I think that is part of it. Even if they do find a knife at the scene.....unless they can find fingerprint or DNA evidence to tie it to the crime, specifically, it is often referred to as the "alleged" weapon. With guns, they can do ballistics testing to narrow down a specific weapon if they find bullets or casings left behind Also, by the entry/exit wounds. With knives, many of them could cause a similar wound pattern. They can often tell if it was a sharp or blunt object, serrated vs smooth edge, and they can get a pretty good idea of the length of the blade by measuring the deepest wounds. But even that is not foolproof. It depends on the force used when stabbing occurs. There can be shallow wounds, made with a long blade. Or there can be shorter blades which are driven in with such force that they plunge farther in because the skin and muscle tissue are compressed inward.

The penalty phase will only take place if she is found guilty, as charged. And, yes, victim impact statements will be allowed. I am not sure of AZ law. I think it differs from state to state. Typically, the jury will vote to recommend what sentence they believe should be imposed. In MA, there is no death penalty. A conviction of first degree murder carries an automatic life in prison with no parole. In those cases, the judge must impose the sentence. But, there are some states in which the judge has the final decision as to whether they follow the jurors recommendation or they can impose a sentence of their own choosing. Any members versed in AZ law?

When you add to that the fact that Jodi is being caught in lies (like about the 3rd gas can), which will clearly demonstrate to the jury that she was willing to look THEM right in the face with extreme sincerity and tell THEM bald faced lies. The judge will instruct the jury that if they find Jodi lacks credibility, they do not have to believe any of her testimony.
I think both premeditation and cruelty will be proved beyond a reasonable doubt.

As to premeditation, it is defined under AZ criminal code, chapter 11 (Homicide), Statute #13-1101, Definitions: "Premeditation means that the defendant acts with either the intention or the knowledge that he will kill another human being, when such intention or knowledge precedes the killing by any length of time to permit reflection...an act is not done with premeditation if it is the instant effect of a sudden quarrel or heat of passion."
Dr. DB is trying to present some psychobabble about how certain crime scenes reflect heat of passion as opposed to premeditation which Martinez is trying to block b/c it is BS and has nothing to do with the legal definition of premeditation.
In the history of horrible criminals, have you ever seen a killer who:
1. Did not cooperate with the police or investigators AT ALL? Just not one bit at all, everything she said was a lie, a denial, or a misdirection.
2. Was in such a state of complete denial? With all of her lies now obvious, she continues to weave crazy stories that make no sense (holster, Travis loaded gun, Travis had the knife)
3. Was so full of herself? Just a little fucking superstar up there on the stand telling the world about KY Jelly and correcting the judge & lawyer mistakes.
4. Was so great at taking a life in her first try? She was cunning and clever and controlled the situation to her advantage. It got messy but she won.
Jodi Arias is the last and only person in the world pretending that she didn't fully intend to kill him. When they find her guilty and she has to plead for her life, I wonder what she will come up with then...
Maybe finally offer up her accomplice?
