Not sure...good question. I believe it's usually at the judge's discretion, with input/recommendation (or not) from the prosecutor and defense team?

IMO with a case this big, DP and all....maybe they should have been?

Cost was a big factor I would think. I am sure the AZ/MAricopa County taxpayers would be screaming over the costs if they had been sequestered. Then what happens on the long weekend breaks - could they have gone home for President's Day or Easter?? IMO, the decision on sequestering the jury was a 'damned if you do damned if you don't' choice for the judge.

If Jodi is sentenced to death, I feel certain this fact will be listed as a part of the appellate process.

Thanks NQ, that makes a lot of sense!

Wow you guys are braver than I, I haven't had a chance to watch the gazillion interrogation vids but may well get round to it today pre trial coverage.

I'm catching up so hope you will forgive me for being late to this but, "dense" (loved that sneakers, even if it was unintentional ;)) want a mistrial?! *mock shocked face*

I hope the judge puts the stop to that crap!

    INTERESTING!

Watch At: 12:22 as Stabby tries to rewind the (fake) recording device to listen to the BS story she just gave! To see if she sounded credible Ha Ha! Very quickly (from behind the fake mirror), Flores comes back into the room, (after giving a dramatic "You're on your own now Stabby" goodbye), to say...nothing really, but immediately takes the fake device from the room!

Are we sure Stabby knew she was being recorded??? That changes my mind a bit!

Im pretty sure in the States a suspect has to be apprised of the fact they are being recorded. Jodi is intelligent in her sociopathic/psychopathic way. Our whole goal if we get caught is how the crud are we gonna get out of this....I prolly would have done the same thing. Jodi is off her game in these tapes. Her mind is racing too fast on how she is going to get herself out of trouble. Too bad for her....game over.

Does anybody know where part 1 of the Abe email is at? I have the 2nd page, but can't find the first page.

    Here's what page 2 says

are not in a committed relationship, but regardless of our status, I care so deeply about his. I often ask myself, how would Travis feel about this? Or, how I would I feel if Travis were doing what I'm doing right now with someone else? In fact, this reasoning has been a compelling force behind all of my actions, decisions and conduct as of late.

Now I'm sure you're already aware of this, but when we hugged at the Grove a few weeks ago, my intention was nothing more than to warmly greet a friend and business associate. But I've since given this further thought and I've asked myself, would I have acted the same if Travis were there that day? In truth, I would not have. And this leads me to question my own character. I don't want to be inconsistent, especially not when it involves something and someone that is so important to me. Granted, human behavior is often modified and adjusted under various circumstances. Everyone does this, it is natural. But at this point, none of that matters to me. What matters to me is how that which I am accountable for would make Travis feel. I care more about him than I ever have. His happiness is of cardinal significance to me, and his feelings and opinions I value more greatly than gold.

I didn't write this email to expound upon my secret worship-Travis-agenda. I only wanted to clear a few things up, if not for you, then for myself. For I'm sure you already "get" all of this anyway. But at least now I've said it, and I can rest easier knowing that we are on the same page about things. I think you're a great person who's never had a single bad intention toward me, and I appreciate all of the time you've taken to impart to me your knowledge, prespectives, and experiences. I will certainly see you around at events, to which you bring a lively energy.
    Take care until then, Jodi

Surely she knew she was being filmed?

She was definitely sure those little recorders were going to catch her out somehow. Very odd indeed.

I do think they should have (been sequestered). And as for the exhorbitant cost some have mentioned. Yes, I'm sure it would have been very costly. But, this is a high profile, DP case, and IMO every precaution should have been taken to protect the jury's integrity. If not sequester in this case, then when? I also truly believe the the inconvenience to the jury, along with the extra cost to the taxpayer, would have compelled the judge (who I think is doing a good job, all things considered), to spend the court's time more judiciously (pun intended, hehe). Why, for instance, is there no court on Fridays, ever; why is a Sunday holiday (Easter) made into a "4 day weekend?" Could not some of the judge's other cases been re-assigned? (Her early mornings are taken up with other cases.) And if you need to put a feeding tube down the insatiable/migraine suffering murderess, hold court until 5pm every day!

I noted that. Ambidextrous or just trying to put on video she wasn't necessarily left-handed? I think she stabbed him with her left, but could have used both throughout the attack. Good spot!

I don't know for sure why anybody would take Lisa's email serious??!! The girl got scared when Travis got a freaking woody when they were making out.

The girl was naive about sex/and men. The letter she wrote sounded like a bunch of jr high school kid drama.

    Lisa admitted that.

People act like they are surprised Travis liked sex. uh, Mormon's like sex as much as Amish, Baptist, Pentecostal, Atheists, and devil worshippers.
I always laugh at the facebook comments that claim Jodi sucked him in with her magical puss power. Who knows-maybe Travis sucked Jodi in with his magical sexual powers.
I doubt seriously either of them just stepped off the virgin truck.

I've been thinking about the motion for mistrial filed for juror misconduct yesterday. I wonder if it has something to do with the juror that Hodi was trying to point out to JW last week or the week before (they all run together now). Some thought she said juror 5 at first, then some people thought she said juror 2. I think she's been watching the jurors and looking for one that don't seem to buy her story. I think shes been stalking this juror for a few weeks now. Just my speculation.

When we went to his apartment the next day to get a few things and finally saw all the blood... same thing, it was pretty much everywhere, even up the walls and on some furniture.

Not saying it's true, just that it could be, ya know?
ya never know what is true or not when it is coming out of that broad's mouth.

Hopefully that wasn't something he experienced, tho. But ya never know with the things that come out of HER crazy mouth.

I'm pretty sure she is ambidextrous.
I have definitely seen her writing/doodling with both in court.

Wow, and I thought the one I got for suggesting maybe Travis might have said he didn't feel his legs was uncalled for, dang.
(this will prolly get smited, too)

Least now I know I'm not the only one, cuz that was weird.

    Agree.
He may have gone a little fast for her, at times, but unless she says no - and stops him - how is he supposed to know where her boundaries are? And when asked to stop - he did. Nothing that scream he was abusive/threatening in any way. Maybe a little over eager with her, but that's about it.
    Watch Day 22

She starts to slip right before Nurmi cuts her off with an objection.

"I said that he said that" [indication of word games she does when she's lying]

gets herself all twisted in her lie
"I said, he said, I said he said"

As far as ambidextrous, another fake out. She played that game in interrogation, but we hear the Dt Blaney found BLANK pages.
There is nothing but her fake games for a camera but they all lack any actual writings.

Mods have asked smite [we all get them] talk to be taken to chit chat so hopefully this thread can hold more TRIAL topics.

i'm confused by this as well, why did they not assign this case to another judge with more free time, or reassign her cases to another judge? And the thought of a DP case without juror sequestering is strange to me. All in all the time management of this court is extremely baffling...to me at least.

Definitely this. Travis was doing a normal human thing, getting his end away (as we say here) with someone who like to do it with him. No crime in that.
As for Lisa, she was just very young. Travis was an older guy who knew what he liked. Simple as that.

Hard to tell what Jodi is thinking. Jury watching by her has been very obvious this past week. You can just see her wheels turning when she studies them, then jots something down in her book.
I wonder what the jurors are thinking when they observe her almost constantly writing vs paying attention.

I guess I am the only person who waited around for five days for MDS to reopen the locked thread. Just checked and found everyone on part II.
