While I am not fond of the defense team, to be fair it really is possible that they decided at the last minute to abandon their attempt to get this in (for whatever reason).

She is not a doctor. After her name she has "M.S. and MFCC"; these mean:

M.S. or M.A. - Masters of Science or Masters of Arts. These are the traditional degrees given by colleges of arts and sciences. In the United States, a master's degree in psychology has not been considered a "terminal degree." A psychologist (other than a school psychologist) generally needs a doctorate to be licensed. Some Canadian provinces license psychologists with a master's degree. A few US states are also beginning to do this.

M.F.C.C. is used in some states to identify a Marriage, Family, and Child Counselor

He will be testifying, just not about whether or not he can tell if this was a premeditated murder by looking at crime scene photos.

If I read your post wrong, I apologize, but it seemed you were saying the jury was already somehow determining DP at this time and the 3 gas cans wasn't enough. No, they're not, but my point is they are not determining DP at all yet. I agree with you that JM needs to focus more on premeditation to reach 1st Degree. However, there is also Felony Murder to consider. That is also 1st Degree.

Overall, I'd like to hear more about a motive. Why did she want him dead? Was he an obsession? Was it the last set of text messages/emails? If so, JM should put it together for us. Premeditation will be easier to follow at that time. He needs to be able to bring in the stalking, tire slashing, weird behavior, etc. I am worried because I haven't seen any of this. We can assume a motive, but I really would love to hear more evidence and testimony that supports her obsession with Travis.

Maybe they figured he wouldn't have time to put together other questions if he was busy working on what ever they had already decided not to fight with. Does that make sense? The moment when I became convinced that Jodi planned his murder was in listening to her leave the "voicemail" for Travis, on his machine, as she was driving on to Utah.....after she had slaughtered him. There is no way in hell she could have made that up on the fly. That was rehearsed. Her voice is cool, calm. She does not falter in her speech, at all, as she talks about how she's sorry she missed him and blah blah blah. It is cold and calculated. She knew exactly what she was doing. That call was not conducive to the state of mind she claims she was in. It IS right in line with premediated murder, though.

I was convinced when I heard her on the 'sex' tape. Cancun kept coming up and it was obvious that her brain was spinning as she tried to lay paths for her future cover. Remember how she mentioned seeing Shakespeare during the recorded sex tape? Then she used the same cover in her post murder voice mail to Travis. This premeditation began before she moved back in April. Premeditation layers have been built beautifully by Martinez. Link the evidence together the evidence and reasonable doubt would only be found by the dumbest of jurors.

Nurmi wanted Dave Hall's video but then Martinez subpoenaed him as prosecution witness. He would use Dave Hall to counter anything the defense tried to get out of the video.

It would be hard though, jmo, for the defense to establish a foundation to enter the video as evidence without Dave Hall's testimony as to the where/when/why/how.
