallery and although she'll be curious and glance over at them occasionally, I don't believe she'll try and 'engage' with anyone. Very soon, she'll be watching mixed reviews of her attendance and she may not go back.

Stick to the important and relevant points. Arguing over Snow White as your leadoff question string is getting drawn into the muck.
Ah, you're back. You mean the way the defence with Alyce stuck to the important and relevant points? She's spun a fairytale for long enough on that stand. Juan's calling her out on the fact she's based seminars on her "catchy titled" Snow White bullshit. Just as she's based her opinions on Jodi's fairytale bullshit. Seems to me she was re-assessing her own 'validations' by the minute with Martinez. The woman is a shyster.

No, I missed that report, thank you Hello. It does say the door was kicked in. And the gun had a magazine of 7 jacketed? hollowpoints! Was that a hollowpoint casing found in the bathroom?

RE juror 5, if she is a truck driver you would think she would be getting back on the road after not getting paid for 3 months. I doubt her employer had to pay her while on jury duty if she is a private contractor, but I don't know how that works. I don't see what purpose it serves for her to be in the courtroom. If I were her, I would have tried to be incognito.

    Coconut, my friend...

I have read The Art of War.

In that famous book, Sun Tzu also said:

If your opponent is temperamental, seek to irritate him.

Hold out baits to entice the enemy. Feign disorder, and crush him.

When the enemy is at ease, be able to weary him.

Thus, what is of supreme importance in war is to attack the enemy's strategy.

Take advantage of the enemy's unpreparedness; travel by unexpected routes and strike him where he has taken no precautions.

And therefore those skilled in war bring the enemy to the field of battle and are not brought there by him.

All men can see these tactics whereby I conquer, but what none can see is the strategy out of which victory is evolved.

The sayings I quoted would tend to support JM's tactics. And frankly, in the end, I don't really care if he uses a sledge hammer or a scalpel, so long as he gets the job done.

In theory, I don't have a problem with Juror 5 being there. I think she's probably pissed that she was wrongfully ousted by the defense, because they think she was/is not buying Jodi's bullshit.

That being said, I think she should probably stay home, only because I'm sure Nurmi will try and twist her being in court into another plea for a mistrial. He'll claim that she was speaking out to the other jurors and that's why she had to be removed, and so by her being in the gallery, she's still "exerting influence" or some other kinda b.s.

I don't think it's worth the risk that the judge allow her to stay.

Rather than jump to a conclusion or SPECULATE what he meant, I asked the source. You cannot tell tone in either, for the most part. I take such issue with the methodical twisting of Travis' words. If anyone is guilty of character assassination, it's the f'ing DT.

PS Donovan is creeping me out. I think I may have TGA from the shock of stumbling across her mug in this thread. Thanks for the nightmares. LOL xo
Yep. Been there, done that. Have sent some texts myself, and due to space, I've re-thought what I sent, after I sent it, and then sent a follow-up to clarify, just so it wouldn't be misunderstood. There is plenty of room for misinterpretation when it comes to texts.

Really. Obviously this was a heinous crime and Jodi is a cold-blooded murderer. But, it could only have been worse if she'd killed him in the woods. If nothing else, at least the fact that it happened in his home means that she left tons of evidence behind. I have to believe we wouldn't have the murder pictures if she had managed to lure him to the woods.

And knowing Jodi, she would've been quick to fabricate herself an alibi, with friends or family on her turf, and then claim that either she didn't know Travis was coming, or that she was expecting him and he never showed up.

A crime scene in the woods would've been much more beneficial for Jodi, and she probably would've gotten away with killing poor Travis.

I am seriously pissed right now. I leave work at 5 and watch HLN once I get home. NG is busy ignoring the trial and once she comes back to it she is showing reruns from earlier testimony with stupid and stupider!!! WTH is going on? If I miss the Snow White part of the cross I will be one unhappy woman.

The defense can fiddlefart around and try their tricks - they don't have the burden of proof. Alyce did a reasonable job casting doubt on Travis's lifestyle and showed that he was a horndog who treated women poorly and without respect. More like sex toys. Whatever, right?

Has anyone in their life ever "won" an argument by yelling? Have you ever been in a business meeting and got your point across by raising your voice and pounding the table? Maybe if you name was Saddam but that's about it.

Yelling isn't going to win the case. Screaming won't convince the jury. Clearly presenting evidence and showing contradictions will. Making a precise and succinct argument, without emotion, will get the job done. Martinez has taken the bait again and decided to verbally assault a quirkly grandma who lectures on battered women. Only a dumbass would hurt his own case that way, by distracting from the real issues with emotion.

yup good choices. I'll go with ABC, but at least she picked a main network. And one that doesn't make phony fanfair and talk over each other. She's making a calculated mistake though, because when the verdict comes in, her 15 mins are all but worthless.

