    So, I don't get the point of this guy's testimony at all...if anything I think he was damaging to the defense, both by equating Jodi to police officers and servicemen and by talking about how murderers are 'traumatized' by their crimes. Really?? We are supposed to feel sympathy for the poor traumatized murderers now??

    I think that is part of it. Even if they do find a knife at the scene.....unless they can find fingerprint or DNA evidence to tie it to the crime, specifically, it is often referred to as the "alleged" weapon. With guns, they can do ballistics testing to narrow down a specific weapon if they find bullets or casings left behind Also, by the entry/exit wounds. With knives, many of them could cause a similar wound pattern. They can often tell if it was a sharp or blunt object, serrated vs smooth edge, and they can get a pretty good idea of the length of the blade by measuring the deepest wounds. But even that is not foolproof. It depends on the force used when stabbing occurs. There can be shallow wounds, made with a long blade. Or there can be shorter blades which are driven in with such force that they plunge farther in because the skin and muscle tissue are compressed inward.

    The penalty phase will only take place if she is found guilty, as charged. And, yes, victim impact statements will be allowed. I am not sure of AZ law. I think it differs from state to state. Typically, the jury will vote to recommend what sentence they believe should be imposed. In MA, there is no death penalty. A conviction of first degree murder carries an automatic life in prison with no parole. In those cases, the judge must impose the sentence. But, there are some states in which the judge has the final decision as to whether they follow the jurors recommendation or they can impose a sentence of their own choosing. Any members versed in AZ law?

    Not sure what you are doing wrong? Reply with Quote should quote the person you are replying to.     The "burglary" at the grandparents where the same caliber gun is stolen a week earlier.
    The bizarre circumstance of the burglary itself.
    The rental car (when she owns a car).
    Driving 100 miles to rent the rental car.
    Not wanting a red rental car.
    Her license plate being tampered with/upside down.
    Asking in advance to borrow gas cans.
    Borrowing gas cans.
    Buying another gas can.
    Saying you are using the gas cans to save money, but then filling them up in CA where gas is more expensive.
    Was allegedly not planning to visit Travis on this trip, then changed her mind.
    Does not tell Ryan or anyone she is planning a detour.
    Never getting any gas in AZ.
    Losing phone charger right before entering AZ.
    Phone runs out of juice right before entering AZ.
    Does not park in Travis' driveway.
    She and Travis just happen to decide to try bondage that day.
    They just happen to use a big knife to cut the rope.
    The knife happens to get left in the bathroom.
    They just happen to choose that afternoon to do the Calvin Klein shower photo shoot.
    She just happens to drop the camera during the photo shoot, enraging Travis.
    Travis just happens to have a gun that he has told nobody about except her.
    The gun only has 6 bullets (or less).
    The gun is the same caliber as the gun stolen from her grandparents.
    She happens to be able to outrun Travis to grab the gun.
    The gun happens to be loaded with all the bullets Travis owned.
    When the gun does not stop him, she is able to instantly find a knife, which just happens to be in the bathroom or very close by.
    Travis is killed elsewhere, then dragged back to the shower and washed off

    She just happens to find the phone charger just before she leaves AZ.

    Thanks Kdon. I was just commenting on the glasses because Juror asked Stabby about her prescription. Think said Juror noticed the changes in her eyeglasses. Thought she said -2.25, -2.50 or something like that. Made me think they were just reading glasses but I was corrected. Damn if I can figure out my own prescription. Figured she wore glasses for effect, but she does take them off when reading. My bad.

    Denn, I am cranky b/c of how the DT with the help of this douchebag doctor is trying to blow smoke up the jury's ass.

    As to premeditation, it is defined under AZ criminal code, chapter 11 (Homicide), Statute #13-1101, Definitions: "Premeditation means that the defendant acts with either the intention or the knowledge that he will kill another human being, when such intention or knowledge precedes the killing by any length of time to permit reflection...an act is not done with premeditation if it is the instant effect of a sudden quarrel or heat of passion."

    Dr. DB is trying to present some psychobabble about how certain crime scenes reflect heat of passion as opposed to premeditation which Martinez is trying to block b/c it is BS and has nothing to do with the legal definition of premeditation.

    In the history of horrible criminals, have you ever seen a killer who:

    1. Did not cooperate with the police or investigators AT ALL? Just not one bit at all, everything she said was a lie, a denial, or a misdirection.
    2. Was in such a state of complete denial? With all of her lies now obvious, she continues to weave crazy stories that make no sense (holster, Travis loaded gun, Travis had the knife)
    3. Was so full of herself? Just a little fucking superstar up there on the stand telling the world about KY Jelly and correcting the judge & lawyer mistakes.
    4. Was so great at taking a life in her first try? She was cunning and clever and controlled the situation to her advantage. It got messy but she won.

    Jodi Arias is the last and only person in the world pretending that she didn't fully intend to kill him. When they find her guilty and she has to plead for her life, I wonder what she will come up with then...