I respectfully disagree with just about all of this.

Travis was NOT a "horndog who treated women poorly and without respect. More like sex toys"...I find statements like this offensive. You have your opinions, and I have mine, I guess.

Martinez doesn't scream. He raises his voice and he speaks passionately. He is the voice for the victim. I have very little to complain about with him. I think he is doing a great job. I can't wait to see his rebuttal case and his closing argument!

How many people have you sent to death row succesfully? Juan's not in a business meeting, your attempt to equal a murder trial to one is an error.
Grandma? Oh come on now coconut, you are smarter than that. Grandma my rear end, she's a scammer promoting her book for selfish gains on the back of a dead man's horrible murder.

The top five symptoms of pen kleptomania:

    1. An intense urge to steal pens.

    2. A feeling of relief, fear, or anxiety after stealing pens.

    3. Compulsive stealing of pens, mostly from public places.

    4. Stashing away of stolen pens in different and unusual places.

    5. Brutally murdering ex-boyfriends.

At first I was a little taken aback by Juan's style, but I've come to appreciate it. After hours and hours of Nurmi speaking softly and coddling a heartless murderer as if she's a delicate flower, and then after hours and hours of Wilmott coddling two shrinks-for-hire who did backbends to make the murderer a victim, it's a visceral relief to have Juan's passion come in and finally get everything back to reality and the utter seriousness of this crime. If he also talked sweetly to these awful people, I would wonder about our judicial system.

I think that's why he is so aggressive - he wants the witness to give up and just agree with his perspective on what they have said. Juan tries to repackage her testimony into small phrases and then try to sabotage her with them. I can see myself reacting to that in a pretty similar way. If he was sweet and sensible he'd get a much better result. The best way to argue with someone is when they don't even know you're mad. Then they react to what you're saying and not your/their emotions.
I have concerns about it myself. I have to think that some of the jurors are not turned off by it. I can totally understand why she has the attitude that she has. I may not care for her man hating ways but if I was on the stand with someone trying to put me on the spot like that I would go snarky bitch on that person.

It's constantly reported that the voice isn't as loud as HD TV appears when you are sitting in the court room and that is the only room the jurors are in. I don't have to like his voice to see the man has a long succesful career including one woman on death row. He must not be making as many mistakes as some wish to see. Not saying he is perfect, no one is, but this HLN mentality of 'he is shouting' has grown old. The only juror critque I can find in previous cases is one. And it wasn't about his demeanor or his voice level! It was he tossed out a new theory in closing and that juror said it wasnt believable to her.

I disagree that a prosecutor should present his argument without emotion.. as in never showing any kind of feelings of anger. He should be angry that this other side is trying to take the victim and make that person the perp. He should be offended and angry at that.

Did anyone notice that when JW was asking Alyce if her analysis was based solely on her interviews with Jodi, Alyce said no and started listing off all of the evidence that she evaluated. She mentioned the texts, the IMs, the emails, the journals, and Travis' communications with other women, however she never mentioned the sex tape.

Did she not evaluate the sex tape?? Wouldn't that have told her more than the written word?

Also she said that Jodi maintained strong friendships with Matt and Darryl, Jodi's ex boyfriends. How would she know that if she didnt interview the exes? Once again, her entire opinions are largely based solely on what Jodi told her. Worthless testimony!

Grandma? Oh come on now coconut, you are smarter than that. Grandma my rear end, she's a scammer promoting her book for selfish gains on the back of a dead man's horrible murder.
Again, I give my opinion of The Prosecutor as someone who could be a juror, just like all of us.

Martinez and I do have something in common - neither of us are sending Jodi to death row.

If I were a juror, I would want The Prosecutor to help me understand the inconsistencies in the testimony. Instead he gives me a headache and a stress reaction. It's not effective communication for me. His argument may be correct, the witness may be a fraud, but he's not making his case effectively. I don't think this witness is even that important. She glossed right over the only day of Jodi's life that really matters... I thought she was going to talk about Travis attacking Jodi, or how women who have been abused can go mental and snap, but none of that happened.

Granted, he is much more interesting than Nurmi. In fact, I don't watch Nurmi; however, JM is interesting in a bit of a train-wreck aspect. He would piss me off if I was a juror. He's belligerent. Not getting the circle-jerking to him. Well, given the biddies in this thread, I guess I do.
